More Minnesota Nurses Send MNA Union Bosses Packing

Politics-motivated union faces string of successful decertification votes in Minnesota

FAIRMONT, MN – In 2022, then-President of the Minnesota Nurses Association (MNA) union Mary Turner expressed to the Minnesota Reformer her ambition to continue pushing the MNA’s political agenda in the Minnesota state legislature and eventually vie for the presidency of the National Nurses United (NNU) union, MNA’s parent.
The NNU is also known for its ardent political activity — in 2016, the union’s super PAC spent roughly $1 million on promoting self-proclaimed socialist Bernie Sanders for president.
When asked whether the union’s politics played a role in the fact hundreds of nurses, backed by the National Right to Work Foundation, had just voted MNA union bosses out of power at Mayo Clinic in Mankato, Minnesota, Turner had this to say: “They’re going to have to prove to us that they want the union because they lost it.”
Fast-forward to 2025, and the MNA’s obsession with politics hasn’t changed — and neither has nurses’ opposition to the alienating nature of the union. This January, with free Foundation legal aid, nurses at Mayo Clinic’s Fairmont, Minnesota, location voted by over 60% to remove MNA union officials from their facility.
“The MNA was a very divisive force in our workplace, and I think we’ll be able to better serve our patients and the community without the union,” commented nurse Jamie Campbell on the vote.
Foundation Backs Another Grassroots Effort to Nix MNA
Campbell kick-started the union removal effort by submitting a petition to the National Labor Relations Board (NLRB) in December 2024 requesting a union decertification vote.
The NLRB is the federal agency responsible for enforcing federal labor law, which includes administering elections to install (or “certify”) and remove (or “decertify”) unions. Campbell’s union decertification petition contained well over the number of employee signatures needed to trigger a decertification vote under NLRB rules.
Because Minnesota lacks Right to Work protections for its private sector workers, MNA union officials had the legal power to require all the Fairmont Mayo nurses to pay at least a portion of union dues as a condition of keeping their jobs. In contrast, in Right to Work jurisdictions, union membership and all union financial support are voluntary and the choice of each individual worker.
However, in both Right to Work and non-Right to Work states, union officials are able to impose one-size-fits-all contracts on all employees in a work unit, even those who voted against or otherwise oppose the union.
Fairmont Victory Follows Others in Mankato, St. James
The election took place in January, and within a week, the NLRB certified the nurses’ successful ouster of the union.
Since 2022, several sizable units of healthcare workers in Minnesota have sought out Foundation legal aid to obtain removal votes against the MNA and other unions, and have often been successful in freeing themselves. After Mankato Mayo Clinic nurses voted MNA out, nurses at Mayo’s St. James branch did the same with AFSCME Council 65 in August 2022. Support staff at the Mankato facility kicked out American Federation of State, County, and Municipal Employees (AFSCME) Local 1856 union officials in 2023.
“MNA union bosses’ influence and political connections did not shield them from suffering another defeat by rank-and-file nurses at the ballot box,” commented National Right to Work Foundation Vice President Patrick Semmens.
“Ironically, Minnesota’s lack of Right to Work protections — which are vociferously opposed by the MNA — likely removed an important accountability tool from the relationship between the MNA and the nurses they claim to ‘represent.’ It’s no surprise that union bosses who can force workers to pay union dues or fees on pain of termination wind up being far less effective and more out-of-touch than union officials who must earn the voluntary financial support of each worker.”
Hundreds of OH Workers Exit Teamsters as Union Bosses’ Amazon ‘Strike’ Stunt Flounders

Teamsters O’Brien tried to take away Christmas cheer, but couldn’t take away Ohio workers’ freedom
Daniel Caughhorn led a scrappy group of his coworkers in voting Teamsters bosses out of their workplace, a scrap metal processing facility in Toledo, OH. They also beat back union bosses’ attempts to overturn their vote.
WASHINGTON, DC – This past December, Teamsters President Sean O’Brien announced the “largest-ever strike against Amazon,” claiming that thousands of workers would heed his strike order, abandon their delivery vehicles and hit the picket lines. O’Brien threatened that Christmas gifts would be delayed unless his demands were met.
Those who took O’Brien’s rhetoric at face value would have thought he was a veritable Grinch stealing Christmas (even though he tried to explain it was Amazon’s fault that the strike had to occur). But even reporting from pro-Big Labor outlets soon revealed that the order was more story than substance: According to Labor Notes, only about 600 employees obeyed the strike order despite Teamsters honchos claiming to “represent” some 7,000 to 10,000 Amazon employees.
Even the small number who did cease work on O’Brien’s command are arguably not employees of Amazon, and likely aren’t under Teamsters control at all: They work primarily for independent contractors that carry out some delivery functions for Amazon. Even if O’Brien’s dubious theory claiming he had control over those delivery drivers was correct, it would have only affected 10 out of the roughly 110 Amazon centers nationwide. Still, National Right to Work Foundation staff attorneys put a special legal notice out to delivery drivers nationwide informing them of their rights if they were illegally coerced to strike.
