NYC University Professors Take Aim at Forced Union ‘Representation’

CUNY professors’ lawsuit argues NY law forces them under power of anti-Semitic union

NEW YORK, NY – For decades, government sector union bosses have relied on two pillars of coercion — forced dues and forced representation — to maintain their grip on power over America’s public servants and the public services citizens rely on.

While the Supreme Court in the 2018 National Right to Work Foundation-won Janus v. AFSCME Supreme Court case recognized that forcing government employees to pay dues to stay employed violates the First Amendment, a new Foundation-assisted civil rights lawsuit from six City University of New York (CUNY) system professors may finally defeat union bosses’ privilege to impose union representation over the objections of public workers.

CUNY professors Jeffrey Lax, Michael Goldstein, Avraham Goldstein, Frimette Kass-Shraibman, Mitchell Langbert, and Maria Pagano sued the AFL-CIO-affiliated Professional Staff Congress (PSC) union, CUNY executives, and New York State officials in January, challenging New York State’s “Taylor Law” that gives unions monopoly bargaining privileges in public sector workplaces like CUNY.

The plaintiffs, most of whom are Jewish, oppose the union’s “representation” on the grounds that union officials and adherents have relentlessly denigrated their religious and cultural identity. Several of the plaintiffs exercised their Janus right to cut off dues after PSC officials rammed through a resolution in June 2021 that they found “anti-Semitic, anti-Jewish, and anti-Israel,” according to the lawsuit.

Discrimination Cited in Groundbreaking First Amendment Case

The lawsuit, which was filed with legal aid from both the National Right to Work Foundation and Pennsylvania-based Fairness Center, says: “Despite Plaintiffs’ resignations from membership in PSC, Defendants . . . acting in concert and under color of state law, force all Plaintiffs to continue to utilize PSC as their exclusive bargaining representative.”

The resolution is not nearly the worst example of PSC officials’ anti-Semitism, according to the lawsuit. Prof. Michael Goldstein asserts that adherents of PSC are waging a campaign to get him fired and have targeted him with harassment and threats such that he must have an armed guard accompany him on campus. Prof. Lax cites in the lawsuit a determination he has already received from the Equal Employment Opportunity Commission (EEOC) that “PSC leaders discriminated against him, retaliated against him, and subjected him to a hostile work environment on the basis of religion.”

While all of the professors take issue with PSC bosses’ radicalism, they also want to break free from internal conflicts within the large and disparate unit, which consists of full-time, part-time, and adjunct teaching employees and others. Prof. Kass-Shraibman states in the lawsuit that “instead of prioritizing the pay of full-time faculty, PSC expended resources advocating on behalf of teachers in Peru, graduate students at various other universities and the so-called ‘Occupy Wall Street’ movement.”

On top of all that, Profs. Avraham Goldstein, Kass-Shraibman, and Langbert contend that PSC officials aren’t even respecting their First Amendment Janus rights. Although all three professors clearly indicated they wanted to cut off financial support to the union, the lawsuit explains that “Defendants PSC and the City . . . have taken and continue to take and/or have accepted and continue to accept union dues from [their] wages as a condition of employment . . .” in violation of Janus.

“I had paid thousands of dollars in union dues for workplace representation, not for political statements or attacks on my beliefs and identity,” Prof. Avraham Goldstein wrote in a piece for The Wall Street Journal. “I decided to resign my union membership and naively thought I could leave the union and its politics behind for good.”

“I was wrong,” recounted Prof. Goldstein. “Union officials refused my resignation and continued taking union dues out of my paycheck.”

Suit Seeks Damages and to Overturn NY Law Authorizing Union Control

The lawsuit seeks a declaration from the U.S. District Court for the Southern District of New York that the Taylor Law’s imposition of monopoly union control is unconstitutional, and that the defendants cease “certifying or recognizing PSC, or any other union, as Plaintiffs’ exclusive representative without their consent.” The lawsuit also demands the union and university return dues seized in violation of Janus to Profs. Avraham Goldstein, Kass-Shraibman, and Langbert.

