Texas Workers at Multiple Workplaces Latest to Successfully Free Themselves from Unwanted Teamsters Union ‘Representation’
Dallas-based workers at two companies petitioned the NLRB for decertification elections to remove Teamsters Local 745 bosses
Dallas, TX (October 3, 2025) – Two successful union decertification efforts have freed workers from the control of International Brotherhood of Teamsters Local 745 Union bosses in Dallas, Texas. Both Dallas-based delivery drivers for Restaurant Technologies, Inc. and employees at FCC Environmental Services in Dallas filed decertification petitions at the National Labor Relations Board (NLRB) with free legal aid from National Right to Work Foundation staff attorneys.
The NLRB is the federal agency responsible for enforcing the National Labor Relations Act (NLRA) and adjudicating disputes between employers, unions, and individual employees. When employees are dissatisfied with union officials and want to remove the union from their workplace, they may file a “decertification” petition with the NLRB.
Union bosses often try to block elections with charges of unfair labor practices, and vigorously campaign to keep workers under their control. In both of these cases, workers ultimately were able to remove the union.
Teamsters Local 745 Can’t Win Decertification Efforts
Local Teamsters officers tried to block a decertification election at FCC Environmental Services last year, filing numerous charges of unfair labor practices, but despite these stalling attempts, the employees were successful in their effort to remove the union. The union ultimately withdrew all of their objections but one, which the NLRB Regional Director dismissed as it had no bearing on the election itself in which a majority opposed union affiliation.
Meanwhile, Local 745 officials couldn’t even put up a fight against delivery drivers for Restaurant Technologies, Inc. After workers filed a decertification petition at the NLRB in April, a decertification election was set for September. Only three days before the election was scheduled to take place, union officials themselves decided not to contest it, and instead disclaimed any further interest in representing the employees, who are now free from their control.
Workers Fleeing Teamsters Union Nationwide
These successful decertification efforts are part of a larger trend across the country. For four years, the Foundation has seen increasing demand for assistance from groups of workers seeking votes to remove unions. This trend has disproportionately affected the Teamsters Union, as NLRB statistics for the past 12 months show that one of every five decertification cases involved the Teamsters union.
“More and more, American workers across the country are deciding they are better off without Teamsters union bosses who prioritize their own interests over that of the workers they claim to ‘represent,’” commented National Right to Work Foundation President Mark Mix. “These successful decertification efforts demonstrate what happens when courageous and independent-minded workers assert their rights.”
“Union bosses often do not speak for the workers under their so-called ‘representation,’ and statistics show that over 90% of employees have never had a chance to vote on the union that purports to represent them,” Mix added. “That one in five decertification petitions filed last year involved the Teamsters only drives home the point that workers are increasingly rejecting the union’s coercive agenda.”
Builders FirstSource Workers Join Other KY Construction Industry Workers in Ending Teamsters Local 89 ‘Representation’
Majority of workers backed petitions calling for Teamsters removal as second workplace ejects Teamsters Local 89 bosses in recent weeks
Louisville, KY (October 2, 2025) – Kenneth Moore, an employee of Builders FirstSource, and his coworkers have been freed from the hold of Teamsters Local 89 union bosses after Builders FirstSource ended its recognition of the Teamsters as the workers’ “representative.” The employer took this decision following a petition signed by a majority of the workers demanding that Builders FirstSource end the recognition of the Teamsters.
This development comes after Moore filed a petition last month at the National Labor Relations Board (NLRB) seeking a decertification election to remove the union from his workplace. Moore filed his petition at the NLRB with free legal aid from National Right to Work Foundation staff attorneys. Moore and his colleagues now join Chris Smith and other IMI – Irving Materials drivers who were successful in removing the Teamsters Local 89 in Scottsville, KY last month.

Thanks to the 2019 Right to Work Foundation-won Johnson Controls NLRB decision, workers seeking to remove unwanted union bosses can also do so by submitting a majority-backed petition asking their employer to stop recognizing the union. If there is a dispute about the petition, the NLRB can administer a secret-ballot vote to assess the employees’ opposition to the union.
