WASHINGTON, DC – The National Labor Relations Board (NLRB) recently rejected a move by NLRB Acting General Counsel Peter Ohr to prematurely end Texas nurse Marissa Zamora’s case before the Board could rule. The case challenges National Nurses Organizing Committee (NNOC) union officials’ refusal to disclose a secret agreement they signed with the parent company of her hospital that limits Zamora’s ability to remove the union from her workplace.

Ohr is a career NLRB bureaucrat, who was installed as General Counsel by President Biden this January after Biden made the unprecedented move of removing Trump-appointed NLRB General Counsel Peter Robb before his Senate-confirmed four-year term expired. Ohr filed a motion in February seeking unilaterally to send Zamora’s complaint back to the NLRB’s Fort Worth regional office to be dismissed — after Zamora’s case had already been fully briefed at the full Board in Washington.

Zamora is represented for free by National Right to Work Foundation staff attorneys, who in March opposed Ohr’s attempted maneuver. Their brief argued that snuffing

the case out now would jeopardize the NLRB’s power to decide cases involving violations of federal labor law, and also contended that Ohr lacked any authority to make his motion because of Biden’s illegal ouster of Robb. In a May decision, the NLRB agreed with Zamora’s Foundation staff attorneys that the case should continue, observing that the matter “has been fully litigated, and the controversy at issue, which remains active, is ripe for Board adjudication.” The case began when Zamora demanded a copy of the secret so-called “neutrality agreement.” Such agreements are deals between union officials and employers — usually without the knowledge of employees in a workplace — that seek to assist the union in gaining monopoly bargaining powers over rank-and-file workers.

NNOC Agents Shrouded, Lied About Deal Which Stymied Info about Decertification

“The Board correctly rejected Peter Ohr’s attempt to scuttle this case so he could let union officials off scot-free despite their secret backroom deal to undermine the rights of nurses like Marissa Zamora who are subjected to unwanted union representation,” National Right to Work Foundation President Mark Mix said about the decision to let the case move forward. These controversial top-down organizing deals frequently contain provisions that require employers to silence opposition to unionization, hand over workers’ personal information for coercive “card check” drives that bypass the protections of a secret-ballot election, provide union organizers with preferential access to the workplace and even ensure employers will help stifle workers’ efforts to decertify, i.e. remove, the union.

In Zamora’s case, she began circulating fliers and other materials in June 2018 to educate her coworkers on how they could obtain a vote to decertify the union. Legal documents she filed in her case explain that union agents “repeatedly ripp[ed] down her fliers” and that hospital officials referenced a secret agreement with the union when they denied “her access to post material on protected bulletin boards, where her material would be shielded from vandalism.”

Zamora subsequently asked both NNOC and hospital officials to show her any “neutrality agreement” that might have triggered those efforts to block her and her coworkers’ rights. All her requests were denied, and NNOC even denied that such an agreement exists. This was despite statements by hospital agents to her that indicated a “neutrality agreement” was indeed in effect.

Trump-Appointed NLRB GC Robb Backed Nurse’s Case Until Unprecedented Firing

Zamora filed federal unfair labor practice charges at the NLRB, challenging NNOC bosses’ refusal to disclose the secret agreement. Then- NLRB General Counsel Robb issued a complaint supporting the claims in Zamora’s charges.

Nevertheless, a Labor Board Administrative Law Judge (ALJ) dismissed the complaint Robb issued, even revoking subpoenas that would have compelled NNOC union bosses to reveal the covert deal.

Zamora challenged the ALJ’s dismissal, filing exceptions at the full Board in Washington. Briefs she filed supporting those exceptions pointed out that, during a two-day trial, it came out that the “neutrality agreement” existed, but it was a closely guarded secret between the hospital and union officials “to be kept strictly confidential from employees and all third parties.” Robb also submitted exceptions buttressing Zamora’s exceptions.

Robb’s pro-employee decisions preceded Ohr’s controversial installation by Biden in January, and Ohr’s subsequent attempt to remand or dismiss the case, which the NLRB has now rejected.

“The Board should now promptly rule for Ms. Zamora on the merits of the case so union bosses cannot keep secret pacts with employers to the detriment of rank-and-file employees’ protected rights,” Mix said.