Workers Defeat Cynical Attempt by Teamsters to Overturn Vote
The December 2024 Teamsters “strike” against Amazon may go down in history as a strained publicity stunt. But the more significant Teamsters news that month was that hundreds of Foundation-backed workers across Northern Ohio took real action by voting to free themselves from unwanted Teamsters officials’ so-called “representation.”
Dusty Hinkle, an employee for Frito-Lay’s plant in Wooster, OH, and Daniel Caughhorn, a worker at scrap metal firm Omnisource’s facility in Toledo, OH, paved the way to freedom for their coworkers by submitting petitions asking the National Labor Relations Board (NLRB) to hold votes among their coworkers to remove or “decertify” Teamsters unions at their facilities. They submitted these in October and August 2024, respectively, with free Foundation legal assistance.
Because Ohio lacks Right to Work protections for its private sector workers, Teamsters officials enforced contracts that required Hinkle, Caughhorn, and their colleagues to pay union dues or fees as a condition of keeping their jobs. In contrast, in Right to Work states, union membership and all union financial support are strictly voluntary.
The NLRB, the federal agency that enforces federal labor law, administered decertification votes at Hinkle’s and Caughhorn’s workplaces after finding that both petitions contained enough employee signatures to trigger a vote under agency rules. Even though clear majorities of workers voted against Teamsters union control in both votes, Teamsters union officials filed objections alleging misconduct by Frito-Lay and Omnisource management in an attempt to overturn the election results.
However, in both cases regional NLRB officials tossed the union objections and certified the workers’ votes. The Omnisource and Frito-Lay employees — over 430 in total — thereby cut all ties with the Teamsters unions. Now both sets of employees are free both of union bosses’ forced-dues demands and their ability to impose one-size-fits-all contracts on the workplace.
In the final months of 2024, Foundation attorneys assisted a number of other workers from across industries with efforts to remove unwanted Teamsters officials. From just October to December 2024, truck drivers from Georgia, California, Virginia, and New Jersey successfully booted out Teamsters union officials or initiated removal efforts with Foundation aid. These cases came despite increasingly hostile rulemaking from the outgoing Biden Administration’s NLRB bureaucrats in 2024, which undid key Foundation-backed reforms that made it easier for workers to request decertification elections.
Teamsters Schemes to Steal Christmas and Workers’ Rights Both Failed
“Sean O’Brien’s Christmas publicity stunt might have made him seem like an attempted stealer of gifts and holiday cheer, but these two Foundation cases from Ohio demonstrate what Teamsters bosses really are: stealers of workers’ rights and freedom,” commented National Right to Work Foundation Vice President Patrick Semmens.
“That Teamsters officials in both these cases attempted to disenfranchise workers who opposed them shows why workers are turning against their power-hungry tactics, and why American workers deserve the Right to Work choice to withhold financial support from union officials who aren’t serving their interests.”
AT&T Workers Nationwide Win Challenges to Unionization Imposed Through Card Check

Victories by AT&T workers in five states preceded Biden-Harris NLRB rule change to block secret ballot votes

WASHINGTON, DC – While the Biden-Harris National Labor Relations Board (NLRB) sought to upend NLRB rules designed to protect workers’ ability to vote out unwanted unions, AT&T workers across the country won a series of victories highlighting the importance of allowing workers to challenge coercive union card check unionization with secret ballot votes. The decertification victories all relied on the National Right to Work Foundation-backed 2020 NLRB “Election Protection Rule” (EPR), which was formally eliminated by the Biden-Harris Labor Board in September.
In five separate cases covering well over 1,000 workers, AT&T Mobility employees have successfully overturned Communications Workers of America (CWA) unionization imposed through the notorious “card check” process.
Under card check, union organizers bypass the secret ballot election process and instead collect cards face-to-face from employees that are then counted as “votes” for the union. Without the privacy of a secret ballot vote, many workers report being pressured, bullied, or threatened into signing, which is among the reasons why card check has long been recognized as inherently unreliable and abuse-prone.
Foundation-Backed 2020 Rule Let Over 1,000 AT&T Workers Nix Union Card Checks
The 2020 Election Protection Rule reformed several rules that union officials manipulate to trap workers under monopoly “representation,” including by giving employees a way to challenge card check unionization with a secret ballot election. Foundation staff attorneys assisted AT&T employees in five states to do that in advance of the Biden-Harris Labor Board’s cynical repeal of the rule.
First, in Tennessee, AT&T employee Denis Hodzic filed a petition signed by two-thirds of his coworkers in the unit seeking a secret-ballot vote to remove the CWA union, after CWA agents installed themselves over 100 AT&T In-Home Experts by card check. Initially CWA union officials argued the election should be permanently blocked because the union had already merged the workers into a larger bargaining unit with thousands of other AT&T workers.