The workers’ petition to Builders FirstSource managers provided the company with proof that the majority of their employees do not support the Teamsters presence at their facility. In compliance with the Johnson Controls decision, the employer withdrew the Teamsters’ recognition.
Moore and his Builders FirstSource colleagues are amongst the most recent workers who have made strides to remove the Teamsters from their workplaces. According to the NLRB’s owns statistics, over the past 12 months over 20% of all decertification cases involved the Teamsters union.
Kentucky is one of the 26 states with a Right to Work law that protects workers by making union affiliation and dues payment strictly voluntary. However, even in Right to Work states, union officials can still impose monopoly bargaining control upon all workers within a workplace, even those who oppose the union.
“These two groups of Kentucky workers are the latest to come to the conclusion that the interests that Teamsters bosses are pursuing are at odds with the wishes of the rank and file,” commented National Right to Work Foundation President Mark Mix. “The Foundation will continue to assist workers in their efforts to free themselves from the Teamsters or any other unwanted so-called ‘representation.’”
Kentucky Construction Industry Workers File Petitions to Oust Teamsters Local 89 Union from their Workplaces
IMI – Irving Materials drivers already free of Teamsters officials’ so-called “representation” while Builders FirstSource workers await vote
Scottsville & Louisville, KY (September 22, 2025) – Chris Smith, an employee of IMI Kentucky in Scottsville, KY, and Kenneth Moore, an employee of Builders FirstSource in Louisville, KY, each filed petitions seeking to end Teamsters Local 89 union officials’ “representation” at their respective workplaces. IMI workers already secured victory in their effort to remove the Teamsters, while the effort to remove the Teamsters at Builders FirstSource is still ongoing.
Both Smith and Moore filed their petitions with the National Labor Relations Board (NLRB) with free legal aid from National Right to Work Foundation staff attorneys. The NLRB is the federal agency tasked with enforcing federal labor law and with adjudicating disputes between employers, unions, and individual workers. Workers are able to initiate an election administered by the NLRB if their petition gathers the signatures of 30% or more of their fellow employees.
Smith and Moore’s respective petitions garnered the necessary signatures from their coworkers to trigger an NLRB-administered secret ballot election to vote on the Local 89’s continued control. After employees demonstrate sufficient support for a decertification, in most cases the NLRB will schedule a secret ballot election. That process is ongoing for the employees of Builders FirstSource in Louisville.
However, in Smith’s case the employee support for removing the union was so overwhelming that Teamsters union bosses decided to save themselves the humiliation of being formally voted out, and instead disclaimed their status as the workers’ “exclusive representative” the very same day Smith’s petition was filed. The next day the NLRB Regional Director certified that the employees are officially free of Teamsters Local 89.
The employees at IMI Kentucky and Builders FirstSource join a long list of workers who have recently banded together to remove the Teamsters from their workplaces. In fact, NLRB statistics for the past 12 months show that over 20% of all decertification cases involved the Teamsters union.

Cincinnati-Area Kroger Employee Wins Federal Case Against UFCW, Grocer for Illegal Union Dues Deductions
Kroger and union must reimburse unlawfully seized dues as worker transfers to store in Right to Work Kentucky to block any future forced dues
Fairfield, OH (March 4, 2025 ) – Kroger Grocery employee James Carroll has prevailed in his federal case against United Food and Commercial Workers (UFCW) Local 75 union and corporate grocery conglomerate Kroger. The resolution comes after charges were filed against UFCW for threatening Carroll with termination for refusing to sign an illegal union dues deduction form and against Kroger for unlawfully deducting union dues from his paycheck.
To avoid prosecution, Kroger and UFCW agreed to a settlement that requires them to reimburse Carroll for unlawfully seized dues and post a public notice informing employees of their rights. Carroll received free legal aid from National Right to Work Legal Defense Foundation staff attorneys.
