Amicus brief: ILA union strategy to gain control over all jobs at Charleston, SC’s Leatherman Terminal will likely lead to termination of 270 port workers

Washington, DC (October 27, 2023) – Today, the National Right to Work Foundation filed an amicus brief at the U.S. Supreme Court in South Carolina Ports Authority (SCPA) v. National Labor Relations Board (NLRB). In the case, the SCPA is challenging International Longshoremen’s Association (ILA) union officials’ legal gambit to gain control of all port jobs at Charleston, SC’s Hugh K. Leatherman Terminal. Foundation staff attorneys emphasize that the union’s scheme will throw 270 nonunion port workers out of their jobs unless the Court intervenes.

The SCPA is battling the Biden NLRB’s December 2022 ruling permitting ILA union bosses, pursuant to a legally dubious monopoly arrangement they have with the United States Maritime Exchange (USMX), to file lawsuits to prevent cargo carriers from docking at Leatherman until the union gains control of crane lift equipment jobs at the facility. State employees, who are free from the union’s control, have performed this work for SCPA since Leatherman opened in March 2021, and for decades at the other port facilities.

The Foundation, a nonprofit legal organization that provides free legal aid to workers facing compulsory unionism abuses, informs the Justices in its amicus brief that allowing ILA union bosses to succeed in enforcing their alleged monopoly will lead to unconscionable consequences for the Leatherman port workers.

“In short, the decisions below, if affirmed, will cause grievous harm to 270 non-union Ports Authority workers and their families,” the brief reads. “The Foundation submits this brief to provide a voice for the otherwise voiceless non-union Ports Authority workers, so the Court has a clear view of the stakes involved for the workers and their families if the decisions below stand.”

Union’s Aggressive Pursuit of Monopoly Power Harms Workers, Breaks Federal Labor Law

The brief spells out the dire consequences of the ILA union’s maneuver for Leatherman’s 270 state employees, who are protected by state law from monopoly union control. It explains that South Carolina spent over $1 billion to develop the terminal, but the ILA union’s scheme, if allowed to continue, would require South Carolina to both fire all the nonunion state employees of the port, and turn control of crane jobs over to a private contractor with an ILA union contract.

The devastating effects for current employees wouldn’t stop there if the ILA is victorious in the case. The brief points out that, even if fired state workers were to seek new employment at Leatherman with a private contractor under the union’s control, the ILA would likely prioritize its existing workers far above the former state workers because of union seniority provisions and hiring hall referral rules.

Additionally, the brief points out that the ILA union’s enforcement of its alleged monopoly violates the explicit prohibition on secondary boycotts in the National Labor Relations Act (NLRA), the federal law the NLRB is responsible for enforcing. Further, by granting the ILA control over the jobs of state employees who have never chosen to affiliate with the ILA, the NLRB is undermining the NLRA’s fundamental premise of employee free choice – the rule that “the employees pick the union; the union does not pick the employees.”

ILA Union Has History of Malfeasance and Exploitation

The brief discusses the many reasons why these South Carolina public employees would want to avoid associating with the ILA, including the union’s track record of corruption. The New York Daily News reported in 2022 that ILA chiefs negotiated deals by which mob-linked longshoremen in the New York/New Jersey area could get paid for 27 hours of “work” per day. The ILA hierarchy organized such arrangements while trying to shut down ports like Leatherman, which merely allow both unionized and union-free workers to work side-by-side.

“In their effort to maintain and expand their stranglehold on port employment all across the East Coast, ILA union bosses are putting the livelihoods of hundreds of Leatherman employees in jeopardy – employees who work side-by-side with unionized workers at Leatherman and have done nothing wrong,” commented National Right to Work Foundation President Mark Mix. “The Supreme Court must reverse the Biden NLRB’s erroneous ruling letting this union gambit move forward, bearing in mind that the real victims here are the nonunion port workers whose jobs ILA officials want to seize.”

AUSTIN, TX – Union officials spend billions of dollars to influence the political system every election cycle. This is why they are so desperate for forced-dues power — it gives them a guaranteed stream of revenue to sustain their agendas, regardless of whether workers support the union hierarchy’s aims.