CWA Bosses Capitulated to AT&T Workers
However, citing the Election Protection Rule, which gives workers at least 45 days to challenge a card check with a decertification petition, Foundation staff attorneys were able to win a ruling with the NLRB allowing the vote to proceed. At that point CWA officials chose not to even contest the vote, instead filing paperwork with the NLRB freeing the employees from CWA ranks apparently to avoid an overwhelming final vote against the union.
“The Election Protection Rule was essential for us to rely on as we went through the process of seeking resolution to our tricky situation,” Hodzic said of his situation. “The 45-day petition window needs to remain regardless of which group holds the majority position in Washington.”
Since then, with legal aid, around 1,000 additional AT&T Mobility employees in California, Louisiana, Mississippi, and Texas have all also successfully removed the CWA union following installation through card check. In all four states, once the decertification vote became inevitable, CWA officials simply conceded defeat rather than wait for the results of a formal decertification vote.
NLRB Repeal of Election Protection Rule Traps Workers in Union Ranks
Despite these efforts from independent-minded employees, the Biden-Harris NLRB formally repealed the Election Protection Rule in September, dramatically expanding union bosses’ ability to block employee-requested decertification votes.
As a result, now, when workers in Hodzic’s situation attempt to challenge a card check with a secret ballot decertification, the NLRB will automatically block their vote for up to one year after a card check, which opens the door to countless other union delay tactics.
“If these AT&T employees had filed their five decertification petitions after September 30th, they would have been trapped in a union they oppose for years and likely forever,” commented National Right to Work Foundation Vice President Patrick Semmens.
“This is yet another example of the Biden-Harris NLRB steamrolling the rights of independent-minded employees, so union bosses can expand their forced dues ranks. “Despite this setback for employee freedom, Foundation staff attorneys remain committed to helping workers trapped in union ranks they oppose,” added Semmens. “That includes helping them navigate the increasingly rigged NLRB system.”
After Janus, Foundation Continues Fight to Expand Freedom for Public Employees

Building off Janus, CUNY professors’ lawsuit could end forced ‘representation’ powers
The Foundation’s historic Janus victory was a serious blow to public sector union bosses’ coercive power in its own right. But it also opened the door for efforts to free public workers completely from forced dues and forced representation.
NEW YORK, NY – Up until 2018, union bosses had the power to force millions of government workers to pay union dues or fees just to keep their jobs. While such an enormous privilege was not only a gross violation of workers’ free association rights, it also provided a steady stream of forced dues to union bosses, which contributed to their outsized influence over the government and our political system.
Union officials’ forced-dues power over public sector workers crumbled on June 27, 2018, when National Right to Work Foundation staff attorneys won the landmark Janus v. AFSCME decision at the U.S. Supreme Court. A majority of the Justices agreed with Foundation attorneys that every American public sector worker has a First Amendment right to abstain from paying dues to an unwanted union.
On the fifth anniversary of Janus, its impact can’t be overstated. Between the Janus decision itself and over 50 follow-up cases, Foundation staff attorneys have enforced the rights of over 500,000 employees nationwide. Meanwhile, studies find that independent-minded workers are withholding over $700 million in formerly mandatory dues and fees from public sector union bosses every year as a result of the decision.
Of course, Foundation staff attorneys continue to fight to defend, enforce, and expand on the landmark decision.
New Challenge to Forced ‘Representation’ Reaches Court of Appeals
In an ongoing Foundation-assisted case, Goldstein v. Professional Staff Congress (PSC), six City University of New York (CUNY) professors seek to knock down the final pillar of coercive union power in the public sector — union bosses’ power to force their one-size-fits=all “representation” on workers who don’t want it.
A brief recently filed at the Second Circuit Court of Appeals for the professors argues that PSC union officials are violating the professors’ First Amendment rights by forcing them to accept the union’s monopoly control and “representation.”
Professors’ Lawsuit: Janus Already Noted Dangers of Monopoly Bargaining
The professors have found the actions of PSC union bosses and adherents to be “anti-Semitic, anti-Jewish, and anti-Israel,” and have even reported union-instigated bullying and threats targeted against them.
The professors’ opening brief at the Second Circuit maintains that the Supreme Court already acknowledged in the Janus decision that public sector monopoly bargaining is “a significant impingement on associational freedoms,” and argues that New York State’s Taylor Law authorizes such bargaining in violation of workers’ rights.
“If the First Amendment prohibits anything, it prohibits the government from dictating who speaks for citizens in their relations with the government,” reads the brief.
The case, which will likely head to the U.S. Supreme Court no matter how the Circuit Court rules, could set a nationwide precedent forbidding public sector monopoly bargaining, just as Janus prohibits forced dues in all public sector workplaces. The combination of both Foundation-won precedents would guard public workers nationwide from both forced dues and forced representation.
Foundation Brief Defends State Law to Fortify Janus
The Janus victory also motivated freedom-loving state legislators to take extra measures to ensure workers’ First Amendment rights under Janus are being enforced.