Carroll’s charges at Region 9 of the National Labor Relations Board (NLRB) in Cincinnati explain that the form UFCW union bosses forced him to sign is an illegal “dual purpose” membership form, which seeks only one employee signature for authorization of both union membership and dues deductions. Federal labor law requires that any authorization for union dues deductions be voluntary and separate from a union membership application. Additionally, Supreme Court precedents like General Motors v. NLRB recognize the right of workers to refrain from formal union membership.
In contrast to neighboring Indiana, Kentucky, and West Virginia, Ohio lacks a state Right to Work law. This means UFCW union officials to have the power to force Carroll and his coworkers to pay union dues or fees as a condition of keeping a job, even if they are nonmembers. However, even without Right to Work, union officials must obtain employees’ consent before instructing an employer to deduct union dues directly from a worker’s paycheck, and forced-fee amounts cannot include money that goes toward a union’s political activity, as established in the Foundation-won CWA v. Beck Supreme Court decision.
In addition to securing a victory in his case, Carroll took the additional step of transferring to a Kroger store in Right to Work Kentucky to avoid any future union threats demanding payment. Under Right to Work, all payments to the union are strictly voluntary, meaning Carroll cannot be forced to fund the very UFCW officials who violated his rights.
On Illegal Dues Practices, Kroger and UFCW Are Repeat Offenders
This isn’t the first time Foundation attorneys have aided Kroger employees facing illegal dual-purpose membership forms pushed by UFCW union bosses. In February 2023, Houston, TX-area Kroger worker Jessica Haefner filed federal charges against the UFCW for presenting her with such a dual-purpose form, and for altering her writing on the form to show she consented to union dues deductions when she was actually trying to exercise her right under Texas’ Right to Work law to abstain from dues payment.
In 2024, Foundation attorneys also assisted a Portland-area grocery store employee Reegin Schaffer, who filed and won federal unfair labor practice charges against a UFCW union there. In that case, union officials ignored her requests to resign union membership during a union strike and then unlawfully retaliated against her by seeking to fine her for exercising her right to rebuff union boss strike orders and go to work.
“We are pleased with this legal victory for Mr. Carroll, and that he is now completely free of union bosses’ forced-dues demands because he works in Right to Work Kentucky,” commented National Right to Work Foundation President Mark Mix. “Of course most workers subjected to union bosses’ ‘pay-up-or-be-fired’ threats don’t have the option of commuting to a location in a Right to Work state.
“That’s why, despite the good resolution, though this case shows why workers everywhere need Right to Work protections,” added Mix.
New Flyer Employee Slams CWA Union with Federal Charges, Claims Union Lied to Employees to Attain “Majority Status”
Following suspect ‘card check,’ union bosses seek to invalidate worker-backed petition for secret ballot vote to oust union
Shepherdsville, KY (August 9, 2023) – An employee of bus manufacturer New Flyer has filed federal charges against his employer and the Communications Workers of America (CWA) union, maintaining that CWA officials illegally imposed union control over him and his coworkers despite the union lacking a demonstrated majority support among the workers. The employee, Gregory Mabrey, filed his charges at National Labor Relations Board (NLRB) Region 9 in Cincinnati with free legal aid from the National Right to Work Legal Defense Foundation.
Mabrey’s charges explain that CWA union officials gained power in his workplace through a process called “card check,” which bypasses the NLRB’s standard secret ballot election process for installing a union. Under card check, employees are denied the right to vote in private on whether they want the union in the workplace, and union officials can instead claim majority status by demanding union authorization cards directly from workers.
The card check scheme’s lack of privacy exposes workers to a variety of coercive behaviors from union officials who are seeking to collect cards from a majority of employees in a work unit. Workers often report being told signing the card only requests “more information” about the union or serves some other purpose, even though the card will be equivalent to a “vote” in favor of union representation. Workers have also experienced threats and unwanted home visits during card check campaigns.