But workers are increasingly taking advantage of their rights under Right to Work laws and the landmark National Right to Work Foundation-won Janus v. AFSCME U.S. Supreme Court decision to refrain from financially supporting union bosses of whom they do not approve.

Union bosses in Austin, TX, have apparently worked around this dilemma by shifting the burden for funding the union agenda to taxpayers. Through a so-called “official time” scheme, City of Austin employees who are union officials receive compensation from the public purse for conducting union business on the clock.

‘Official Time’ Boosts Inherently Political Government Union Agenda

Foundation attorneys recently filed a brief in the Texas Supreme Court case Roger Borgelt v. City of Austin, arguing that the Foundation-won Janus decision definitively shows why Austin’s scheme violates the Texas Constitution’s prohibitions against payouts of public funds to serve private interests (known as the “Gift Clauses”). The High Court ruled in Janus that forcing public sector workers to fund any union activities as a condition of employment violates the First Amendment, and that union dues can only be deducted from a public sector worker’s paycheck with his or her freely given consent.

An “official time” scheme, which instead forces taxpayers into funding those same union activities, “conflicts with the Supreme Court’s reasons for holding in Janus that it violates the First Amendment to require public employees to subsidize union activities,” says the Foundation’s brief.

The Foundation points out in its brief the Court’s Janus holding that all public sector union undertakings “constitute speech and petitioning on matters of political…concern,” and that by funneling taxpayer money into such speech “the City is effectively paying individuals to lobby the City for a private advocacy organization and its members.”

“The notion that this political advocacy predominantly serves a public purpose, as opposed to predominantly benefiting the private organization, is untenable,” the brief reads.

The brief also refutes an assertion from a lower Texas court that “official time” payments made by the city are actually part of union officials’ compensation for their normal job duties. This defies Janus’ reasoning that public employees who are also union officials “do not act as government agents pursuing their official job duties when they act as union officials.”

“For example, in granting paid leave to employee Bob Nicks to act as the Union’s president, the City is not paying Mr. Nicks for his services as a firefighter or as a public servant,” the brief explains. “The City is paying Mr. Nicks for his services as an agent of a private organization.”

The brief also reveals the disturbing implications of the union-backed argument that taxpayer subsidies for “official time” are needed to maintain harmonious relations between the city and the union: “If respondents contend that Union officials would disrupt City services if they did not receive [‘official time’], that would make the benefit akin to the City paying protection money” to union officials, reads the brief.

Union Bosses Should Not Get Public Funds to Pursue Union Interests

“The Texas Supreme Court should recognize that union officials are not entitled to a slice of taxpayer funds to ‘bargain’ against public interests,” commented National Right to Work Foundation Vice President and Legal Director Raymond LaJeunesse. “Texas’ Gift Clauses forbid the payout of public funds for activities that don’t have a tangible public benefit, and it’s hard to think of an arrangement that violates the Clauses more plainly than letting union bosses pursue private union business on the taxpayer dime.”

“Although Janus now protects public employees around the country from being forced to fund union activities and speech against their will, unfortunately many states and municipalities across the country permit union bosses to subsidize those same inherently political activities using direct payment of tax dollars,” LaJeunesse added.

“If union bosses cannot convince rank-and-file workers to voluntarily fund such activities as Janus requires, they should re-examine their priorities, not seek to force taxpayers to pay for what public employees will not.”

Foundation Issues Statement on Glacier Northwest SCOTUS Decision

The Supreme Court of the United States has just ruled that union bosses who orchestrate property damage as part of a strike order aren’t immune to liability in state court.

In Glacier Northwest v. International Brotherhood of Teamsters Local 174, an 8-1 SCOTUS majority rejected Teamsters officials’ argument that the National Labor Relations Act (NLRA) prevented Glacier Northwest, a Washington State-based concrete company, from suing the union in state court for ordering cement truck drivers to abandon their trucks and leave copious amounts of cement spoiled and completely unusable.

National Right to Work Foundation President Mark Mix issued the following statement on the ruling:

The Supreme Court correctly ruled that union officials should not be granted immunity from state lawsuits over deliberate property damage perpetrated during union strike actions. The issue in Glacier Northwest, however, represents only the tip of the iceberg when it comes to union bosses’ special legal privileges – especially concerning the powers union officials have over rank-and-file workers.