In Indiana, a reform now forbids public employers from using taxpayer-funded government payroll systems to deduct union dues without a worker’s explicit consent. Public employers must obtain yearly consent from workers who wish to have union dues taken from their paychecks, and must also ensure that workers have notice of their constitutional right not to fund union activities. Unsurprisingly, dues-hungry Anderson Federation of Teachers (AFT) union officials sued the state to block these commonsense protections.
Foundation attorneys joined the fight recently to defend Indiana’s laws. A Foundation brief in the Seventh Circuit Court of Appeals urges the court to overturn a lower court’s injunction of these reforms, citing Seventh Circuit precedent.
Foundation attorneys helped successfully defend a similar law in West Virginia in 2021, which the West Virginia Supreme Court upheld on the basis that union bosses “have no constitutional entitlement to employees’ money or to the employer’s administration of union dues deduction schemes.”
Federal Courts Must End Union Monopolies
“Janus was a great triumph for American public workers’ freedom, but it was only a step toward the ultimate goal of freeing public workers from all unwanted union coercion,” commented National Right to Work Foundation Vice President Patrick Semmens. “No American worker should be forced to associate with union officials and union members that openly oppose their interests, including through attacks on their culture and religion as the plaintiffs in Goldstein have harrowingly experienced.”
“It’s encouraging to see that states like Indiana have stepped up to protect workers’ Janus rights,” Semmens added. “But ultimately, after recognizing in Janus and older precedents that union monopoly bargaining abridges workers’ free association rights, it’s high time for federal courts to end this enormous government-granted power for union bosses once and for all.”
Foundation Slams NLRB, ILA Union Officials in Brief to Fourth Circuit Court

Foundation defends union-free SC port workers who would lose their jobs under NLRB ruling
Foundation staff attorneys are fighting to ensure that Charleston’s state-of-the-art Hugh K. Leatherman Terminal doesn’t become a safe harbor for ILA union bosses’ anti-worker schemes.
CHARLESTON, SC – National Right to Work Foundation staff attorneys have joined the fight against the International Longshoremen’s Association (ILA) union’s ongoing gambit to idle Charleston’s state-of-the-art Hugh K. Leatherman Terminal if the union can’t get control of all jobs at the facility.
Hostile Union Power Play Seeks to Put Non-Union Workers Out of Job
The Foundation recently filed a legal brief with the Fourth Circuit Court of Appeals in the case South Carolina Ports Authority (SCPA) v. National Labor Relations Board (NLRB). In the case, the SCPA is challenging the Biden NLRB’s ruling permitting ILA union bosses to file multi-million-dollar lawsuits against any cargo carrier that docks at Leatherman until the union gains control of all crane lift equipment jobs at the facility.
Since its opening in March 2021, some of the work at Leatherman Terminal has been performed by non-union state employees, some of whom have worked for the SCPA for years. The brief argues that if ILA union bosses’ power grab succeeds, it will “cause grievous harm to 270 State port workers and their families.”
The Foundation “submits this brief to provide a voice for the otherwise voiceless non-union State employees, and to give the Court a unique perspective on the stakes involved for those workers and their families,” the brief states. The brief highlights the dire consequences of the ILA maneuver for control of Leatherman’s 270 employees, who are otherwise protected by state law from monopoly union control.
According to the brief, South Carolina spent over $1 billion to develop the terminal, but due to the ILA’s power grab “the only way for South Carolina’s $1 billion Leatherman Terminal to be usable would be for the State to turn the facility over to a private employer with an ILA contract and discharge the 270 State employees.” The devastating effects for current employees and their families wouldn’t stop there if the ILA is victorious in the case. Even if the fired state workers were to seek new employment at Leatherman with a private contractor under the union’s control, the ILA union’s seniority provisions and hiring rules would likely bar them from being rehired.
ILA Union Officials Have History of Corruption
The attempt by ILA union officials to seek total control over workers at the Leatherman terminal is hardly the only underhanded tactic the ILA has been linked to. In 2022, the New York Daily News reported ILA chiefs negotiated “deals” where mob-linked longshoremen in New York and New Jersey could get paid for 27 hours of “work” per day.
“ILA union officials, with assistance from the NLRB, are directly working to destroy the livelihoods of these 270 South Carolinians,” commented National Right to Work Foundation Vice President Patrick Semmens. “The NLRB’s blatant disregard of the rights and wellbeing of workers and siding with union tyrants is outrageous.”
“The non-union port workers who have called Leatherman their workplace for over a decade must be protected,” added Semmens.
Teen Supermarket Cashier Fired for Refusing to Join and Fund UFCW Union

Union officials required teen to violate his religious beliefs or be fired
Josiah Leonatti may be young, but he’s not afraid to stand up to UFCW bosses, who got him fired over objecting to union membership and dues on religious grounds.
PITTSBURGH, PA – Josiah Leonatti, a high schooler, was fired last year for his religious beliefs. Giant Eagle and the United Food and Commercial Workers (UFCW) union compel employees, like Leonatti, to either join or fund the union to keep their jobs. The problem for Leonatti is that he cannot do so without compromising his religious beliefs.
When Leonatti was hired, he never expected that union bosses would force him to choose between his job and his religious convictions. But the union officials did just that.