Cards Union Bosses Used to Support “Majority Status” Claims Had Multiple Problems
Mabrey’s unfair labor practice charges report that his employer, New Flyer, recognized the CWA union despite multiple flaws with the union’s card check claim of majority status. The charges state that union officials “misrepresent[ed] to employees that the cards were for a single, restricted purpose other than to designate the Union as their representative,” and that “the Employer and CWA relied on authorization cards that employees revoked or cancelled prior to the date of recognition.”
To make matters even worse, the charges also point out that “the card check was based on a unit of employees that was smaller than the Employer-recognized bargaining unit.” This means that, even if CWA bosses hadn’t made misrepresentations or relied on cards that workers had actually revoked, the number of cards they submitted to support their claim of majority status may have been too small, even under the coercive card check regime.
Mabrey’s charges seek an NLRB prosecution of the union and employer for their respective roles in illegally granting CWA union officials monopoly bargaining powers over his coworkers.
NLRB Blocks Workers’ Attempt to Vote Out the Union, Even Amid Deception
Mabrey’s charges come as another New Flyer employee, Megan Sowder, is pressing for the NLRB to accept an employee-backed petition she submitted to the NLRB in June that asks for a secret ballot vote to remove the CWA union. Sowder sought to take advantage of a Foundation-backed reform the NLRB adopted in 2020, which gives workers a 45-day window to file for a secret ballot election after an employer notifies employees that it has recognized a union pursuant to a card check.
Filing for a secret ballot vote in this way counters the NLRB’s so-called “voluntary recognition bar,” which normally locks workers under union power for up to a year or more after a card check recognition.
However, as the Request for Review filed by Sowder’s Foundation staff attorneys points out, NLRB Region 9 wrongly dismissed Sowder’s petition. Although Sowder submitted the requisite number of signatures twice to support her petition for a decertification election (30% or more is required to trigger a vote), NLRB Region 9 dubiously claims that Sowder collected the signatures “too early” and that an arbitration meeting that modifies the unit also nullifies the petition. NLRB Region 9 even claims that it never received all the signatures, despite Sowder’s evidence of faxing them directly to NLRB Region 9.
“The Region’s error has caused severe prejudice to Sowder and the bargaining unit employees’ rights under [the National Labor Relations Act], and review should be granted to correct that error,” Sowder’s Request for Review to the full National Labor Relations Board in Washington, D.C., states.
Biden NLRB Plans to Eliminate Workers’ Ability to Challenge “Card Check” Drives
The New Flyer employees’ cases come as the Biden NLRB is poised to issue a final rule as soon as this month to overturn the 2020 Foundation-backed reforms that allow workers to challenge the imposition of union monopoly bargaining power via card check with a secret ballot election. Foundation attorneys filed comments opposing the Biden NLRB’s proposed rule to nix these provisions.
“This situation demonstrates exactly how rank-and-file workers’ rights will be further trampled if the Biden NLRB moves forward with its attempt to expand union bosses’ card check power and simultaneously restrict workers’ statutory right to hold decertificiation votes to remove unwanted unions,” commented National Right to Work Foundation President Mark Mix. “Even absent the misrepresentations CWA union bosses made to foist union so-called ‘representation’ on workers, such card check drives are inherently prone to union pressure tactics that would be grounds for invalidating an NLRB-supervised vote.”
“Meanwhile, despite a lack of evidence of true majority support, the NLRB has improperly denied two submissions of valid employee signatures from workers simply asking for a vote to challenge the invalid card check recognition,” added Mix. “It is not too late for the Biden Board to stop its rulemaking to eliminate the Election Protection Rule, and give rank-and-file workers some hope that their statutory right to decertify a union they oppose will not be steamrolled by the NLRB’s desire to protect incumbent union power.”
Louisville Ford Assembly Plant Employee Wins Refund in Case Charging UAW Union Officials and Ford with Illegally Seizing Dues Money
Embattled UAW and Ford back down and settle case; numerous UAW officials currently serving sentences for embezzlement and corruption
Louisville, KY (April 26, 2023) – A Ford Louisville Assembly plant employee has just prevailed in her federal cases against the United Automobile Workers (UAW) Local 862 union and her employer. Shiphrah Green charged union officials in October 2022 with illegally seizing dues money from her paycheck and threatening her job after she exercised her right to refrain from union membership. Green filed a similar charge against Ford for its role in the scheme.