“By forcing these professors into a monopoly union collective against their will, the state of New York mandates that they associate with union officials and other union members who take positions that are deeply offensive to these professors’ most fundamental beliefs,” observed National Right to Work Foundation President Mark Mix. “New York State’s Taylor Law authorizes such unconscionable compulsion. It is time federal courts fully protect the rights of government employees to exercise their freedom to disassociate from an unwanted union, whether their objections are religious, cultural, financial, or otherwise.”

General Motors Worker Forces UAW Bosses to Stop Seizing Dues for Politics

Illegal seizures came after multi-billion-dollar Big Labor political spending

A massive UAW embezzlement scandal didn’t stop UAW officials from ignoring at least two attempts by Roger Clemons to exercise his right to stop subsidizing union political activity.

ROCHESTER, NY – Even after a sweeping federal corruption probe that has resulted in jail sentences for at least 12 union executives, it seems some United Auto Workers (UAW) officials haven’t learned their lesson regarding misuse of worker funds.

Rochester General Motors employee Roger Clemons this January won a settlement forcing UAW officials at his plant to stop illegally funneling money from his paycheck into union politics. Clemons filed federal charges in September 2021 against UAW Local 1097 and the UAW’s international branch, after union agents ignored his requests to opt-out of funding the union’s political agenda. He received free legal representation from National Right to Work Foundation staff attorneys.

A Foundation-won settlement required UAW international and local officials to give back to Clemons all money that was deducted from his paycheck in violation of the Foundation-won CWA v. Beck Supreme Court decision. Beck forbids union officials from forcing workers under their control to fund union politics.

Because New York State lacks Right to Work protections for its private sector workers, union officials can legally force workers to pay a reduced amount of union dues under threat of termination. In Right to Work states, union membership and all union financial support are strictly voluntary.

UAW Chiefs Repeatedly Violated Worker’s Beck Rights

Clemons stated in his September 2021 charge against UAW Local 1097 officials that UAW officials had a history of flouting his Beck rights, failing to reduce his union dues even after he ended his union membership and became a “Beck objector” in October 2019. “Only after Mr. Clemons filed an [earlier] unfair labor practice charge . . . did the union comply with the requirements of the law,” the charge noted, detailing that union officials finally sent him rebate checks in June and July 2020 for excess dues they took from his paycheck.

However, UAW officials continued to create obstacles for Mr. Clemons’ Beck rights. The September 2021 charge asserted that despite Clemons renewing his Beck objection in October 2020, he then did not receive “a single rebate check or a reduction in the dues deducted from his wages” for almost a year.

Clemons also charged General Motors for its role in enforcing the illegal dues deductions.

The settlement now forbids UAW officials from “accept[ing] dues or fees which have been deducted from the paycheck of Roger Clemons, or any other Beck objector, which are in excess of the amount we can lawfully charge to Beck objectors.” UAW officials also have returned dues that they seized from Clemons above the reduced Beck amount.

Union officials devote enormous sums to political activity. A report the National Institute for Labor Relations Research (NILRR) released in 2021 revealed that union officials’ own Department of Labor filings show over $2 billion in political spending during the 2020 election cycle, primarily from dues-stocked union general treasuries. Another study found that actual union spending on political and lobbying activities likely topped $12 billion during the 2020 cycle.

Union Bosses Likely to Splash Cash on 2022 Midterm Elections and Beyond

“Rank-and-file workers should know they have a right to refuse to fund union politics, especially with union political spending in 2020 having approached record numbers and midterm elections coming up,” commented National Right to Work Foundation Vice President and Legal Director Raymond LaJeunesse. “Workers under UAW control, like Mr. Clemons, have special reason to be on guard, given the UAW’s perennial interest in politics, and because several UAW officials now find themselves behind bars for embezzlement and corruption.”