As the Foundation noted in its amicus brief in the case, beyond the issue of deliberate property damage, union officials have vast special powers and immunities that no other private entity or individual enjoys. This long list includes not only forcing workers under union ‘representation’ they oppose and then extorting workers to pay union fees or else be fired, but also a court-created exemption from federal prosecution for extortionate violence if it is pursued for so-called ‘legitimate union objectives.’

Ultimately, this case shows how far courts and lawmakers have to go in order to level the playing field and stop allowing union bosses to play by a different set of rules from those that apply to all other citizens and private entities.

WASHINGTON, DC – Unions and union officials already have an enormous number of special privileges under the law enjoyed by no other private organization or individual. Yet those special powers — including forcing workers under monopoly “representation” and union dues payments they oppose — haven’t stopped union lawyers from arguing for even more special exemptions.

In a case now before the U.S. Supreme Court, the Justices are set to decide whether the Washington State Supreme Court was correct when it granted Teamsters union officials immunity from lawsuits filed under state law. The lawsuit in this case concerned vandalism and property damage against an employer that occurred during a union boss-ordered strike.

Union Chiefs Want Blank Check to Target Workers with Property Damage

In Glacier Northwest Inc. v. International Brotherhood of Teamsters Local 174, a construction company sued the Teamsters union over property damage deliberately caused as part of a strike, only to see the Washington Supreme Court overturn the lower court and agree with union bosses’ argument that unions were exempt from such lawsuits.

With the issue now before the nation’s highest court, the National Right to Work Foundation filed a brief in the case arguing that creating such a carve-out is wrong under the law. The Foundation brief says this exemption is dangerous not only to businesses but first and foremost to independent-minded workers, and that union officials’ abundance of government-granted powers should be pared back, not extended. Oral arguments are set for January 10, 2023.

The Foundation explains in the amicus brief that “states’ interest in protecting life, limb, and private property must be respected under principles of federalism” because federal courts usually don’t offer relief for crimes like vandalism and property damage, making state courts the only place where lawsuits can be filed for such behavior. Far from being a concern only for employers who face union strike efforts, the Foundation argues, employees are often targeted by hostile or violent strike behavior and state courts often are the only forum in which they can receive justice.

“For example, in Clegg v. Powers, employees sought damages in state court for union violence and property damage during a strike,” the brief says. “Cases like Clegg demonstrate that the Court should limit” unions’ ability to dodge being sued in state court, it continues.

Foundation: Union Officials’ Special Legal Privileges Shouldn’t Be Expanded

The Foundation’s brief then points out that the Teamsters bosses’ attempt to gain this new legal privilege should be shut down given “the extraordinary privileges and exemptions already granted to unions” by Congress and courts all over the country.

These include, but are not limited to, an exemption from federal law prohibiting extortionate violence, the power to force employees in non-Right to Work states to pay union dues or fees just to stay employed, and the privilege to foist monopoly “representation” over workers against their will — powers no other private entity or individual has.

“This Court should treat unions like all other citizens or entities, clarifying that they can be liable for damages in state courts under ‘the common law rule that a man is held to intend the foreseeable consequences of his conduct,’” the brief concludes.

Unions Shouldn’t Get More Rights Than Regular Citizens

“Union officials’ theory that they should be off the hook in state court for damaging or vandalizing property is outrageous on its face. The law already has plenty of carve-outs and privileges for union hierarchies that no other private organization or citizen gets to enjoy, least of all the workers union bosses claim to ‘represent,'”” commented National Right to Work Foundation Vice President Patrick Semmens.

“Union officials regularly force millions of workers to pay union fees or be fired, and force their ‘representation’ on millions of workers who bitterly oppose it. The Supreme Court should reject this new ploy seeking another union-only exemption to regular laws, and begin to scrutinize and ultimately roll back the many existing union boss special powers.”