Green received free legal representation from National Right to Work Legal Defense Foundation staff attorneys, who asserted her rights before National Labor Relations Board (NLRB) Region 9 in Cincinnati. In addition to the illegal dues deductions and threats, Green’s October 2022 charges also detailed that UAW and Ford officials had forced her to navigate several unnecessary and unlawful steps to end her financial support for the union.
Foundation attorneys argued that the UAW union and Ford violated her rights under Section 7 of the National Labor Relations Act (NLRA), which protects American private sector employees’ right to refrain from any or all union activities. Additionally, Kentucky is a Right to Work state, meaning that state law prohibits union officials and employers from requiring workers to join or pay union dues or fees to keep their jobs.
Now, pursuant to settlements, Green will be reimbursed for all the dues illegally seized from her paycheck. UAW and Ford must also post notices informing workers that they will no longer continue to take dues from employees’ paychecks after they have resigned from the union, or create unlawful roadblocks to terminating membership or stopping dues deductions.
UAW Officials Block Employee from Exercising Basic Rights
According to her charges, Green sent correspondence to both UAW and Ford officials on April 21, 2022, informing them she was resigning her union membership and cutting off union dues deductions from her wages. Neither granted her request, and Green instead received an email from UAW Local 862’s president notifying her that she must come to the union hall to be shown the purportedly “correct” method to leave the union.
At a meeting with union officials at the UAW union hall on April 25, 2022, UAW officials interrogated Green about why she wanted to leave the union. They also demanded she sign a letter listing “benefits” Green would supposedly forgo if she went through with exiting the union.
The charge contended that NLRB precedent prohibits requiring workers to sign such a document so they can exercise their right to end their union membership and stop dues deductions. UAW Local 862’s president apparently went even further. According to the charge, he told Green “if it were up to me, you’d lose your job for leaving the union.”
As this chain of events with the union was unfolding, Green was also trying to get Ford management to end the dues deductions. This also proved fruitless, as Ford officials gave her several confusing responses and even told her at one point that, under the union monopoly bargaining contract, she could only cease dues deductions in February 2023 – even though paperwork she signed previously stated it could be revoked at will.
The charges contended that Ford violated federal law by “continuing to take full union dues” from Green’s paycheck at union bosses’ behest even after she had requested that they stop. The charges also stated that UAW Local 862 violated the law by continuing to accept those illegally-seized dues, by “restricting her union membership resignation, and by making threatening comments that would chill an ordinary employee’s exercise of Section 7 rights.”
After an investigation into the charges, NLRB Region 9 agreed that Ford and UAW officials’ actions violated federal law. To avoid a federal prosecution for their illegal actions, the company and union quickly settled.
Green’s Foundation-won settlements mandate that Ford and the UAW union return all money taken from Green’s paycheck since April 21, 2022, the date she first tried to resign from the union. UAW officials must also abstain from threatening that “you should or could incur disciplinary problems and job loss with Ford Motor Company Louisville Assembly Plant . . . because you inform us that you are resigning from the union.”
Systemic UAW Disrespect for Workers’ Rights May Be Rampant at Louisville Ford Plant
“The recent federal probe into UAW officials stealing and misusing workers’ money has sent multiple top UAW bosses to jail, and uncovered a shocking culture of contempt for workers’ rights,” commented National Right to Work Foundation President Mark Mix. “As Ms. Green’s case shows, these issues are systemic and widespread, and any other Louisville Ford Assembly Plant worker facing UAW union boss attempts to coerce union membership or dues payment should contact the Foundation for free aid in protecting their legal rights.”
“Louisville Ford Assembly employees should know that, under Kentucky’s Right to Work law, union bosses can’t force them to join or pay any money to the union as a condition of employment,” Mix added.