Red Rock Casino workers vote against unionization, but nearly 2 years later judge ordered employer to bargain with union officials

Las Vegas, NV (August 24, 2021) – A large majority of the workers at Red Rock Casino in Las Vegas, Nevada voted “no” to unionization, but a federal district court judge is forcing their employer to bargain with union officials anyway.

The Casino is appealing the judge’s order at the U.S. Court of Appeals for the Ninth Circuit. Now Red Rock employee Raynell Teske has filed an amicus brief arguing the judge was wrong to impose the union on the workers, given the rejection of the union in the election. National Right to Work Legal Defense Foundation attorneys assisted Teske for free in filing the amicus brief with the appellate court.

In December 2019, the National Labor Relations Board held a secret ballot election whether to unionize Red Rock. A sizable majority of those voting rejected union officials’ effort to become their monopoly bargaining representatives. Despite that vote, NLRB Region 28 Director Cornele Overstreet filed a federal court injunction action seeking to have the union imposed over the workers’ objections.

On July 20, 2021, Judge Gloria Navarro agreed with the NLRB Director’s request, and issued a “Gissel” order forcing Red Rock to bargain with union officials despite the employees’ vote against unionization. The judge said the order was justified because, prior to the vote, union officials claimed that a majority of workers had signed union authorization cards.

Teske’s amicus brief argues those “card check” signatures are unreliable, and not reason enough to conclude the union ever had majority support. She contends the level of union support was tested fairly by the secret-ballot election, in which workers voted 627-534 against unionization. Secret ballots are a far more reliable way of gauging worker support for a union, because workers are often pressured, harassed, or misled by union organizers into signing cards.

Unions themselves know that “card check” signatures do not indicate solid worker support. The AFL-CIO admitted in its 1989 organizing handbook that it needed at least 75% card check support before having even a 50-50 chance of winning a secret ballot election. An earlier guidebook acknowledged that some workers sign cards just to “get the union off my back.”

Teske’s brief argues the union’s possession of so-called “cards” is an insufficient legal basis for imposing unionization, especially after a secret ballot election in which the union lost. It agrees with the employer that the “Gissel” order should be overturned, and that Teske and her coworkers should not be subjected to monopoly bargaining by a union they rejected in an NLRB-supervised secret ballot election.

This is not the only case in which union bosses are battling casino employees in court. Red Rock’s parent company, Station Casinos, also owns Palms Casino in Las Vegas, where employees filed a petition to decertify union officials in March, 2021. Union lawyers blocked the petition with a slew of charges that were accepted by NLRB bureaucrats as reason to block the workers’ petition. The Palms Casino worker represented by National Right to Work Foundation attorneys who filed the petition is appealing the decision to block the vote he requested.

“Ms. Teske and her coworkers had good reasons to reject the union. It is outrageous that the judge’s order imposing unwanted unionization brushes aside the workers’ contrary preference clearly demonstrated in the secret ballot vote,” said National Right to Work Legal Defense Foundation President Mark Mix. “There have been countless examples of workers being pressured, misled and even bribed to sign union cards, which is why ‘Card Check’ is widely accepted as unreliable, especially compared to an NLRB-supervised secret ballot election.”

“If federal labor law is to be about defending the rights and freedoms of rank-and-file workers, then the Court of Appeals should promptly overturn Judge Navarro’s order substituting the wishes of NLRB bureaucrats for the actual choice workers made at the ballot box,” added Mix.

QUEENS, NY – With free legal aid from the National Right to Work Legal Defense Foundation, New York City UPS warehouse worker Kamil Fraczek has filed a National Labor Relations Board (NLRB) charge against Teamsters Local 804. The charge came after a Teamsters union official made repeated threats to his job and lied about his legal rights.

Union Official Refused to Respect Worker’s Rights under Beck Decision

When Fraczek began working at the warehouse full-time, a Teamsters representative tried to mislead him by telling Fraczek he must become a union member and sign documents authorizing dues deductions from his paycheck. Fraczek specifically asked about other options, but the union representative told him that if he did not sign the forms, Teamsters officials would ask UPS to fire him.

Because New York is a forced-unionism state that doesn’t protect workers with a Right to Work law, Fraczek can be required to pay some union fees as a condition of his job.