New Foundation-backed challenges to Janus restrictions also pending at U.S. Supreme Court

CAMDEN, NJ – Toward the end of 2021, South Jersey Transportation Authority (SJTA) bus driver Tyron Foxworth and his colleagues Doris Hamilton, Karen Burdett, Karen Hairston, Ted Lively, Arlene Gibson, and Stanley Burke decided they had had enough of International Federation of Professional and Technical Engineers (IFPTE) union bosses’ so-called “representation” and opted out of union membership. Union cards they had signed indicated that the union would cease taking money from their paychecks in January 2022.

But, January 2022 came and went, and neither Foxworth nor his fellow independent-minded colleagues saw dues deductions stop. As a result, with free legal representation from National Right to Work Foundation staff attorneys, they filed a First Amendment federal civil rights lawsuit against the IFPTE union. They argued that union officials violated their First Amendment rights under the Foundation-won 2018 Janus v. AFSCME Supreme Court precedent by continuing to seize dues despite their objections.

IFPTE Officials Subjected Drivers to Restrictions They Never Knew About

In Janus, the Court declared it a First Amendment violation to force public sector workers to pay union dues as a condition of employment. It also ruled that union officials can only deduct dues from the paycheck of a public sector employee who has voluntarily waived his or her Janus rights.

Rather than face Foundation staff attorneys in federal court, IFPTE union lawyers backed down and settled the case. As the settlement ordered, union bosses have now given back all money they seized unconstitutionally from Foxworth and his objecting coworkers, plus interest. The settlement also bars the IFPTE union from demanding or seizing any dues from the drivers going forward.

According to Foxworth and his colleagues, IFPTE dues deductions cards led them to believe that dues opt-outs would become effective on either the January or July following a request. However, the union’s monopoly bargaining contract with SJTA recognized dues revocations only in July. The drivers never consented to this greater restriction.

Foundation attorneys argued in the lawsuit that IFPTE union officials, by taking union dues after January 1, 2022, without the workers’ consent, “violate[d] Plaintiffs’ First Amendment right to free speech and association.”

Foxworth and his coworkers’ victory is the latest of numerous Foundation-won cases to vindicate American public workers’ First Amendment Janus rights. In the past few years, class action lawsuits brought by Foundation staff attorneys have led to settlements freeing tens of thousands of Ohio public employees from American Federation of State, County, and Municipal Employees (AFSCME) union schemes illegally restricting the exercise of their Janus rights.

Courageous public workers from California and Nevada are also asking the Supreme Court to take the next step and declare such Janus restrictions clearly violative of the First Amendment.

Lifeguards, Police Officer Battle Blatantly Unconstitutional Restrictions

Foundation attorneys just filed a petition asking the Supreme Court to hear several Southern California lifeguards’ suit against a so-called “maintenance of membership” scheme that California Statewide Law Enforcement Agency (CSLEA) union officials are using to trap the lifeguards in membership and full dues payments years after they resigned, in direct opposition to Janus.

Also awaiting Supreme Court review of her case is Las Vegas police officer Melodie DePierro, who with Foundation aid is battling an arrangement imposed by Las Vegas Police Protective Association (PPA) union officials that forbids the exercise of her Janus rights for over 90 percent of the year.

“Union officials across the country continue to enforce schemes that give them — not the workers they claim to ‘represent– control over the exercise of Janus rights, meaning more money in union coffers while employees’ constitutional rights are squashed,” commented National Right to Work Foundation President Mark Mix. “While many union bosses, aware of the indefensibility of their actions, run screaming from facing Foundation attorneys on Janus issues and settle quickly, American public workers should also know that Foundation attorneys will fight all the way up to the Supreme Court to ensure their First Amendment rights are protected.”

WASHINGTON, DC – In July, sixteen attorneys general threw the support of their states behind Chicago Public Schools educators Ifeoma Nkemdi and Joanne Troesch, who are urging the U.S. Supreme Court to hear their case defending their First Amendment right to cut off union financial support as recognized in the Foundation-won Janus v. AFSCME decision.

In an amicus brief encouraging the High Court to hear the case, attorneys general from Alaska, Alabama, Arizona, Arkansas, Indiana, Kansas, Louisiana, Missouri, Montana, Nebraska, South Carolina, South Dakota, Tennessee, Texas, Utah, and West Virginia argue that “escape period” restrictions like the one that Chicago Teachers Union (CTU) bosses foisted on Troesch and Nkemdi are a widespread threat to public employees’ rights under the Janus Supreme Court decision.

