Pennsylvania EMS/Rescue Workers Unanimously Vote to Remove Teamsters Union After Union Boss Delay Tactics

Emergency workers submitted multiple petitions asking for vote to escape Teamsters union officials’ exclusive “representation” powers and demands for money

North Huntingdon Township, PA (March 10, 2026) – Following months of union-instigated delays, Shannon Martin and her coworkers at North Huntingdon EMS/Rescue unanimously voted Teamsters Local 205 union officials out of power at their workplace. Martin obtained the vote by filing a union decertification petition at the National Labor Relations Board (NLRB) with free legal assistance from National Right to Work Foundation staff attorneys.

The NLRB is the federal agency responsible for enforcing private sector labor law, a task that includes administering elections to install (or “certify”) and remove (or “decertify”) unions. In response to her colleagues’ staunch opposition to the union, Martin filed a total of three union decertification petitions with Foundation legal aid, all of which either showed unanimous worker support for a union decertification vote or otherwise passed the threshold to trigger a vote under NLRB rules.

However, NLRB Region 6 in Pittsburgh blocked Martin and her colleagues from having a vote for months at Teamsters officials’ behest. Regional NLRB officials cited the so-called “voluntary recognition bar” as the justification for delaying the vote. The voluntary recognition bar stops workers from exercising their right to vote out a union for a year or more after union officials have installed themselves via “card check,” a process that bypasses the traditional secret-ballot union election process.

Under card check, union officials can demand “union authorization cards” directly from workers, which are later counted as “votes” for the union. Unsurprisingly, this process leaves workers open to threats and manipulation from union officials. Even union organizing handbooks recognize that card check is not indicative of how workers would vote in a standard union election. Martin and her coworkers were unfortunately trapped in a work unit that had been organized via card check.

To make matters even worse, Pennsylvania lacks Right to Work protections, meaning Teamsters union bosses were empowered to impose monopoly bargaining contracts that forced Martin and her colleagues to pay money to the union as a condition of employment. In contrast, in Right to Work states, union membership and all union financial support are strictly voluntary.

Flawed NLRB Policy Let Union Bosses Stay in Power Despite Obvious Worker Opposition

In mid-February – over a year after the Teamsters union had established itself via card check in Martin’s workplace – Martin filed her third decertification petition with Foundation aid, which finally resulted in the NLRB scheduling a vote to remove the union. On March 3, Martin and her coworkers voted unanimously to dethrone Teamsters union bosses.

The Foundation has consistently advocated for the elimination of the voluntary recognition bar, as well as other NLRB policies that appear nowhere in the text of federal labor law and serve only to stifle workers’ free choice. The Foundation supported the NLRB’s promulgation of the Election Protection Rule during the first Trump Administration, which gave independent-minded workers a chance to request a secret-ballot vote to challenge union officials’ claims of majority support following a card check campaign. However, the Biden NLRB repealed the Election Protection Rule.

“Ms. Martin and her coworkers’ dedication to winning back their freedom from unwanted Teamsters officials is admirable, and we were proud to help them win,” commented National Right to Work Foundation President Mark Mix. “But her case exposes the anti-worker nature of the so-called ‘voluntary recognition bar.’ This misguided NLRB policy let Teamsters bosses stay in power long after it was clear that there was uniform opposition to them in the workplace.

“Trump’s new appointees should look to situations like Ms. Martin’s as prime examples of why NLRB policies should be reformed to prioritize secret-ballot elections and worker free choice,” Mix added.

Genesys Nurse Hits Hospital, Teamsters Union with Additional Federal Charges for Illegal Dues Deductions

New charges latest example of how union bosses are violating workers’ rights following repeal of Michigan Right to Work law

Flint, MI (August 20, 2024) – Madrina Wells, a nurse at Ascension Genesys Hospital in Grand Blanc Township, MI, has filed additional federal unfair labor practice charges against the Teamsters Local 332 union and her employer for illegally deducting union dues out of her paycheck in violation of federal law. Madrina filed the two new unfair labor practice charges with the National Labor Relations Board (NLRB) with free legal aid from National Right to Work Foundation staff attorneys.

Last month, Wells and her coworker filed federal unfair labor practice charges against the Teamsters Local 332 union, where they maintained that union bosses threatened to fire them and other nurses if they didn’t sign forms authorizing union officials to deduct dues straight out of their paychecks.  The charges for Wells and her coworker Lynette Doyle, were also filed at the NLRB with National Right to Work Foundation legal aid. NLRB agents will now investigate Wells’ multiple charges in addition to the charge filed by Doyle.