However, under long-standing federal law, workers cannot be required to become formal union members nor can they be required to pay full union dues even in non- Right to Work states. Under the Supreme Court’s 1988 CWA v. Beck decision, won by National Right to Work Legal Defense Foundation attorneys, no private sector worker can be compelled to financially support union activities unrelated to bargaining.

Union Misinformation Continues Even after Employee Demanded Rights

Expenses which can’t be charged to non-members under Beck include political expenditures and members-only activities.

Knowing his actual rights, Fraczek returned to the Teamsters official asking to be recognized as a non-member and Beck objector. He provided a letter to the representative stating his intention to pay only reduced fees and declining union membership.

As the unfair labor practice charge states, instead of accepting Fraczek’s request, the Teamsters official doubled down on his prior illegal threats. He demanded that Fraczek pay full dues and sign membership documents or face termination.

The official falsely claimed that only supervisors can opt out of the union, and that the federal laws protecting workers from funding union political activities only apply in Right to Work states, not in forced-unionism states like New York.

In response, Fraczek’s Foundation staff attorneys filed an NLRB charge asserting his right to pay reduced fees under Beck and not to join the union.

Foundation staff attorneys are defending Neises Concrete Construction Corp. workers’ unanimous call to free themselves from the coercive reign of IKORCC union bosses.

CROWN POINT, IN – Mike Halkias and his coworkers at Neises Construction Corp. in Crown Point, Indiana, are subject to monopoly “representation” by officials of the Indiana/Kentucky/Ohio Regional Council of Carpenters (IKORCC) union.

Every bargaining unit member exercised the right under Indiana’s Right to Work Law to decline formal union membership and to refuse to pay any union dues or fees, but union officials still have the authority under federal law to “negotiate” with Neises for the employees despite their objections to that representation.

NLRB Officials Snub Workers’ Unanimous Petition, Demand Union Bargaining

With free legal aid from the National Right to Work Legal Defense Foundation, Halkias submitted a decertification petition to Region 13 of the National Labor Relations Board (NLRB), signed by every member of his unit, to remove IKORCC union officials from their workplace.

Despite unanimous agreement by the unit’s workers to hold a vote to oust IKORCC bosses, NLRB Region 13 officials rejected the decertification petition. The Regional Director is demanding that the Indiana employer bargain with IKORCC, even though none of its employees want the union to “represent” them.

Union Bosses Won’t Give Up Monopoly Bargaining Power over Non-members

So far union officials have stymied the vote through “blocking charges,” unfair labor practice charges filed by union lawyers that, before they are resolved, prevent a vote from taking place. Union officials claim the vote cannot proceed until the company negotiates “in good faith” with the union.

That demand comes even though federal law makes it illegal for an employer to engage in bargaining with a union that it knows lacks the support of at least a bare majority of workers. The NLRB regional official’s order dismissing the employees’ petition did not even acknowledge that every employee in Mr. Halkias’ bargaining unit has shown a desire to be independent from the union by resigning union membership and asking for a decertification vote.

Foundation Attorneys Bring Fight to National Board

The Foundation staff attorneys who represent Halkias have appealed to the NLRB in Washington to overturn the rejection of the decertification petition and to allow the workers to vote so they can be rid of the union whose so-called “representation” they all oppose. “It is outrageous that in a workplace where every single worker wants nothing to do with a union, federal law still forces workers to accept the so-called ‘representation’ of union bosses,” said National Right to Work Foundation Vice President Patrick Semmens.

“The fact that this appeal is even necessary demonstrates how rigged federal law is against independent-minded workers who seek to exercise their right not to associate with a union.”

“This case is a reminder that, even in Right to Work states that protect workers from being forced to fund a union they don’t support, federal law still forces workers under union monopoly control even when those employees oppose the union and believe they would be better off without it.”

WASHINGTON, DC – Workers in California and New Jersey who were previously subject to Teamsters bosses’ monopoly bargaining authority have freed themselves from unwanted union control.

The workers received free legal aid from Foundation staff attorneys, and benefited from rule changes at the National Labor Relations Board (NLRB) in Washington pushed for by the Foundation.

In California, Eliseo Haro, an employee at Los Angeles-based KWK Trucking, Inc., submitted a decertification petition with the NLRB because he and his coworkers were being ignored by Teamsters bosses. As Haro puts it, “The union never came in to talk to us, or negotiate a contract, or represent us. They disappeared.”