With free legal aid from National Right to Work Foundation staff attorneys, Leonatti hit UFCW union officials and Giant Eagle in January with federal discrimination charges. Although Giant Eagle rehired Leonatti to limit liability, neither Giant Eagle nor the union agreed to accommodate his religious beliefs. So Leonatti faces discharge, again, unless he funds the union.
Moreover, the union demands that Leonatti submit to an illegal “religion test.” Before the company and union will consider accommodation, they demand that Leonatti answer irrelevant and inappropriate questions to determine whether his religious beliefs are valid.
UFCW Bosses Tried to Get Teen Fired After He Voiced Religious Objections
Foundation attorneys filed charges for Leonatti against the union at both the Equal Employment Opportunity Commission (EEOC) and the National Labor Relations Board (NLRB) based on federal law. Foundation attorneys also filed charges against Leonatti’s employer, Giant Eagle.
Federal law requires unions and employers to accommodate employees who have religious objections to joining or paying dues to a union. And federal law also prohibits forced union membership regardless of a worker’s reason for not wanting to affiliate with a union.
Leonatti’s charges report that he attended employee training last year as a cashier trainee. There, a store manager told new hires that they “must sign papers to join the United Food And Commercial Workers.” According to the NLRB charges, “No other options were even hinted at.”
After reviewing the papers with his family, Leonatti’s charges explain, he mailed a letter to UFCW officials detailing his sincere religious objections to joining and supporting the union. He also presented the same letter in person at training.
Rather than accommodate his religious beliefs as required by law, a company official “dismissed [Leonatti] from training and sent [him] home.” The same official later called Leonatti and told him that union membership is compulsory at Giant Eagle, and admitted the grocery store had terminated him over his refusal to join.
UFCW officials responded to Leonatti’s letter by mail on November 10, 2022, rejecting the written explanation of his religious objection and demanding he “complete its religious examination” before they even considered granting him an accommodation. Even if he passed this “test,” the charges say, union officials threatened that he would still have to pay an amount equal to full UFCW union dues to a charity approved by union bosses. Giant Eagle has not offered a religious accommodation to Leonatti, and the union has not retracted its threats or agreed to accommodate him.
Teen’s Firing Shows Need for Pennsylvania Right to Work Protections
Leonatti’s EEOC charges seek to compel the UFCW union and Giant Eagle to provide him a legally required religious accommodation. In addition, the NLRB charges state that relief must include unitwide notice and corporate training regarding workers’ right to refrain from union membership, among other remedies.
“Union bosses’ attempt to coerce a high school student to violate his religious beliefs is unconscionable and illegal,” commented National Right to Work Foundation Vice President Patrick Semmens. “We’re proud to support Mr. Leonatti as he defends his rights and beliefs. This should serve as a stark reminder that all Americans deserve Right to Work protections.”
“If Pennsylvania were a Right to Work state, Leonatti wouldn’t be forced to present his religious objections to expectedly hostile union chiefs,” Semmens added. “In a Right to Work state, he and other dissenting employees would have a statutorily protected right to cut off dues payments for any reason. All employees deserve the right to choose whether to fund a union.”
Virginia, Kentucky Workers Slam Union Officials with Charges for Illegal Dues Deductions

Union bosses seized full dues over employees’ clear objections, despite state Right to Work laws

DANVILLE, VA – For workers under the protection of Right to Work laws, union membership and financial support are supposed to be strictly voluntary. However, as recent cases brought with Foundation legal aid for workers in Kentucky and Virginia demonstrate, even in the 27 states that currently have Right to Work laws, union bosses will often attempt to illegally seize dues over workers’ objections.
“Living in Right to Work Virginia, it is outrageous that we need to take legal action just to stop union dues from being seized against our will,” commented Steven Ricketts, one of two employees at Buitoni Food Company who recently filed charges against United Steelworkers (USW) Local 9555. “I don’t want my money supporting the United Steelworkers union, and it is time union officials accept that ‘no means no’ when a worker resigns from the union and revokes their dues authorization.”
Ricketts and fellow employee Donald Hale each hand-delivered letters to both USW union officials and to their employer, formally resigning their union memberships and revoking their dues check-off authorizations.
Steelworkers Bosses Ignore 75-Year-Old Virginia Right to Work Law
After the workers’ letters were delivered, dues deductions briefly stopped only to quickly resume. In the case of Ricketts, Buitoni Food Company not only restarted union dues deductions but also deducted double the dues amount in a subsequent paycheck. Deductions from Mr. Hale’s paycheck also resumed without his authorization after a short period.
Mr. Ricketts sent an email to the company’s human resources department after the dues seizures restarted and was told to contact union officials about it. Each employee sent another letter to the United Steelworkers union, specifically requesting copies of their dues check-off authorizations. However, money continues to be deducted without their consent and without the union officials producing copies of the authorizations that are legally required before any such deductions can occur.
Eventually the workers filed unfair labor practice charges against both the USW and their employer for their respective roles in the unauthorized union dues deductions.