In 2018, the Supreme Court ruled in Janus v. AFSCME that public employees’ First Amendment rights are violated when they are forced to fund a union as a condition of employment. The Court also held that union dues can only be taken from a public employee with an affirmative and knowing waiver of that employee’s First Amendment right not to pay.

Unions Are Seizing Money from ‘Tens of Thousands’ Unconstitutionally, Brief Says

The CTU-concocted “escape period” Nkemdi and Troesch are challenging blocks employees from exercising their First Amendment Janus right to end union financial support except during one month per year. The educators’ petition for writ of certiorari presses the High Court to hear their case to affirm that Janus does not permit union bosses to profit from schemes that constrict workers’ constitutional right to refrain from subsidizing a union.

The states’ amicus brief emphasizes how glaringly union officials have flouted Janus with restrictions, as well as how widespread the schemes are: “Janus has been ignored. Across the country public-sector unions have resisted Janus’s instructions and devised new ways to compel state employees to subsidize union speech. Unions place onerous terms on dues forms that prohibit state employees from opting out of paying dues except during narrow (and undisclosed) windows during the year.”

The brief continues: “Unions refuse to inform state employees that they have a First Amendment right not to pay union dues. And unions refuse to stop collecting dues despite unequivocal employee demands. The result is that tens of thousands of state employees across the country are having dues deducted to subsidize union speech without any evidence that they waived their First Amendment rights . . . .”

Nkemdi and Troesch’s case “implicates these precise concerns” and the Court must hear it, the brief maintains.

In addition to the states’ brief, policy groups Goldwater Institute, Cato Institute, Freedom Foundation, and Liberty Justice Center filed amicus briefs backing the case.

Justices May Already Be Showing Interest in Foundation-Backed Case

In late July, the Supreme Court ordered lawyers for CTU and the Chicago Board of Education to file a response brief to Troesch and Nkemdi’s petition, a signal that some Justices may be interested in taking up the case.

Also pending at the High Court is Foundation attorneys’ anti- “escape-period” case for Susan Fischer and Jeanette Speck, two New Jersey teachers. Both that case and Troesch and Nkemdi’s case are expected to be fully briefed in October, after which the Justices will decide whether to take them.

“As union bosses continue to use deceptive ‘escape period’ arrangements to keep worker money flowing unconstitutionally into their coffers, support continues to roll in from across the country for Troesch and Nkemdi, who are sticking up for independent-minded public servants who simply want to serve their communities without being forced to fund union activities,” observed National Right to Work Foundation President Mark Mix. “The High Court must weigh in to affirm that public workers’ First Amendment rights cannot be confined to union officials’ arbitrary schedules.”

Cuyahoga County Probation Officer Hits Union with Federal Lawsuit for Years of Unconstitutional Dues Seizures

Union officials took full union dues from nonmember officer without consent, then ignored requests to return illegally-seized money

Cleveland, OH (August 25, 2021) – Cuyahoga County probation officer Kimberlee Warren is suing the Fraternal Order of Police (FOP) union in her workplace, charging union officials with breaching her First Amendment right as a public employee to refuse to support union activities. She is receiving free legal representation from National Right to Work Legal Defense Foundation staff attorneys, in partnership with attorneys with the Ohio-based Buckeye Institute.

Foundation staff attorneys contend that FOP union officials ignored her constitutional rights recognized in the landmark 2018 Janus v. AFSCME U.S. Supreme Court decision, which was argued and won by Right to Work Foundation staff attorneys.

In Janus, the Justices declared it a First Amendment violation to force any public sector employee to pay union dues or fees as a condition of keeping his or her job. The Court also ruled that public employers and unions cannot take union dues or fees from a public sector employee unless they obtain that employee’s affirmative consent.

The federal lawsuit says that Warren was not a member of the FOP union before the Janus decision in June 2018, but FOP union bosses collected union dues from her wages without her consent. According to the complaint, this continued until around December 2020, when Warren notified union officials that they were violating her First Amendment rights by taking the money and demanded that the union stop the coerced deductions and return all money that they had taken from her paycheck since the Janus decision.