Haro’s petition was signed by nearly 80 percent of the workers in the 119-employee bargaining unit and called for an NLRB-supervised decertification election, in which KWK employees could vote out the unpopular union officials.

Rather than face an overwhelming defeat in the decertification election, Teamsters bosses chose to walk away. The union disclaimed interest in the unit, and NLRB Region 21 revoked Local 986’s certification as the workers’ monopoly bargaining agent.

New Jersey Decertification Effort Succeeds Despite Union Stall Tactics

In Cinnaminson, New Jersey, Teamsters officials did not immediately leave when a decertification petition was filed by Miguel Valle and his coworkers at a branch of XPO Logistics. Instead, Teamsters lawyers used nearly two months of unnecessary court proceedings to delay the election.

They demanded the vote be held in person at the Teamsters union hall. Foundation attorneys argued that the union lawyers’ requests were merely an effort to delay the vote. Ultimately, as expected, the NLRB’s Regional Director ruled that the election would be conducted by mail.

When Valle and his coworkers finally had their election, they voted 16-2 to remove Teamsters bosses from their workplace.

Foundation-Backed Rule Changes Reduce Needless Election Delays

For workers, just getting a decertification election is often difficult. In some cases, union bosses have created multi-year delays to stymie decertification efforts, trapping workers under union monopoly “representation” and often forced-dues payments they oppose, while they wait for a vote.

Union officials frequently attempt to delay or block decertification votes by filing “blocking charges,” unfair labor practice charges that can be used to hold up an election, even when they have nothing to do with the employees’ dissatisfaction with the union.

Union officials’ ability to use this tactic to block or delay votes has been limited by recent NLRB rulemaking, finalized in 2020. Under the NLRB’s new policy, which draws on comments filed by the National Right to Work Foundation, union charges cannot indefinitely stall employee votes, and in most instances votes occur without delay.

Additionally, as the Foundation advocated in its comments, instead of ballots being impounded for months or even years while “blocking charges” are resolved, the NLRB modified its original proposed rule so that in most cases ballots are tallied and the results are announced after employees vote.

“Union bosses can stick around for years, even when they face overwhelming opposition from rank-and-file workers, because of the legal barriers that protect union officials from decertification votes,” said National Right to Work Foundation Vice President and Legal Director Raymond LaJeunesse.

“Thanks to Foundation-backed reforms to the NLRB’s ‘blocking charge’ policy, union officials’ ability to trap workers in union ranks through legal trickery despite overwhelming opposition has been significantly curtailed.”

Marissa Zamora is challenging the authority of NLRB “Acting” General Counsel Peter Ohr, who was installed by Pres. Biden in an unprecedented power grab and began attacking the rights of workers opposed to associating with union officials.

WASHINGTON, DC – President Biden’s unprecedented removal of National Labor Relations Board (NLRB) General Counsel Peter Robb, and subsequent installation of forced-unionism zealot Peter S. Ohr as Robb’s “Acting” replacement, quickly threatened workers’ individual rights. It also threatened the independence of the Board itself, including in multiple ongoing cases brought with National Right to Work Foundation legal aid.

In two cases brought by Foundation staff attorneys that are already before the NLRB, Ohr is attempting to stop the Board from ruling against union officials. One is a case for Texas-based nurse Marissa Zamora, which challenges union officials’ ability to hide secret “neutrality agreements” that limit workers’ rights. The other, brought for West Virginia Kroger employee Shelby Krocker, seeks to prosecute union officials for coercing workers into signing dues checkoff authorizations that are supposed to be voluntary.

Former NLRB General Counsel Peter Robb, who supported the workers in both of these cases, was removed by President Biden just minutes after his inauguration, despite the fact that Robb still had nearly 11 months remaining in his Senate-confirmed four-year term.

This unprecedented and possibly illegal maneuver flies in the face of the law creating the NLRB, which envisioned an independent General Counsel. Since the office of NLRB General Counsel was established in 1947, no sitting General Counsel of the NLRB has ever been fired by a president before the end of their term, even when the White House changed hands.

Zamora’s case progressed to the full NLRB in Washington, D.C., after an NLRB Administrative Law Judge (ALJ) dismissed a complaint that former NLRB General Counsel Peter Robb had issued, prosecuting the National Nurses Organizing Committee (NNOC) for refusing to disclose to represented employees its secret “neutrality agreement.”