Regarding the Foundationbacked charges, Hale noted: “I’m grateful for the National Right to Work Foundation assistance in enforcing my legal rights, but it really shouldn’t take a federal case to cease the collection of union dues.”
Meanwhile in neighboring Kentucky, Shiphrah Green, who works at Ford’s Louisville Assembly Plant, filed similar charges with the National Labor Relations Board (NLRB) against the United Automobile Workers (UAW) Local 862 union, as well as the UAW international union and Ford, for illegal union dues deductions.
Kentucky Autoworker Hits UAW Union with Federal Charges
Green notified both Ford and UAW union officials in April 2022 that she was resigning her union membership and cutting off all union dues deductions from her wages, as is her right under Kentucky’s Right to Work law. Instead of honoring her request, Green instead received an email from UAW Local 862’s president notifying her that Green needed to be shown the allegedly “correct” method to leave the union.
During a subsequent meeting with union officials at the UAW union hall, UAW officials subjected Green to interrogation about why she wanted to leave the union, and also demanded she sign a letter listing “benefits” Green would supposedly forgo if she went through with exiting the union. Longstanding NLRB precedent makes such restrictions on resignation illegal, as was the UAW Local 862 president’s coercive statement to Green that “if it were up to me, you’d lose your job for leaving the union.”
Despite Green’s resignation and requests to cut off union dues, UAW and Ford did not stop dues deductions. While Green continued trying to get Ford management to end the dues deductions, her efforts proved futile, as Ford officials gave her several confusing responses and even told her that she could only cease dues deductions in February 2023, even though the previously authorized dues deduction document could be revoked at will.
Finally, after getting the runaround from both Ford and the UAW, Green filed charges with the NLRB in October using free legal aid from the National Right to Work Foundation. As this issue went to print, Labor Board regional officials were conducting an investigation to see if Ford and the union should be prosecuted for illegal dues seizures.
Foundation Attorneys Play Essential Role in Limiting Union Boss Power
“As thousands of Foundation cases have demonstrated — whether in Right to Work states or forceddues jurisdictions, or whether litigated for government employees or private sector workers — limits on union bosses’ power to seize money from workers mean little if they aren’t enforced,” commented National Right to Work Foundation Vice President Patrick Semmens.

Emails show NLRB insiders cheered Biden’s unprecedented attack on agency’s ‘independence’
After Foundation attorneys’ FOIA request revealed pro-Biden bias pervading the “independent” NLRB, Foundation staffers secured coverage for the findings in some of the nation’s top outlets.
WASHINGTON, DC – National Right to Work Foundation attorneys have uncovered, through a Freedom of Information Act (FOIA) request, National Labor Relations Board (NLRB) staff emails that expose the partisan response to unprecedented power grabs launched by the Biden Administration at the behest of Organized Labor.
Biden Power Grab Prompts Records Request
The FOIA request was filed to provide further details surrounding Biden’s unprecedented and legally dubious removal of Trump-appointed NLRB General Counsel Peter Robb, who had sided with Foundation-represented workers in several cases in which they sought to resist union boss coercion. The emails show widespread partisan bias throughout the agency, which is charged with neutrally enforcing federal labor law.
Under long-standing federal law, the NLRB General Counsel has unreviewable authority to prosecute unfair labor practice charges, including those brought by workers against union officials. To protect that authority from blatant political interference, Congress gave the General Counsel a four-year term. Once appointed by the president and approved by the Senate, no General Counsel in the history of the NLRB had ever been fired. That changed when, just minutes after Biden took office on January 20, 2021, his administration moved to fire Robb despite 11 months remaining on his term.
NLRB Officials Celebrated Biden Attack on Labor Board’s Top Prosecutor
Following Biden’s election with the backing of Big Labor officials who wanted to shield themselves from accountability at the NLRB, Biden was encouraged by union bosses to remove General Counsel Robb and replace him with a union partisan. Five days after the removal of Robb, Biden fully obliged, selecting career NLRB bureaucrat Peter Sung Ohr as Acting General Counsel. The FOIA-requested emails show that although some NLRB officials were surprised by Biden’s actions — with one career NLRB attorney noting the move was “not expected” — some current and former NLRB officials voiced their approval of the unprecedented actions that fly in the face of the prosecutorial independence that Congress sought to protect when the General Counsel’s office was established. Los Angeles-based NLRB Region 31 Director Mori Rubin sent an email to her colleagues reacting to the news that Alice Stock, then the number-two attorney at the agency, had been fired along with Robb. Rubin derided Stock as a “clone” of Robb. She said “there is talk that Peter Ohr may be appointed acting GC, which would be wonderful!” Respondents to the thread, whose names are redacted, proclaimed: “Go Biden!!”, “That would be terrific!” and “Hope this comes true!”