NYC Car Wash Workers Kick Out Unwanted RWDSU Union Officials

NEW YORK, NY – In 2018, Ervin Par, an employee of Main Street Car Wash in Queens, NY, explained why he and his coworkers overwhelmingly wanted Retail, Wholesale, and Department Store Union (RWDSU) officials out of their workplace: “They just come and collect their fees, but I don’t see an economic benefit from the union.”

“Among my colleagues, there’s a majority that doesn’t want the union,” Par told Reason magazine in an interview at the time. Now, after a three-year effort to vote out RWDSU officials, Par and his coworkers have finally succeeded with free legal aid from National Right to Work Foundation staff attorneys.

Soon after Par submitted an October petition signed by enough of his coworkers to prompt the National Labor Relations Board (NLRB) to conduct an employee vote whether to eject the union, RWDSU officials filed paperwork ending their control over the facility. Notably, RWDSU union officials fled Main Street Car Wash before the NLRB had conducted the union decertification election for Par and his coworkers — likely in an attempt to avoid an embarrassing, overwhelming rejection in the vote.

Car Wash Employees Endured Years of Forced Dues, Union “Blocking Charges”

Par also rallied his coworkers in 2018 to oust the union, but their valid petition for a decertification election was thwarted by “blocking charges” from RWDSU officials. Because Par and his colleagues work in non-Right to Work New York, the delays meant that they were forced to pay dues to an unpopular union for almost three more years just to keep their jobs. In contrast, in Right to Work states all union financial support is strictly voluntary.

Par and his coworkers’ desire for freedom from union control is not uncommon. According to reports, in 2018 Main Street Car Wash was one of only six car washes in New York City still under union monopoly control, a number that had been declining following other union departures due to lack of employee support.

RWDSU Bosses Oppose Will of Rank-and-File Workers Across Country

The RWDSU is notably the same union that Bessemer, AL, Amazon employees rejected decisively during a highly publicized April 2021 union election. Despite that election loss, RWDSU officials are still trying to install themselves at the Bessemer facility. Litigation continues over whether RWDSU lawyers will nullify the workers’ vote in which barely 12% of eligible voters supported union bosses’ monopoly “representation.”

Atlanta, GA-area employees of water treatment company Ecolab have also recently received free Foundation legal assistance in their attempt to remove RWDSU officials.

“Mr. Par and his coworkers persevered for almost three years to end RWDSU union officials’ grip on power in their workplace,” commented National Right to Work Foundation Vice President Patrick Semmens. “Although we’re glad the employees have finally been able to exercise their right to remove RWDSU, union officials should not have been able to manipulate the rules to stifle the decertification effort for so long.”

“RWDSU union officials have a penchant for challenging the will of the very employees they claim to ‘represent.’” Semmens added. “Workers across the country who seek to remove unwanted RWDSU presence in their workplace should contact the Foundation for free legal aid in exercising their rights.”

Teamsters Union Charged with Illegally Threatening UPS Worker: ‘Join Union or Be Fired’

QUEENS, NY – With free legal aid from the National Right to Work Legal Defense Foundation, New York City UPS warehouse worker Kamil Fraczek has filed a National Labor Relations Board (NLRB) charge against Teamsters Local 804. The charge came after a Teamsters union official made repeated threats to his job and lied about his legal rights.

Union Official Refused to Respect Worker’s Rights under Beck Decision

When Fraczek began working at the warehouse full-time, a Teamsters representative tried to mislead him by telling Fraczek he must become a union member and sign documents authorizing dues deductions from his paycheck. Fraczek specifically asked about other options, but the union representative told him that if he did not sign the forms, Teamsters officials would ask UPS to fire him.

Because New York is a forced-unionism state that doesn’t protect workers with a Right to Work law, Fraczek can be required to pay some union fees as a condition of his job.

However, under long-standing federal law, workers cannot be required to become formal union members nor can they be required to pay full union dues even in non- Right to Work states. Under the Supreme Court’s 1988 CWA v. Beck decision, won by National Right to Work Legal Defense Foundation attorneys, no private sector worker can be compelled to financially support union activities unrelated to bargaining.