Though Zamora’s Foundation-provided attorneys and Robb had both filed exceptions urging the full Board to reverse the ALJ’s decision, NLRB Acting General Counsel Peter Ohr filed a motion on February 23, 2021, seeking unilaterally to send the complaint back to the NLRB Fort Worth regional office to be dismissed.

So-called “neutrality agreements” are organizing deals struck between union officials and employers, usually without the knowledge of employees in a workplace. They frequently contain provisions that require employers to silence opposition to unionization. In Zamora’s situation, the neutrality agreement was used to limit her ability to inform her coworkers about their right to vote out the union.

Zamora’s opposition brief challenges Ohr’s attempt to kill the case. It argues that the case is already before the full Board, and she “is a full party with a right to have her pending exceptions decided by the Board.” It notes that letting Ohr shut her out at this stage would “infringe on the Board’s exclusive power to adjudicate violations of” federal labor law.

Further, the brief contends that because of Robb’s unlawful removal, Ohr lacks the legal authority to even ask the NLRB to end the case. Allowing “the President to fire the General Counsel at will would do irreparable damage to the NLRB’s function as an independent agency,” the brief says.

In Krocker’s case, NLRB Region 6 in Pittsburgh initially dismissed Krocker’s charge challenging United Food and Commercial Workers Union (UFCW) checkoff cards which falsely stated that they “MUST BE SIGNED.”

West Virginia Kroger Employee Stands Up to Union-Allied Ohr

Foundation attorneys successfully appealed this dismissal to General Counsel Peter Robb, who sustained the charge and ordered NLRB Region 6 to issue a complaint prosecuting UFCW Local 400 for the violation.

In fact, Robb ordered Region 6 to issue the complaint on several additional grounds, including maintenance of a checkoff that prohibited employees from ending dues deductions after the expiration of a contract.

After an ALJ declined to rule that UFCW Local 400 officials violated the law with their “MUST BE SIGNED” demands and other unlawful provisions, Krocker’s Foundation staff attorneys and General Counsel Robb both appealed the case to the NLRB. Their appeals have been fully briefed before the Board since September.

After Ohr’s appointment, Region 6 entered into an inadequate informal settlement over Krocker’s objection and filed a motion to send the case back to Region 6.

Biden Appointee Shielding Union Boss Privileges

Krocker’s opposition to that motion argues, as does Zamora’s, that her case is already pending before the full NLRB and that Ohr lacks the authority to divert it away from the Board’s judgment.

“‘Acting’ NLRB General Counsel Peter Ohr’s unabated attacks on Foundation cases seeking to defend workers’ individual rights clearly show how imminent a threat our cases are to union bosses’ coercive and greedy behavior,” commented National Right to Work Foundation Vice President Patrick Semmens. “Ohr demonstrates repeatedly that he has no problem with turning the NLRB into the Biden Administration’s tool for stifling the rights of independent-minded workers who dare to stand up to Biden’s union boss allies.”

He’s done playing games: After cameraman Jeremy Brown sought free legal aid from the Foundation, an NLRB Administrative Law Judge ruled against NABET bosses for violating his Beck rights for years.

PORTLAND, OR – Jeremy Brown, a “daily hire” cameraman for ABC who had worked on and off for the company since 1999, would not have thought that a new president taking over the National Association of Broadcast Employees and Technicians (NABET) Local 51 union would mean anything for him when he resumed work in 2016. After all, he had worked for ABC for nearly three years, and the union had never even contacted him and he had never joined the union.

Then, in 2019, he received a series of letters from the new union honcho, demanding he pay nearly $10,000 in initiation fees and so-called “back-agency dues.” Brown quickly obtained free legal aid from National Right to Work Legal Defense Foundation staff attorneys and asserted his rights under the Foundation-won CWA v. Beck Supreme Court decision.

Beck prevents private sector union bosses from forcing employees who have abstained from formal union membership to pay for anything unrelated to the union’s bargaining functions, such as political expenses. Moreover, it requires union officials to provide information on the union’s fee calculation and expenditures to non-members.

New NABET Chief Demanded Thousands, Then Snubbed Cameraman’s Beck Rights

Because Brown works primarily in non-Right to Work states, he can be legally forced as a condition of employment to pay some fees to union bosses.