Within days Ohr rescinded almost a dozen guidance memos issued by Robb, including one ensuring workers could avoid funding union political and lobbying activities, another allowing workers to intervene in legal actions that are used to block efforts to secure decertification votes, and yet another strengthening unions’ obligations to workers subject to union boss monopoly bargaining. In all these instances Ohr took the position advocated by union officials who had backed Biden’s election campaign, and against those of Foundation-backed employees.
Ohr earned praise for his aggressive implementation of the Biden agenda. Among the emails unearthed in the FOIA request was a message to Ohr from longtime NLRB attorney Emily Hunt describing her reaction on the day of Biden’s inauguration when she learned that Robb had been removed: “I exclaimed to myself, ‘This day just keeps getting better and better!’” Hunt, whose career with the NLRB spanned over 30 years, commended Ohr for rescinding Robb’s memos.
Foundation Spreads the Word About Activism within NLRB
The NLRB emails received coverage from multiple outlets including Fox Business, The Epoch Times, and Reuters. The coverage exposed the favoritism of many inside the NLRB towards union officials despite the Board’s directive to apolitically enforce federal labor law.
“By celebrating Joe Biden’s unprecedented attack on the Board’s independence so openly, the NLRB officials in these emails make it clear that those inside their agency do not want the Board to be an independent enforcer of the law as Congress intended,” said National Right to Work Foundation Vice President Patrick Semmens. “Instead, these partisans want the Board to be an activist agency with a mission of advancing union boss power at the expense of the rights of rank-and-file workers.”

Union bosses lied to metal workers and covertly signed forced-dues contract to keep grip on power
In NLRB documents, Steelworkers union officials openly defended their deception of employees, calling such behavior “irrelevant” to whether they should remain in power.
FRANKLIN, PA – Workers under the thumb of union bosses have many reasons to oppose the union’s “representation.” It could be they oppose a bad contract the union negotiated, or maybe it is the union’s divisive political activity for candidates they oppose. Whatever the reason, workers have a right under federal labor law to vote to free themselves of such unwanted union “representation.”
But federal labor law also has no shortage of workarounds for union bosses bent on clinging to their monopoly bargaining power over workers. Kerry Hunsberger and her coworkers at Latrobe Specialty Steel’s Franklin, PA, facility are currently defending their right to throw out unpopular Steelworkers union officials, after the union chiefs secretly signed a contract workers had voted down twice.
Steelworkers Officials Tried to Dodge Employee Accountability
Steelworkers chiefs did so to activate a so-called “contract bar” and remain in power at the plant when they knew a decertification election was coming. Steelworkers officials held two ratification votes to make workers think they had control over whether the contract went into effect. But in reality, union officials have no legal obligation under the National Labor Relations Act (NLRA), the federal statute that governs private sector labor relations, to even conduct such a ratification vote, much less heed the workers’ actual vote tally.
The pro-union boss National Labor Relations Board (NLRB) created out of whole cloth the “contract bar” policy. It immunizes union officials from employee-backed attempts to vote out a union for up to three years after union bosses and management finalize a contract — even a contract that isn’t supported by a majority of workers.
Hunsberger’s petition asking the NLRB to hold a vote to remove the union contains the requisite number of signatures under NLRB rules, but union officials argue the “contract bar” should block the election anyway.
Union Bosses Ignored Two Votes by Workers Rejecting Forced-Dues Contract
The Latrobe Specialty Steel workers first voted July 25 on the contract drawn up by Steelworkers union officials. The workers soundly rejected the contract, and Hunsberger began collecting employee signatures for a decertification petition shortly afterwards.
According to documents and transcripts filed with the NLRB, when Steelworkers union officials discovered a decertification petition was circulating, they secretly and hurriedly signed the unpopular contract on July 28, without telling the employees or the employer, in an attempt to activate the “contract bar” rule and avoid being voted out.
The slapdash contract lacked basic In NLRB documents, Steelworkers union officials openly defended their deception of employees, calling such behavior “irrelevant” to whether they should remain in power. elements, like start and end dates. Even though the union now claims this contract was immediately in effect on July 28, union officials held a new employee ratification vote on August 1, encouraging workers to “ratify” the contract. But the union bosses never told the workers their “vote” was a meaningless sham because union officials had already signed the forced-dues contract in secret.
Hunsberger’s decertification petition was filed at 2:00 PM on August 1, just hours before the sham contract vote occurred. As with the previous vote, the workers rejected the contract by a lopsided margin. But later that night, at around 9:00 PM, union officials suddenly announced to the employer that the contract was already in effect and the employee ratification “vote” was irrelevant because of the union bosses’ covert signing on July 28.
In sworn testimony, one union boss admitted that Steelworkers union bosses execute contracts despite employees voting them down, and that union officials deceived the Latrobe workers and ignored their votes in this case “to protect the integrity of the union.” Apparently the Steelworkers bosses’ lust for monopoly bargaining power and compulsory union payments takes precedence over the actual wishes of the rank-and-file workers union officials purport to “represent.”
‘Contract Bar’ Encourages Unions to Force Through Unpopular Contracts
“Steelworkers union bosses drew up a contract that my coworkers and I hated, so naturally we wanted them out of our workplace and out of our pocketbooks. But to add insult to injury, they apparently didn’t even think they owed us a duty of honesty,” said Hunsberger.