Union Misinformation Continues Even after Employee Demanded Rights

Expenses which can’t be charged to non-members under Beck include political expenditures and members-only activities.

Knowing his actual rights, Fraczek returned to the Teamsters official asking to be recognized as a non-member and Beck objector. He provided a letter to the representative stating his intention to pay only reduced fees and declining union membership.

As the unfair labor practice charge states, instead of accepting Fraczek’s request, the Teamsters official doubled down on his prior illegal threats. He demanded that Fraczek pay full dues and sign membership documents or face termination.

The official falsely claimed that only supervisors can opt out of the union, and that the federal laws protecting workers from funding union political activities only apply in Right to Work states, not in forced-unionism states like New York.

In response, Fraczek’s Foundation staff attorneys filed an NLRB charge asserting his right to pay reduced fees under Beck and not to join the union.

According to the charge, “Local 804’s agent has repeatedly tried to mislead Mr. Fraczek about his rights and has invoked the Union’s power to get him fired, all in an effort to coerce Mr. Fraczek into signing the membership and dues deduction authorization form…”

“Union officials are perfectly willing to tell outright lies to independent-minded workers who object to union membership,” said National Right to Work Foundation President Mark Mix. “Union bosses blatantly ignore the law just to protect their forced-dues revenue stream, and it is workers like Mr. Fraczek who pay the price.”

New York City Preschool Teachers and Other Employees Vote to End Unwanted UFT Union ‘Representation’

New York City, NY (March 9, 2017) – Employees of the Birch Family Services Manhattan Early Childhood Center in Washington Heights, Manhattan have voted overwhelmingly to remove the United Federation of Teachers (UFT) union from their workplace and end the UFT’s designation as their monopoly bargaining representative.

Under the National Labor Relations Act, private-sector employees in unionized workplaces have the right to initiate a decertification election to remove a union. Recently, employees in the Birch Family Services Manhattan Early Childhood Center signed and submitted a decertification election petition to the National Labor Relations Board (NLRB). The employees who voted to remove the union included teachers, teachers’ aides, teaching assistants, nurses and other employees.

National Right to Work Legal Defense Foundation staff attorneys provided free legal advice to employees seeking to remove the union, including on how to navigate the often-complicated NLRB process for successfully getting a vote to remove the union officials as the school employees’ NLRB-designated monopoly bargaining representative, a process known as decertification.

Relying on that advice from Foundation staff attorneys, the employees collected signatures from their coworkers in support of the decertification vote and submitted the petition to the NLRB, resulting in a decertification vote that was held on February 28, 2017. At the end of the vote, the tally stood 37-15 in favor of decertifying the UFT and removing them from the workplace.

“The Foundation is committed to helping workers like these New York City preschool employees assert their right to remove union officials whom they feel are a detriment to their school and their students,” said Mark Mix, president of the National Right to Work Foundation. “Foundation staff attorneys stand ready to continue defend and protect these educators’ choice if there is union boss retaliation.”

National Right to Work Foundation staff attorneys are prepared to defend the workers’ choice should union officials attempt to overturn the results of the vote.

Constitutional challenge would free childcare providers from being forced to accept unwanted union ‘representation’

On December 9th, a group of New York childcare providers, with free legal assistance from National Right to Work Foundation staff attorneys, petitioned the Supreme Court to strike down a compulsory unionism scheme on First Amendment grounds. The childcare providers are challenging a New York law that empowers union officials to speak for all childcare providers, including those who have not joined and do not support the union, when bargaining with state government.

Foundation attorneys argue that the current arrangement violates the providers’ First Amendment right to choose with whom they associate to petition their government by naming a union as their state-designated lobbyist.