When the deductions ended, FOP chiefs refused to give back the money that they had already seized from Warren in violation of her First Amendment rights. They claimed the deductions had appeared on her check stub and thus any responsibility to cease the deductions fell on her – even though to her knowledge they had never obtained permission to opt her into membership or to take cash from her paycheck in the first place.

According to the lawsuit, Warren also asked FOP bosses to provide any dues deduction authorization document she might have signed. FOP officials rebuffed this request as well.

The High Court ruled in Janus that, because all activities public sector unions undertake involve lobbying the government and thus are political speech, forcing a public employee to pay any union dues or fees as a condition of keeping his or her job is forced political speech the First Amendment forbids.

Union bosses were permitted by state law before the Janus ruling to seize from nonmember workers’ paychecks only the part of dues they claimed went toward “representational” activities. FOP union officials took this amount from Warren prior to Janus. However, they furtively designated her as a member following the decision, and began taking full dues, deducting even more money from her wages than they did before Janus despite the complete lack of any consent.

Warren is now suing the FOP union in the U.S. District Court for the Northern District of Ohio. Her lawsuit seeks the return of all dues that FOP union officials garnished from her paycheck since the Janus decision was handed down. It also seeks punitive damages because FOP showed “reckless, callous” indifference toward her First Amendment rights by snubbing her refund requests.

Warren’s lawsuit comes as other Foundation-backed lawsuits for employees defending their First Amendment Janus rights seek writs of certiorari from the Supreme Court. This includes cases brought for Chicago and New Jersey public educators which challenge “window periods” that severely limit when they and their fellow educators can exercise their First Amendment right to stop union dues deductions, sometimes to periods as short as ten days per year. In a California federal court, Foundation staff attorneys are also aiding a University of California Irvine lab assistant in fighting an anti-Janus state law that gives union bosses full control over whether employers can stop sending an employee’s money to the union after that employee exercises his or her Janus rights.

“All over the country, union officials are stopping at nothing to ensure they can continue ignoring workers’ First Amendment Janus rights and continue siphoning money from the paychecks of dissenting employees,” commented National Right to Work Foundation President Mark Mix. “After Janus was handed down, FOP union officials in Warren’s workplace could have come to her to attempt to get her to support the union voluntarily, but tellingly instead they began surreptitiously siphoning full dues out of her paycheck without her consent in direct contravention of the Supreme Court.”

“Despite her repeated requests, FOP bosses have continued to trample Warren’s Janus rights, and Foundation staff attorneys are fighting to stop this gross injustice against her and punish FOP bosses for their brazen behavior,” Mix added.

Teachers continue battling Chicago teacher union “escape period,” file brief with Supreme Court

CHICAGO, IL – With free legal aid from National Right to Work Foundation staff attorneys, Chicago Public Schools (CPS) educators Ifeoma Nkemdi and Joanne Troesch are appealing to the U.S. Seventh Circuit Court of Appeals their class-action civil rights lawsuit against the Chicago Teachers Union (CTU) and The Board of Education of the City of Chicago (Board) for unconstitutional dues seizures.

The suit challenges a union policy that blocks teachers from exercising their First Amendment right under the Foundation-won Janus v. AFSCME decision to stop payments to the union outside of the month of August. It also seeks refunds of all dues seized from dissenting educators by the Board.

In Janus, which was argued by one of Troesch and Nkemdi’s Foundation staff attorneys, the High Court struck down mandatory union fees as a violation of government employees’ First Amendment rights. The Court ruled that taking any dues without a government worker’s affirmative consent violates the First Amendment, and further made it clear that these rights cannot be restricted absent a clear and knowing waiver.

The appeal comes after the U.S. District Court for the Northern District of Illinois dismissed Troesch and Nkemdi’s lawsuit on February 25, 2021. The court sided with CTU and Board officials, ruling they didn’t violate Janus by forbidding the two educators from exercising their First Amendment right to cut off union dues except for one month a year. This prompted Foundation attorneys to appeal the case to the Seventh Circuit.

