Security Guards Overwhelmingly Vote to Remove SPFPA Union Officials from Vogtle Nuclear Power Plant

Guards avoid runoff with clear vote to reject two different unions

Waynesboro, GA (February 10, 2026) – Security guards working for Southern Nuclear Operating Company have freed themselves from the control of Security, Police and Fire Professionals of America (SPFPA) union officials in their workplace. The guards, who in January filed a petition seeking a “union decertification vote” with free assistance from National Right to Work Foundation staff attorneys, work at Plant Vogtle, a major nuclear power plant in Waynesboro, Georgia.

In a vote conducted by the National Labor Relations Board (NLRB), a majority of voting security guards decided against having any union at all in their workplace, rejecting both the SPFPA and a rival union that was trying to work its way into power. By voting overwhelmingly to reject union “representation,” the guards avoided a runoff election and sent a clear message in favor of their individual freedom.

The NLRB is the federal agency responsible for enforcing federal labor law, a task that includes administering votes to install (or “certify”) and remove (or “decertify”) unions in workplaces. Under NLRB rules, the Board should administer a decertification election if employees submit a petition in which at least 30% of workers in a work unit demand such an election.

Security Guards Restore Individual Freedom in Their Workplace

Georgia is a Right to Work state, meaning that SPFPA officials could not enforce union contracts that require workers to pay union dues or fees to keep their jobs. Now, the nearly 250 security guards at the power plant are also free from SFPFA’s exclusive “representation,” a power used by union officials to impose restrictive, one-size-fits-all contracts on every employee in a workplace, even those who don’t support the union.

The Foundation has seen unprecedented levels of worker-backed decertification efforts in the wake of the radical, pro-Big Labor policies instituted by the Biden Administration. There were several successful decertification efforts in 2025 involving the Teamsters, the Operating Engineers, the International Brotherhood of Boilermakers, and the Service Employees International Union. This successful effort continues this trend into 2026.

“Contrary to union boss propaganda, workers all across America desire to make a living independent of union rules and strictures. Plant Vogtle security guards have just joined the vast majority of American workers who are not under union control and have no ambitions to join a union,” said National Right to Work Foundation President Mark Mix. “While Georgia’s Right to Work law guards employees from the forced-dues demands of union officials, no worker should be forced under the control of union chiefs who are self-interested or simply aren’t doing a good job.”

Guards collect enough signatures to prompt federal labor board to administer union removal vote

Waynesboro, GA (January 8, 2026) – Security guards working for Southern Nuclear Operating Company have recently filed a petition asking the National Labor Relations Board (NLRB) to hold a vote to remove the Security, Police and Fire Professionals of America (SPFPA) union from their workplace. The guards, who filed the petition with assistance from National Right to Work Foundation staff attorneys, work at Plant Vogtle, a major nuclear power plant in Waynesboro, Georgia.

The NLRB is the federal agency responsible for enforcing federal labor law, a task that includes administering votes to install (or “certify”) and remove (or “decertify”) unions in workplaces. Under NLRB rules, the Board should administer a decertification election if employees submit a petition in which a required number of workers in a work unit demand such an election. The Southern Nuclear Operating Company workers’ petition, which Dallas Howard submitted on behalf of his coworkers, met this threshold.

Security Guards Dissatisfied with Union ‘Representation’

Georgia is a Right to Work state, meaning that SPFPA officials cannot enforce union contracts that require workers to pay union dues or fees to keep their jobs. In non-Right to Work states, union bosses can have workers fired solely for refusing to financially support union officials’ activities.

However, in both Right to Work and non-Right to Work states, union officials can wield exclusive “representation” power over every employee in a workplace, even those that don’t want to be represented by the union. A successful decertification election would strip SPFPA union bosses of exclusive bargaining power over these 250 security guards, enabling the workers to negotiate for themselves.

SPFPA Union Officials Continue to Ignore Worker Interests

The Foundation has seen a history of unwanted “representation” by the SPFPA. In 2024, the Foundation provided free legal aid to security guards in Delaware after the SPFPA negotiated a contract behind their backs. In Las Vegas, security guards scored a settlement returning thousands of dollars in illegally-seized union dues after SPFPA officials failed to acknowledge many employees’ attempts to revoke their union memberships and cut off dues deductions.