Recently, The Pacific Legal Foundation together with the Goldwater Institute, Fairness Center, Pioneer Institute, and Empire Center, filed an amicus brief supporting the petition, arguing that Americans cannot be compelled to speak or associate, or petition the government, against their wishes. New York Verizon Workers Win Settlement Against Union Officials For Illegal Retaliation

CWA Union officials illegally attempted to levy five figure fines against Verizon employees who exercised rights to work despite union boss-initiated work stoppage

New York, NY (January 17, 2017) – In mid-October, 2016, seven Verizon employees filed federal unfair labor practice charges with the National Labor Relations Board (NLRB) against the Communications Workers of America (CWA) union for violating federal labor law. The violations came after the employees exercised their right to resign their union memberships during a high profile union boss-ordered strike last year.

After CWA union officials ordered the strike, the workers chose to resign from the union and return to work. Later they were notified by CWA officials that they were being tried on internal “union discipline” charges, despite the fact that these workers were not union members when they returned to work and thus are protected by federal law.

On September 15th, the union held an internal union trial and fined the workers for going to work. Soon after, the workers were informed by letter that they had been fined sums of between nine and thirteen thousand dollars each.

Now, CWA Local 1107 union officials were required to settle the NLRB charges filed against them. The settlement requires that a notice describing the workers’ rights, and stating that the illegal fines imposed by the union bosses have been rescinded, be posted in the facility where the workers are employed.

“Union officials were caught red-handed violating the rights of workers with illegal five-figure fines just because the employees exercised their right to return to work in order to support their families,” said Mark Mix, President of the National Right to Work Foundation. “Although these employees have won their legal battle, it is outrageous that these types of illegal retaliatory fines remain common when workers choose to exercise their right to remain on the job and defy union-ordered strike demands.”

Verizon Workers Hit CWA Union Officials with Charges for Retaliation for Working During Strike

SPFPA union officials continued to collect dues over workers’ objections despite majority vote by employees that ended mandatory payments

New York, NY (April 3, 2017) – Four Brooklyn Verizon employees have filed federal unfair labor practice (ULP) charges against the Communications Workers of America (CWA) union for violating federal labor law after the employees exercised their right to resign their union memberships during a high-profile strike in May 2016. The charges were filed with free legal assistance provided by National Right to Work Legal Defense Foundation staff attorneys.

In April 2016, CWA union officials announced a coordinated work stoppage at Verizon facilities and ordered workers up and down the East Coast, from Massachusetts to Virginia, to abandon their jobs. CWA Local 1109, which is the subject of the ULP charges, participated in the multi-state strike.

Soon after CWA union officials ordered the strike, the four workers who filed the charges chose to resign from the union and returned to work. Under federal law, workers cannot be compelled to join a union-boss ordered strike. However, under a 1972 National Labor Relations Board (NLRB) ruling, to protect themselves from internal union discipline they must resign their formal union membership before to returning to work, as each of these workers did.

On March 16, 2017, these workers were notified by CWA officials that they were being tried by the union on internal charges of violating the union’s constitution, despite the fact that these workers were not union members when they returned to work and thus are protected by federal law. These four workers turned to the Foundation for assistance, and filed ULP charges with the NLRB.

The union has notified the workers that an internal tribunal, which has no legal jurisdiction over the workers, is scheduled for April 16.

“Once again union officers are blatantly violating the rights of the very workers they claim to represent,” said Mark Mix, President of the National Right to Work Foundation. “It is outrageous that union officials are resorting to this type of retaliation to ‘punish’ workers who chose to return to work in order to provide for themselves and their families.”

“The Foundation has successfully defended a number of Verizon workers in the New York area who were also threatened with sham trials and five-figure illegal fines, and we are eager to assist these and any other workers in defending their workplace rights,” added Mix.

In 2016, Foundation staff attorneys defended eleven Verizon workers from retaliation by CWA and IBEW union officials after the same April 2016 East Coast strike. Seven of the workers were fined up to $14,000 each for exercising their federally protected rights. The remaining four were threatened by union bosses with “union discipline” that would have resulted in similar fines. In all eleven cases, union officials were forced to settle with the workers with all of the illegal strike fines and threats rescinded.