After receiving the baffling, belated dues demands, Brown emailed the new union president, Carrie Biggs-Adams, asking for clarification. He also exercised his Beck rights by objecting “to the collection and expenditure by the union of a fee for any purpose other than” certain bargaining activities. Believing that he would be fired if he did not agree to pay union dues, he filled out a form authorizing NABET to take full dues from his paycheck, but did so under duress.

Biggs-Adams ignored several follow-ups by Brown. According to legal documents, she “believed Local 51 had no obligation to [reply to Brown] because Beck objections” are handled only by the union’s national headquarters under NABET rules. Even so, she never apprised Brown of NABET’s national mailing address, or provided him the dues reduction or any of the information mandated by Beck.

In December, Brown won a decision from a National Labor Relations Board (NLRB) Administrative Law Judge (ALJ) about the union’s Beck rights violations. The ALJ’s decision holds the NABET union violated Brown’s rights under the National Labor Relations Act (NLRA) through its officials’ omissions and the failure to reduce his dues.

The ALJ ordered NABET Local 51 to provide Brown with “a good faith determination of the reduced dues and fees objectors must pay,” and “reimburse Brown for all dues and fees collected” beyond what is required under Beck, with interest.

“While this decision vindicated Mr. Brown’s legal rights, it also demonstrates why every American worker deserves the protection of a Right to Work law to shield them from union boss threats to pay up or be fired,” commented National Right to Work Foundation Vice President Patrick Semmens.

Union-Label Biden Labor Board Appointee Moves to Scuttle Foundation Cases

Unprecedented: Biden removes NLRB top prosecutor despite 11 months left on his term

WASHINGTON, DC – With National Right to Work Foundation staff attorneys having won numerous National Labor Relations Board (NLRB) cases in recent years curtailing coercive union practices, union bosses pushed the Biden Administration to take unprecedented measures to protect Big Labor’s power over rank-and-file workers.

In January, top union bosses, including Service Employees International Union (SEIU) chief Mary Kay Henry, formally demanded that upon taking office President Biden make the unprecedented move of removing NLRB General Counsel Peter Robb, despite nearly a year remaining on his term. Union officials were furious Robb had frequently sided with Foundation-backed employees in many cases during his tenure, including cases in which workers successfully challenged union boss demands that workers subsidize their spending to put Biden in the White House.

Just 23 minutes after taking office on January 20, in response to Big Labor’s demands, Biden took the legally dubious action of removing Robb. Robb’s Senate-confirmed term runs through November 2021.

In the 85-year history of the NLRB, no previous NLRB General Counsel had ever been fired before their four-year term — meant to protect the office from political pressure — expired. For example, Robb’s predecessor, Obama-era NLRB General Counsel Richard Griffin, served almost a full year into Trump’s presidency to complete his term.

Following Robb’s unprecedented removal, Biden designated union partisan Peter Ohr as “Acting General Counsel.” Within days of his installation, the ersatz General Counsel moved to undo actions taken by Robb in Foundation-backed cases, in each instance reversing course to the benefit of Big Labor officials.

On January 29, Ohr ordered Seattle NLRB officials to stop prosecuting the Embassy Suites Pioneer Square hotel and UNITE HERE Local 8 union officials for making a backroom agreement designed to unionize housekeepers through a coercive “Card Check.” The “Card Check” bypassed an NLRB-supervised secret-ballot election. The very next day after Ohr’s order, Boston NLRB officials also pulled their prosecution of Boston Yotel and UNITE HERE Local 26 officials in a similar case brought by four Foundation-represented housekeepers.

Biden’s “Acting” Appointee Targets Foundation Cases Scheduled for Trial

In each case, Foundation staff attorneys were prepared to argue at trial that the “top-down” agreements for “Card Check” were illegal and tainted the installation of the union. But by pulling complaints weeks prior to when trials were set to begin before Administrative Law Judges (ALJs), Ohr blocked the cases from even being heard.

Those orders were then followed by a flurry of other activity by Ohr that included instructing local NLRB officials not to move forward with cases related to enforcing workers’ Beck rights, which protect them from being required to fund union political activities.

“Biden’s intent in firing Robb was obvious: So his handpicked NLRB replacement could move unimpeded to protect the privileges of his union boss political allies at the expense of individual workers’ rights,” observed National Right to Work Foundation Vice President Patrick Semmens. “Robb often sided with Foundation-backed workers, which made him a threat to Big Labor that needed to be eliminated.”