“SPFPA union officials have repeatedly shown that they care little about workers they claim to ‘represent.’ They only care about maintaining control and power, and we are proud to assist these security guards as they try to restore their individual freedom,” said National Right to Work Foundation President Mark Mix. “While Georgia’s Right to Work law guards employees from the forced-dues demands of union officials, no worker should be forced under the control of union chiefs who are self-interested or simply aren’t doing a good job.”

Michigan Security Guards Overwhelmingly Vote to End Union Bosses’ Power to Force Workers to Pay Up or Be Fired

In rebuke to partisan Right to Work repeal, majority of guards vote against union officials’ ability to require union dues payments

Grand Rapids, MI (September 23, 2024) – A group of Michigan security guards, have voted to strip United Government Security Officers of America (UGSOA) union officials of their power to force the guards to pay union dues as a condition of keeping their jobs. A majority of the guards employed by Triple Canopy, Inc. voted overwhelmingly to remove union bosses’ forced-dues powers in the “deauthorization” election. Following months of delays, the National Labor Relations Board (NLRB) recently released the full vote count from the election that took place by mail in April and May.

Guard James Reamsma submitted the “deauthorization petition” in February on behalf of his Triple Canopy Inc. coworkers, who guard federal facilities across Michigan and who wanted to revoke forced-dues privileges from UGSOA union officials. Reamsma is receiving free legal aid from the National Right to Work Legal Defense Foundation.

Reamsma’s request for a deauthorization election was necessary because Michigan’s popular decade-old Right to Work law was repealed in February. Under Right to Work, union financial support is strictly voluntary. Without Right to Work, union officials have the power to demand workers pay up or be fired. Michigan’s non-Right to Work environment forces workers to either deauthorize a union or vote it out of a workplace completely (via a similar process known as “decertification”) if they want to end union officials’ forced-dues power.

In response to Reamsma’s petition, the NLRB scheduled the mail vote with ballots due in mid-May. However, rather than promptly counting the ballots and certifying the results, the results were delayed for months, with the full NLRB tally of ballots only recently being released.

Once the results are certified, union officials will no longer have the legal power to coerce Reamsma and his colleagues to pay dues or fees as a condition of employment.

UGSOA Union Bosses Still Face Federal Charges For Illegal Dues Deductions

In addition to his deauthorization petition, Reamsma filed NLRB Unfair Labor Practice charges in May against UGSOA for seizing dues money from his paycheck without providing required disclosures on how the union spends worker cash. That charge, which was also filed with legal aid from the National Right to Work Foundation, is still being investigated by Region 7 of the NLRB based in Detroit.

According to Reamsma’s charge, he submitted a notice to UGSOA union agents in March that requested the union reduce his dues payments in accordance with Right to Work Foundation-won U.S. Supreme Court decision Communications Workers of America v Beck and provide him with the financial information required by law. In response, union officials claimed that the amount of dues chargeable to nonmembers was equal to 100% of full union dues. Reamsma’s charge states that UGSOA “failed to provide the financial disclosures for itself and its affiliated unions, and a chance to object to its alleged reduced fee.”

The charge also notes that, despite Reamsma notifying union officials in April that he prefers to pay union dues by check, UGSOA ignored this request and has continued to take money directly from his paycheck by payroll deduction. Federal labor law forbids union officials from using direct deduction to collect union dues or fees without worker consent.

After Repeal of Right to Work, Employees Across Michigan are Challenging Forced Dues

In a party-line 2023 vote, Michigan legislators repealed Right to Work at the behest of union special interests, ending workers’ ability to decide for themselves whether or not union officials deserve their money. The repeal came despite polling showing Michigan voters, including 70% of union households, overwhelmingly wanting Michigan to remain Right to Work.

After the repeal became effective in February, workers from across the Great Lakes State sought help from National Right to Work Foundation staff attorneys in escaping union bosses’ forced dues demand.