CTU Bosses Pilfered from Paychecks Even after Educators Opted out

Troesch and Nkemdi’s lawsuit explains that they “did not know they had a constitutional right not to financially support” the union hierarchy until the fall of 2019. The pair independently discovered their First Amendment Janus rights while they were researching how to exercise their right to continue working during a strike that CTU bosses ordered in October 2019, the lawsuit notes. They sent letters the same month to CTU officials to exercise their Janus right to resign union membership and cut off all dues deductions.

Both educators received no response until November of that year. CTU officials then confirmed receipt of the letters but said that they would continue to seize dues from the educators’ paychecks “until September 1, 2020.” CTU bosses relied on the fact that Troesch and Nkemdi had not submitted their letters within a union boss-created “escape period,” which limits when teachers can exercise their First Amendment right to end dues deductions.

Troesch and Nkemdi contend that CTU and Board officials’ attempt to curb employees’ right to stop dues deductions with an “escape period,” and the Board’s seizure of dues after they dissociated from the union, both violate the First Amendment. Their lawsuit seeks to make the CTU union and the Board stop enforcing the “escape period,” and notify all bargaining unit employees that they can end the deduction of union dues at any time and “retroactively exercise that right.”

Troesch and Nkemdi’s efforts to defeat union boss-concocted “escape period” schemes don’t stop at their lawsuit. The pair submitted an amicus brief in Belgau v. Inslee, which is currently pending on a petition for certiorari at the U.S. Supreme Court.

New Legal Brief Backs SCOTUS Challenge to Union “Escape Period” Scheme

Belgau involves a group of Washington State employees, led by Melissa Belgau, who are fighting similar policies imposed by Washington Federation of State Employees (WFSE) union officials and the State of Washington.

University of California Santa Barbara employee Cara O’Callaghan, Maumee City (Ohio) School District employee Chelsea Kolacki, and Springfield (Ohio) Local School District employee Michelle Cymbor also joined this brief. All of them have been subjected to First Amendment violations similar to those at issue in Belgau and the Chicago educators’ case.

Foundation staff attorneys provided free legal aid in filing the brief, and currently represent public servants in at least 14 cases where union officials have tried to confine their First Amendment Janus rights to an “escape period.”

“Each day that the courts fail to fully enforce Janus is another day that union bosses are allowed to seize the hard-earned money of dissenting public servants in clear violation of their First Amendment rights,” commented National Right to Work Foundation President Mark Mix. “The Foundation is proud to stand with Ms. Troesch and Ms. Nkemdi, and will continue to defend all educators who simply want to serve their students and community without being forced to subsidize union activities.”

NEW ORLEANS, LA – With free legal representation from National Right to Work Legal Defense Foundation staff attorneys, two airline workers have filed cases challenging union boss policies that require workers to opt out in order to exercise their First Amendment right not to fund union political activities, as recognized in the Foundation-argued 2018 Janus v. AFSCME Supreme Court decision.

The two federal class-action lawsuits were brought for United Airlines fleet service employee Arthur Baisley and JetBlue Airways pilot Christian Popp. They are currently pending in the U.S. Courts of Appeals for the Fifth and Eleventh Circuits respectively.

Workers Challenge Compelled Political Speech

Baisley’s case against the International Association of Machinists (IAM) union has been fully briefed and is tentatively set for oral argument the week of November 30. Meanwhile, the opening brief for Popp’s case against the Air Line Pilots Association (ALPA) union was filed in early October.

The lawsuits contend that under Janus and the 2012 Knox v. SEIU Supreme Court cases — both argued and won by Foundation staff attorneys — no union dues or fees can be charged for union political activities without a worker’s affirmative consent.

Despite this, union officials at the IAM and ALPA enforce complicated opt-out policies that require workers to object to funding union political activities or else pay full union dues. Foundation staff attorneys argue that the Janus decision’s opt-in requirement applies to airline and railroad employees covered by the Railway Labor Act (RLA), taken together with longstanding precedent protecting private sector workers from being required to pay for union political and ideological activities.