Though Ohr, at Biden’s behest, is weaponizing the NLRB against independent-minded workers’ rights so the union elite can escape scrutiny, are already before the full Board and by law out of the General Counsel’s control.

Through August 27, 2021, the Trump-appointed Board majority will retain their seats and are immune to Biden’s whims. That means these cases for workers still could take down erroneous union boss-friendly precedents that have harmed workers for decades.

Groundbreaking Foundation Cases Still Advancing to Full Labor Board

Among the Foundation cases pending at the full NLRB in Washington are challenges by three separate groups of workers to the pernicious “contract bar” doctrine (see page 1), a separate case about “neutrality agreements” for Corpus Christi, TX-based nurse Marissa Zamora and Michigan AT&T employee Veronica Rolader’s challenge to restrictive “window period” policies which let union bosses collect forced dues even after a contract has expired.

Semmens added: “The Foundation is proud to stand with workers challenging all types of union coercion, and will continue to stand ready to defend workers against Big Labor and, when necessary, the Biden-Harris Administration.”

Foundation staff attorneys are assisting Delaware poultry workers in challenging UFCW bosses’ attempts to use the “contract bar” to trap them in union ranks.

WASHINGTON, DC – Foundation attorneys in January filed a Request for Review to the full National Labor Relations Board (NLRB) in Washington, D.C. The Request defends the right of Virginia Transdev workers to have a vote to remove unpopular Office and Professional Employees International Union (OPEIU) Local 2 bosses from power at their workplace.

The Transdev employees, who work at the Fairfax Connector bus service in Northern Virginia, now join Foundation-backed workers in Delaware and Puerto Rico, all of whom are urging the NLRB to eliminate the “contract bar.” That is a non-statutory NLRB policy which forbids employees from exercising their right to vote out an unpopular union in an NLRB-supervised “decertification election” for up to three years after their employer and union finalize a monopoly bargaining contract.

Foundation attorneys point out in each of these cases that the “contract bar” appears nowhere in the National Labor Relations Act (NLRA), the federal law the NLRB is charged with enforcing, and is merely the result of past union boss-friendly decisions by the Board. They also argue that the bar undermines workers’ basic right under the NLRA to remove unions that lack majority support.

“The ‘contract bar’ undermines the fundamental objective of federal labor law: Employee free choice. It makes rank-and-file employees prisoners of an unpopular union, with no way out for up to three years,” commented National Right Work Foundation President Mark Mix. “This inevitably creates an environment in which, as these employees can certainly attest, it’s impossible to hold self-serving union bosses accountable because workers are denied the right to vote them out.”

Unpopular OPEIU Bosses Went Behind Workers’ Backs to Sign Contract

The petitioner in the Transdev workers’ case, Amir Daoud, submitted a petition on November 10, 2020, signed by the necessary number of his coworkers to trigger a “decertification election” in his workplace. This was after news had gotten around that an OPEIU union agent had told some employees in October he had “negotiated a new agreement” with Transdev management and “‘intended’ to sign it without a ratification vote.” Workers had already voted down an earlier union boss-promoted monopoly bargaining contract in June.

Foundation attorneys filed a Request for Review, which notes that the union agent didn’t inform Daoud and his coworkers of when he planned to approve the new contract — until after Daoud filed the petition. The new contract was signed by union agents on October 30 and Transdev representatives on October 31.

NLRB Region 5 in Baltimore dismissed Daoud and his coworkers’ decertification petition on December 22, ruling that the “contract bar” applied because the employees’ petition was submitted just after the new contract was signed, even though the employees had no way of knowing whether or when that signing would occur.

This prompted Daoud to ask the NLRB in Washington to review the case. Because Daoud recently accepted a job with Transdev outside the OPEIU’s monopoly bargaining control, the Request for Review asks the NLRB to recognize his coworker Sheila Currie as the new petitioner to represent the interests of the workers who signed the decertification petition.

The Request exposes the arbitrariness of the “contract bar,” pointing out that the NLRB Regional Director applied it “merely because the Union ‘won the race’ and signed the contract ten days” before Daoud submitted the petition, even though the petition clearly demonstrated the employees’ interest in voting the union out.