“This election was scheduled in May, but NLRB delayed the counting of the votes until now, all while UGSOA continued illegally collecting union dues,” commented National Right to Work Foundation President Mark Mix. “It’s tactics like this that would have been prevented, if Michigan had kept it’s Right to Work law.

“These workers’ vote to end forced dues happened months ago, and we call on the NLRB to promptly make the result official, and order the union to return all monies taken from the employees during the delay to certify the guards’ wishes.

“We are proud to help Michigan workers reclaim their freedom, but no worker should have to navigate the NLRB’s bureaucratic deauthorization process simply to ensure their hard-earned money isn’t going to union boss activities they may staunchly disagree with.”

Michigan Security Guards Fight to End Union Bosses’ Forced-Dues Power

Worker blasts state Right to Work repeal: ‘Now… [we] must join or lose our jobs’

Freedom Fighter: Security guard James Reamsma is disappointed that the Right to Work repeal re-imposes forced-dues payments, but he and his coworkers still have a shot to restore their liberty.

GRAND RAPIDS, MI – In February, Big Labor allies in the Michigan Legislature and union partisan Gov. Gretchen Whitmer saw their plans to enrich union bosses at the expense of workers come to fruition. The repeal of the state’s Right to Work law — which Whitmer and state legislators backed despite polling showing that 70% of Michiganders wanted the law to remain in place — became effective that month.

Michigan’s Right to Work law, which took effect in 2013, was popular for a reason: It protected the state’s private sector workers from being forced to pay union dues as a condition of employment. Michigan then experienced substantial economic gains while the law was effective. Now that union bosses can again force Michigan workers to pay dues or be fired, it’s no surprise that National Right to Work Foundation staff attorneys are seeing worker backlash to the change.

Despite Repeal, Western MI Guards Can Still Restore Worker Freedom

In a rebuke to the Right to Work repeal, security guards from government buildings across Western Michigan in February backed a “deauthorization petition” that will kick off a process that could strip union officials of the United Government Security Officers of America (UGSOA) of their forced-dues powers. In a non-Right to Work state, deauthorization is the only option that workers have to remove union bosses’ forced-dues power apart from voting the union out in a decertification election.

Similar to the decertification process, workers who petition the National Labor Relations Board (NLRB) for a deauthorization vote must obtain signatures from 30% or more of their colleagues to trigger a vote. James Reamsma, the security guard who submitted the deauthorization petition with free Foundation legal aid, had signatures far beyond this threshold.

“UGSOA union officials have threatened to have everyone who does not join the union fired,” commented Reamsma. “Many of us are retired police officers, or military, working part time, supplementing our income by providing security for government buildings across Michigan.

“When Right to Work was in place, guards were never forced to join the union. Now part-time guards are expected to pay the same high dues as full-time guards and all guards must join or lose our jobs,” decried Reamsma.

According to the petition, the requested deauthorization vote will take place among “all full-time and regular part-time security guards . . . performing services for the Company . . . in and around the cities of Alena, Cadillac, Petoskey, Traverse City, West Branch, Flint, Bay [C]ity, [Big] Rapids, Ludington, Mount Pleasant, Owosso, Saginaw, Escanaba, Houghton, Ironwood, Marquette, Sault Ste. Marie, Grand Rapids, Holland, and Muskegon, Michigan.”

In addition to providing free aid to Wolverine State workers like Reamsma and his colleagues who are taking legal action to counter forced dues, the Foundation also issued a legal notice in February to all Michigan workers explaining the new legal landscape.

In New Anti-Freedom Environment, Foundation Keeps MI Workers Informed

The notice explains that while union bosses again have forced-dues power in the private sector, private sector workers can still object to paying dues for union political purposes as per the Foundation-won CWA v. Beck Supreme Court decision, or end forced dues in their workplace entirely by decertifying or deauthorizing the union.

As for public sector workers, the Foundation’s 2018 victory at the Supreme Court in Janus v. AFSCME ensures that their freedom from forced dues is still protected by the First Amendment despite the cynical Right to Work repeal.