Mr. Baisley and Mr. Popp both work in Right to Work states (Texas and Florida, respectively), but the RLA preempts state law. Consequently, they can be forced to pay union dues or fees or be fired. Even under the RLA, however, union bosses cannot legally force workers to pay for political activities.

Cases Could Expand Janus Protections to Private Sector

The lawsuits argue IAM and ALPA’s opt-out policies are designed to trap unwilling participants into full dues in violation of their First Amendment rights. This forces workers to subsidize union political activities against their will, including the part of full dues that union officials use to support their radical political agenda and handpicked candidates for office.

“IAM and ALPA union officials have demonstrated a blatant disregard for the rights of the very workers they claim to represent by creating complicated obstacles for independent-minded workers who want to exercise their right not to fund union ideological activities,” said National Right to Work Foundation Vice President Patrick Semmens. “Although Janus’ biggest impact was to secure the First Amendment rights of all public employees across the nation not to be required to fund Big Labor, these cases demonstrate that Janus’ implications can also protect the rights of private sector workers.”

Two years after Foundation staff attorneys won Janus, public sector workers continue to cast off the shackles of forced union dues. In Allen, the plaintiffs successfully defended the Janus rights of thousands of Ohio public workers.

COLUMBUS, OH – A lawsuit by four Ohio public employees has secured the end of an illegal dues deduction scheme used by Ohio Civil Service Employees’ Association (OCSEA/AFSCME Council 11) union bosses to block an estimated 28,000 workers from exercising their First Amendment right to stop union dues payments. The workers obtained free legal representation from National Right to Work Foundation staff attorneys in challenging the policy.

The class-action suit, Allen v. AFSCME, challenged OCSEA’s so-called “maintenance of membership” policy, which trapped workers in forced-dues payments except for a brief “escape period” once every three years at the expiration of the union monopoly contract. The workers argued this policy violated their First Amendment rights under the Janus v. AFSCME Supreme Court decision.

In Janus, the High Court struck down mandatory union fees for public sector workers as an infringement of their First Amendment rights, and ruled that the government can only deduct union dues or fees with an individual’s affirmative consent.

After Freeing Workers, Foundation Attorneys Warn of Future Union Boss Tricks

As a result of the lawsuit, OCSEA officials and the State of Ohio have rescinded the “maintenance of membership” restriction on when state workers can exercise their First Amendment right to cut off union dues deductions.

They must also honor requests to stop dues deductions from any employees who signed the AFSCME dues authorization form at issue in the lawsuit. Finally, AFSCME bosses repaid dues seized illegally under the scheme to the plaintiffs and more than 150 other employees who tried to cut off union dues deductions after Janus was decided.

Knowing that union bosses don’t easily give up in their crusades to coerce workers into paying dues, however, Foundation staff attorneys issued a legal notice shortly after the case wrapped up, warning workers that OCSEA union bosses may soon solicit them to sign new dues deduction forms which are not covered by the litigation. The new forms will “purport to restrict” when employees can stop dues, it warns.

In light of that, the notice reminds workers that under Janus, no Ohio public employee can be forced to sign a union dues deduction form as a condition of employment, no matter what union agents may tell them.

Just Latest in String of Ohio Worker Victories over “Escape Periods”

Allen is not the only case in which Ohio public employees have, with National Right to Work Foundation legal aid, successfully challenged union boss attempts to limit their rights.

Seven other Ohio public employees won the first-in-the-nation victory against unconstitutional “escape periods” with Foundation aid in January 2019, after they filed a class-action federal lawsuit challenging a similar policy created by AFSCME Council 8 bosses. They won a settlement ending the restrictions for themselves and their coworkers. That win was followed by two other Ohio public workers, Connie Pennington and Donna Fizer, successfully ending “escape period” restrictions with Foundation assistance later in 2019.

“Although this chain of victories for Buckeye State public employees is certainly encouraging, the widespread nature of these schemes shows there remains much work to do to force union bosses to end their unconstitutional restrictions on public employees’ First Amendment Janus rights,” observed National Right to Work Foundation President Mark Mix. “Foundation litigation has already freed hundreds of thousands of public employees from forced union dues, but likely millions more remain trapped and unable to exercise their rights. That is why Foundation litigators will continue to file these cases.”