“This entire ordeal has been incredibly frustrating and we are grateful for the help of the National Right to Work Foundation in defending our right to vote the union out.”
Kerry Hunsberger’s Foundationbacked brief defending her and her coworkers’ rights states that the Steelworkers’ contract ploy is “nothing more than a smokescreen, concocted by a desperate and unpopular union to entrench itself and bar employee free choice” under federal law.
“The ‘contract bar’ arbitrarily blocks, often for years, workers’ statutory right under federal law to vote out union officials they oppose. Worse, it encourages union officials to cynically impose a contract at all costs, especially when union bosses know rank-and-file workers would see such a contract as a reason to get rid of so-called union ‘representation,’” commented National Right to Work Foundation Vice President Patrick Semmens. “This case presents an easy choice for the NLRB: defend the rights of rank-and-file workers, or side with Steelworkers union officials, who repeatedly misled those workers and disregarded their votes simply to protect union power. The case also demonstrates that there is no such thing as ‘union democracy’ in America.”
ATU Union Facing Prosecution After Agent Physically Assaults Bus Driver

Bus driver targeted by union militants for opposing incumbent union officials
Driven by Justice: Thomas McLamb did not let ATU union agents get away with upending his career just because he opposed their agenda. The union is now facing prosecution for its abuses.
WASHINGTON, DC – Transdev bus driver Thomas McLamb thought that Amalgamated Transit Union (ATU) union bosses at his workplace were mishandling finances and not serving the workers’ interests. In 2015, he led a campaign to vote the union out, and in October 2021 he ran for union office in the hopes of unseating officials he found ineffective.
In response, union agents kicked off a vicious retaliation campaign to punish McLamb for peacefully resisting ATU union bosses’ agenda. This included a union steward physically assaulting McLamb and another union official arranging McLamb’s illegal firing.
McLamb sought out free legal assistance from the National Right to Work Foundation and hit ATU union officials with federal charges for illegal retaliation. He also charged Transdev for the company’s role in his firing. McLamb’s opposition to the ATU union is activity protected by the National Labor Relations Act (NLRA), which guarantees workers’ right to “refrain from any or all of ” union activities. McLamb’s charges say that ATU and Transdev officials illegally violated his rights under the NLRA.
Following an investigation, the National Labor Relations Board (NLRB) issued a formal complaint against the ATU union, confirming all McLamb’s charges and scheduling a trial against ATU for its campaign of illegal retaliation. As this edition of Foundation Action went to press, a trial over the union’s misconduct had concluded. McLamb is now awaiting a decision from an NLRB Administrative Law Judge (ALJ).
Union President Encouraged Followers to Assault Dissident Workers
In a statement filed in November 2021, McLamb said that the ATU Local 689 president, Raymond Jackson, had told other union officers to “slap” employees who were opposing his agenda. Shortly after, McLamb’s statement reported, a union shop steward assaulted him. Both incidents occurred while McLamb was campaigning against the incumbent officers to serve on Local 689’s board.
The NLRB’s complaint and notice of hearing in the case echoed McLamb’s charge. It stated that “[o]n November 11, 2021 . . . [union steward] Tiyaka Boone, at the Employer’s Hubbard Road facility, in the presence of employees, physically assaulted the Charging Party.”
McLamb reported in another federal charge that, shortly after this incident, ATU official Alma Williams demanded that Transdev management fire him. The NLRB’s complaint confirms this accusation: “On November 11, 2021, Respondent, by Alma Williams, at the Employer’s Hubbard Road facility, requested that the Employer discharge the Charging Party.”
On November 16, Transdev gave McLamb a letter stating that he had been placed on “Administrative Leave without pay” pending the outcome of an investigation.
For its part, Transdev backed down and settled immediately, reinstating McLamb and paying him full back wages for the period of his suspension. The ATU union, however, remains defiant.
“The union should not be run as the personal fiefdom of union bosses who do everything they can to insulate themselves from accountability, yet that’s how ATU officials have treated it, complete with threats and violence against me for calling out union officials’ shortcomings,” McLamb told The Washington Free Beacon shortly after a trial was scheduled in his case.
Case Highlights Need for Right to Work Protections
“No American employee should have to go to work thinking that they could be fired, mugged, or slandered merely for exercising their right to oppose union officials. The NLRB’s issuance of a complaint against the ATU in Mr. McLamb’s case is a small but significant step toward justice,” commented National Right to Work Foundation Vice President Patrick Semmens. “However, due to Maryland’s lack of Right to Work protections for its private sector employees, Mr. McLamb is still required to sacrifice part of every paycheck to the same union hierarchy that is now facing prosecution for instigating violence against him.”
“Although we’re happy that the scales are finally tipping in Mr. McLamb’s favor, it’s unfortunately the reality in the 23 non-Right to Work states that workers are forced to pay fees to union hierarchies that act against their interests, sometimes even violently so.”