“Within weeks of Michigan’s Right to Work repeal, we see the harm Big Labor’s coercive policy agenda inflicted on rank-and-file workers,” commented National Right to Work Foundation President Mark Mix. “Mr. Reamsma and his colleagues, who will be providing security to Western Michigan’s government buildings during what is likely to be another turbulent election year, don’t deserve to be forced into financially supporting a union they disapprove of, nor does any Michigan private sector employee.

“While union boss powers have greatly expanded since the Right to Work repeal, workers still have some rights to resist union boss coercion, and Foundation attorneys stand ready to help them exercise those rights,” Mix added.

Security Guards at Federal Buildings Across Delaware Voting Soon on Whether to End SPFPA Union’s Forced-Dues Power

SPFPA union officials trapped workers in union ranks, but workers still have chance to stop mandatory dues payments

Delaware (June 26, 2024) – Security guards posted at federal buildings across the state of Delaware will soon cast ballots in a “deauthorization election” that may strip officials of the Security, Police and Fire Professionals of America (SPFPA) union of their power to force guards to pay union dues as a condition of employment. Newark, DE-based security guard Steven Bowden requested the vote by submitting a deauthorization petition to the National Labor Relations Board (NLRB), which a majority of his fellow guards employed by GXC Inc. backed. Bowden is receiving free legal aid from National Right to Work Foundation staff attorneys.

The NLRB is the federal agency responsible for enforcing federal labor law in the private sector. Following an election agreement, the NLRB has announced that the guards can begin casting ballots in the deauthorization election on July 2.

Because Delaware is one of the minority of states still lacking Right to Work protections, union bosses have the legal privilege to force private sector workers like the GXC Inc. security guards to pay union dues or fees as a condition of employment. For that reason, workers opposed to funding union activities can only end the union’s forced-dues power by voting against it in a deauthorization election, or by requesting a “decertification vote” that terminates a union’s bargaining power in a workplace completely.

Gathering employee signatures to petition for a deauthorization or decertification vote can be difficult and time-consuming, especially in a situation like Bowden’s where the members of his work unit come from across the state. In contrast, in Right to Work states, deauthorization votes are unnecessary because union membership and financial support are the voluntary choice of each individual worker.

Union Officials Manipulated Carve-Outs in Federal Labor Law to Stay in Power

SPFPA union officials drew the ire of Bowden and his colleagues by signing a contract with GXC Inc. management without the workers’ knowledge or consent. While voting the union out of the workplace would be their next logical step, the NLRB’s so-called “contract bar” allows union officials to immunize themselves from worker-backed decertification attempts for up to three years after a union contract has been finalized. The “contract bar” appears nowhere in the text of the National Labor Relations Act (NLRA), the federal law the NLRB is charged with enforcing, but is the product of union boss-friendly decisions made by partisan NLRB members over the years.

“SPFPA union officials sprung this contract on me and my colleagues, which is hardly what we would consider ‘representing’ us fairly,” commented Bowden. “It’s disappointing that NLRB rules prevent us from kicking SPFPA bosses out, but stopping them from forcing us to fund union activities is definitely a step in the right direction, and we’re confident we’ll win this vote.”

Union officials regularly exploit the “contract bar” to remain in power, even when workers have clearly expressed their opposition to the union’s performance. In 2022, Foundation attorneys successfully defended Kerry Hunsberger and her coworkers at Latrobe (PA) Specialty Metals from a scheme by United Steelworkers (USW) to use a contract that workers had overwhelmingly voted against as a reason to block a decertification vote. In 2020 and 2021, Foundation attorneys also aided an 800-employee unit of Mountaire Farms poultry workers in Delaware in a similar situation.

This also isn’t the first time that Foundation attorneys have provided free legal aid to security employees seeking freedom from SPFPA union dues schemes. In 2020, Las Vegas-based security guard Justin Stephens and his coworkers scored a settlement returning thousands of dollars in illegally-seized union dues to North American Security staff after SPFPA officials failed to acknowledge many employees’ attempts to revoke their union memberships and cut off dues deductions.

“SPFPA union bosses betrayed the trust of Delaware GXC security guards by finalizing a new contract behind their backs, and these guards certainly deserve a chance to exercise their right to vote the union out,” commented National Right to Work Foundation President Mark Mix. “Despite that, the ‘contract bar’ lets union officials unilaterally block workers from voting a union out of power, demonstrating how stacked federal labor law is against basic worker freedom.