The new charges from Wells are the most recent in a flurry of Foundation-backed cases for Michigan workers who are seeking to challenge or escape union bosses’ coercive power in the wake of Michigan’s repeal of its Right to Work law. Since the repeal became effective this February, union bosses have had the legal power to require workers to pay union dues or fees as a condition of employment. In states with Right to Work protections, union membership and all union financial support are strictly voluntary.

However, even in states like Michigan that lack Right to Work protections and allow for forced-fee requirements, longstanding federal law prohibits union bosses from requiring workers to authorize the direct deduction of union dues from their paychecks. The Foundation-won Communications Workers of America v. Beck Supreme Court decision additionally forbids union bosses in non-Right to Work states from forcing workers to pay money for any activities beyond the union’s bargaining functions, such as political expenditures.

“I already had issues with Teamsters bosses’ illegally demanding money from me when Right to Work was in force,” commented Madrina Wells. “Back then, I at least knew that I was defending my right to pay nothing at all to Teamsters bosses I disapprove of. It’s ridiculous that rather than comply with my rights, Teamsters Local 332, now with the assistance of my employer, have violated Federal law once again by deducting dues from my paycheck without my consent.”

Without Right to Work, Michigan Workers Increasingly Having to Take Legal Action Against Union Boss Forced Dues Abuses

In a party-line 2023 vote, Michigan legislators repealed Right to Work at the behest of union special interests, ending workers’ ability to decide for themselves whether or not union officials deserve their dues money. The imposition of union bosses’ power to force employees to “pay up or be fired” came despite polling showing Michiganders, including those in union households, overwhelmingly opposed the elimination of workers’ Right to Work protections.

After the repeal became effective this February, workers from across the Great Lakes State sought help from National Right to Work Foundation staff attorneys in escaping union bosses’ forced-dues demands. The total cases that our attorneys have filed for Michigan workers in 2024 is already more than double the 2023 number.

“Emboldened by the partisan repeal of Right to Work, Michigan union bosses are showing once again that their greed for forced dues is more important than the rights of the very workers they claim to ‘represent,’” observed National Right to Work Foundation President Mark Mix. “Michigan workers are standing up to defend what rights they still have against union coercion, and the Foundation is proud to assist them.”

QUEENS, NY – With free legal aid from the National Right to Work Legal Defense Foundation, New York City UPS warehouse worker Kamil Fraczek has filed a National Labor Relations Board (NLRB) charge against Teamsters Local 804. The charge came after a Teamsters union official made repeated threats to his job and lied about his legal rights.

Union Official Refused to Respect Worker’s Rights under Beck Decision

When Fraczek began working at the warehouse full-time, a Teamsters representative tried to mislead him by telling Fraczek he must become a union member and sign documents authorizing dues deductions from his paycheck. Fraczek specifically asked about other options, but the union representative told him that if he did not sign the forms, Teamsters officials would ask UPS to fire him.

Because New York is a forced-unionism state that doesn’t protect workers with a Right to Work law, Fraczek can be required to pay some union fees as a condition of his job.

However, under long-standing federal law, workers cannot be required to become formal union members nor can they be required to pay full union dues even in non- Right to Work states. Under the Supreme Court’s 1988 CWA v. Beck decision, won by National Right to Work Legal Defense Foundation attorneys, no private sector worker can be compelled to financially support union activities unrelated to bargaining.

Union Misinformation Continues Even after Employee Demanded Rights

Expenses which can’t be charged to non-members under Beck include political expenditures and members-only activities.

Knowing his actual rights, Fraczek returned to the Teamsters official asking to be recognized as a non-member and Beck objector. He provided a letter to the representative stating his intention to pay only reduced fees and declining union membership.

As the unfair labor practice charge states, instead of accepting Fraczek’s request, the Teamsters official doubled down on his prior illegal threats. He demanded that Fraczek pay full dues and sign membership documents or face termination.

The official falsely claimed that only supervisors can opt out of the union, and that the federal laws protecting workers from funding union political activities only apply in Right to Work states, not in forced-unionism states like New York.

In response, Fraczek’s Foundation staff attorneys filed an NLRB charge asserting his right to pay reduced fees under Beck and not to join the union.