VA and Puerto Rico Cases Follow Groundbreaking Effort by DE Poultry Workers

The Virginia Transdev employees, and a Puerto Rico armored transit guard who submitted a similar Request for Review on behalf of his coworkers with Foundation aid in January, are now battling the “contract bar” like Delaware Mountaire Farms poultry worker Oscar Cruz Sosa and his coworkers. For almost a year now, Cruz Sosa and his fellow employees have been fighting United Food and Commercial Workers (UFCW) union bosses’ attempts to use the “contract bar” to block their valid petition for a decertification vote. The Mountaire employees are now waiting for the NLRB to issue a ruling on their case.

In that case, UFCW officials claim that the “contract bar” should apply to bar any elections at Mountaire, despite an NLRB Regional Director’s decision allowing the vote because the union contract contains an invalid forced-dues clause.

When the UFCW bosses asked the full NLRB to review the Region’s order allowing the election, Cruz Sosa’s attorneys filed a brief urging that, if the Board granted review, it should use the opportunity to review the entire non-statutory “contract bar” policy. The Board is now doing just that. The UFCW union bosses are even arguing that the impounded ballots already cast by Mountaire workers should be destroyed, claiming the election should never have been held.

The Requests for Review submitted by Foundation staff attorneys for the Puerto Rico guard and Virginia Transdev employees each request that the NLRB should either grant review or least hold the case until a decision is issued in Cruz Sosa’s case.

NLRB to Prosecute Boston Hotel, UNITE HERE Union for Coercive “Card Check” Deal

BOSTON, MA – With free legal aid from National Right to Work Legal Defense Foundation staff attorneys, in December 2019 four housekeepers at the Yotel hotel in Boston filed charges against their employer and UNITE HERE Local 26, after the hotel illegally assisted union officials with foisting their “representation” on workers during a “Card Check” organizing drive.

Now, in response to the charges filed for Cindy J. Alarcon Vasquez, Lady Laura Javier, Yesica Perez Barrios and Danela Guzman, the National Labor Relations Board (NLRB) Regional Director has issued a complaint to prosecute the hotel and UNITE HERE for violating the housekeepers’ rights under federal law.

Agreeing with the workers’ Foundation staff attorneys, the complaint charges the hotel with illegally assisting union organizers by providing the kind of assistance the Board has long held to be illegal when it benefits workers’ decertification efforts, and charges the union with illegally accepting the unlawful assistance.

NLRB: Employer Illegally Aided Union Campaign

The NLRB has long held that an employer taints employees’ efforts to remove a union if it gives those workers support that amounts to more than “ministerial aid.” Under that standard, the Board has held that an employer can’t provide a list of bargaining unit employees or allow use of company resources when employees are trying to remove a union, because this assistance would tarnish the results of the election.

Foundation attorneys in this case argue that, under the same standard, Yotel Boston similarly tainted the union’s organizing campaign by providing assistance to UNITE HERE union organizers.

The charges, which resulted in the NLRB complaint, say the hotel illegally assisted the union’s coercive “Card Check” drive, during which employees were pressured by union operatives into signing union cards. These cards were later counted as “votes,” and were used to bypass a secret-ballot election that would have determined whether the workers actually support union representation.

Foundation Cases Challenge Unequal Standard

The case is not the first in which the NLRB has addressed this double standard. In July, NLRB Region 19 issued a similar complaint in another case involving a hotel worker whose employer illegally assisted UNITE HERE Local 8 union officials in its “Card Check” drive at Embassy Suites in Seattle. There the NLRB also agreed that the employer had provided more than “ministerial aid,” and therefore UNITE HERE officials “did not represent an uncoerced majority of the unit.”

“The NLRB is finally addressing the double standard that for too long has favored union bosses in their coercive “Card Check” unionization drives,” said National Right to Work Foundation President Mark Mix. “Union bosses pressure workers and get illegal assistance from employers to impose their so-called representation on workers, but they cry foul when that same assistance is given to workers attempting to remove unwanted forced representation.

“With these two complaints against UNITE HERE union bosses, the Board is correctly finding that what qualifies as more than ‘ministerial assistance and support,’ and violates the National Labor Relations Act, cannot depend on whether the employer is helping outside union organizers impose unionization on workers or is assisting workers in exercising their right to remove an unwanted union,” Mix added