“Federal labor law’s bias toward keeping union bosses in power even over workers’ objections again shows why Right to Work laws are needed nationwide,” Mix added. “If union officials can legally trap workers under a union’s so-called ‘representation,’ the least states can do is provide workers a way to protect their hard-earned cash from going toward union activities that go against their interests.”

Las Vegas Security Guards Win $4,200 in Case Challenging Illegal Dues Seizures

SPFPA officials rushed monopoly bargaining contract in attempt to trap workers in forced dues

“You can stand up to the union and not fail and not have fear of retaliation,” security guard Justin Stephens told the Las Vegas Review-Journal about his and his coworkers’ victory.

LAS VEGAS, NV – Dozens of Las Vegas security guards employed by North American Security won a settlement last October against the Security, Police & Fire Professionals of America (SPFPA) union, which they had charged in April with illegally seizing dues from their paychecks. The guards received free legal aid from the National Right to Work Foundation.

SPFPA union officials must now refund more than $4,200 to the security guards, whose timely requests to resign from union membership and cease dues deductions were wrongfully rejected by union officials who hastily extended their monopoly bargaining agreement with the guards’ employer.

Union Officials Secretly Struck Contract after Guards Voiced Dissatisfaction

According to guard Justin Stephens’ April 2020 charge filed at Region 28 of the National Labor Relations Board (NLRB) in Phoenix, SPFPA officials extended the bargaining contract with North American Security on January 31, 2020. The extension occurred one day after Stephens and the vast majority of his fellow employees at the federal courthouse in Las Vegas sent letters to the union stating that they no longer wanted it as the monopoly bargaining agent in their workplace.

The charge explained that Stephens later submitted a batch of letters to SPFPA officials in which he and his fellow employees tried to exercise their rights to resign union membership and stop dues deductions from their paychecks. These letters were sent within what the employees believed to be the contract’s window for exercising their right to cut off dues payments.

However, the charge asserted, the union “did not acknowledge the timely revocation the employees made on the anniversary” of the contract, ostensibly because the union officials’ hurried contract extension eliminated any opportunity for employees to cut off union dues before the existing contract’s March 31 expiration.

SPFPA bosses kept collecting full union dues “from all non-member bargaining unit employees” in violation of their right under the National Labor Relations Act to refrain from union activities and support, according to the charge. Stephens’ charge also asserted that the union’s sudden extension of the monopoly bargaining contract after the workers notified the union about their opposition amounted to “an apparent attempt to avoid a decertification” vote to remove the union.

Because Nevada has enacted Right to Work protections for employees, union bosses are additionally forbidden by state law from requiring any employee to join or pay dues or fees to a union as a condition of employment.

The settlement requires SPFPA officials to process any timely resignations by security guards and notify North American Security to cease dues deductions from those whose resignations they have already processed.

Foundation Wins Refunds of Unlawful Dues Seized from Dozens of Guards

SPFPA bosses must also return all dues seized from Stephens’ and his coworkers’ paychecks in violation of their rights. In the future, the settlement stipulates, union officials must always “accept and timely process” resignations and requests to cut off dues.

“I want people to see this and see that it’s possible,” Stephens told the Las Vegas Review-Journal in a story about his case. “You can stand up to the union and not fail and not have fear of retaliation.”

“It’s good news that Mr. Stephens and his hardworking colleagues have gotten back dues that were illegally taken from them by SPFPA union bosses who have demonstrated they are more interested in stuffing their coffers with union dues than respecting the wishes of the rank-and-file workers they claim to ‘represent,’” commented National Right to Work Foundation Vice President and Legal Director Raymond LeJeunesse. “This type of legal trickery used by union bosses to stay in power despite the objections of most workers shows why the NLRB should eliminate its numerous policies that block workers from removing an unwanted union.”

“Ultimately, the root of this problem is the federal labor law which grants union bosses monopoly bargaining powers, allowing them to force their so-called ‘representation’ on workers who don’t want it and believe they would be better off without it,” added LaJeunesse.
