NTEU union bosses backed Kamala Harris for President, but when voters rejected her, NTEU union officials and the Biden-Harris Administration hastily moved to install the union at the DOJ in an apparent attempt to obstruct Trump’s priorities.

WASHINGTON, DC – In states across the country, union officials go to great lengths to gain more political influence, and will often violate established law to do so.

As veteran Department of Justice attorney Jeffrey Morrison is discovering, federal agencies are no exception. Morrison is challenging a last-minute attempt by National Treasury Employees Union (NTEU) bosses to gain monopoly bargaining control over attorneys at both the DOJ Civil Rights Division (CRT, where Morrison is employed) and the DOJ Environment and Natural Resources Division (ENRD).

The unionization campaign was fast-tracked just days after Trump’s November election victory, in an apparent attempt to formally hand NTEU union officials power over the divisions prior to inauguration day. Morrison’s legal action asks the Federal Labor Relations Authority (FLRA) to formally review the actions by the Biden DOJ and NTEU officials. The FLRA is the federal agency responsible for adjudicating disputes between federal employees, union officials, and agencies within the federal government.

Brief: DOJ Holdovers and NTEU Bosses Colluded to Flout Existing Law

Morrison, who is receiving free legal aid from the National Right to Work Foundation, contends in filings before the FLRA that the NTEU’s scheme violates an existing FLRA decision in which the agency ruled that CRT attorneys did not comprise a work unit appropriate for unionization.

DOJ management raised this exact concern about the CRT unit with the FLRA after NTEU union bosses began their campaign, but the DOJ dropped its opposition just days after the November federal elections.

Morrison is asking the FLRA to review the decision of the Regional Director to allow the election to go forward in the CRT and ENRD divisions without properly considering if these divisions are an appropriate unit under the law.

Morrison’s filings (called “Applications for Review”) came after DOJ management and NTEU union officials agreed that the CRT and ENRD were work units appropriate for unionization. His Applications for Review point out that a prior FLRA decision, Antitrust Division, held that CRT lawyers “did not have a separate and distinct community of interest from other DOJ trial attorneys” and for that reason couldn’t stand as a distinct bargaining unit.

“[T]he Authority determined this very unit to not be an appropriate unit…The Regional Director’s failure to comply with current, binding Authority precedent is in error and must be reversed,” the Application for Review says regarding the CRT attorneys. This same argument is applied to the ENRD division because it is similarly situated to CRT in the DOJ hierarchy.

FLRA Failed to Conduct Investigation Into NTEU’s Union Scheme

Morrison’s applications also contend that the FLRA “fail[ed] to conduct an independent investigation into the appropriateness of the unit,” despite the law requiring that the FLRA make such a finding.

“An agency agreeing with a union that a unit is appropriate does not mean that unit is actually appropriate. Agencies, like DOJ here, cannot usurp the Authority’s role in deciding unit appropriateness…” say the Applications for Review.

“Right before power changed hands in Washington, DC, NTEU union bosses and DOJ bureaucrats appear to have colluded to flout longstanding precedent that says Justice Department attorneys cannot legally be unionized division by division,” commented National Right to Work Foundation President Mark Mix.

“The FLRA has ignored established precedent to let this hasty unionization attempt go through, and our attorneys are proud to assist Mr. Morrison in opposing this maneuver.”

Filings: Federal Labor Relations Authority’s decision to approve unionization attempts in Civil Rights and Environmental divisions violates precedent

Washington, DC (January 17, 2025) – A veteran Department of Justice trial attorney has just submitted two filings challenging a last-minute attempt by the National Treasury Employees Union (NTEU) to gain monopoly bargaining control over attorneys at the Civil Rights Division (CRT) and Environmental and Natural Resources Division (ENRD). The attorney, Jeffrey Morrison, filed these Applications for Review at the Federal Labor Relations Authority (FLRA) with free legal aid from the National Right to Work Legal Defense Foundation.

Morrison’s filings come after a unionization campaign during which DOJ management and NTEU union officials unilaterally “agreed” that the CRT and ENRD were work units appropriate for unionization, even though they are not appropriate bargaining units under longstanding FLRA precedent. Morrison’s Applications for Review argue that this and other legal issues with the proposed work units invalidate an FLRA Regional Director’s earlier decision to push forward the unionization process.

“Here, the Regional Director failed to apply established FLRA precedent that precludes finding CRT professional[s] to be an appropriate unit,” Morrison’s Application for Review says. “The Regional Director’s direction of election in this matter was thus in error. The Authority should grant review, stay the certification of the election results, reverse the Regional Director’s decision, and dismiss the petition.”

The FLRA is the federal agency responsible for adjudicating disputes between federal employees, union officials, and agencies within the federal government. The labor law governing federal agencies permits union officials to gain monopoly bargaining power over federal workers, even those who didn’t vote for the union or otherwise oppose it.

Despite 1984 FLRA Decision Rejecting Attempt to Unionize Civil Rights Division Attorneys, DOJ Abruptly Dropped Opposition to NTEU Unionization Attempt Shortly After Election Day

Morrison’s Applications for Review advance several arguments as to why NTEU bosses shouldn’t be able to gain control over the departments at issue. Notably, one brief points out that the FLRA ruled earlier in its Antitrust Division case that CRT lawyers “did not have a separate and distinct community of interest from other DOJ trial attorneys” and for that reason couldn’t stand as a distinct bargaining unit.

“[I]n that case, the Authority determined this very unit to not be an appropriate unit…The Regional Director’s failure to comply with current, binding Authority precedent is in error and must be reversed,” the brief says.

In fact, the brief notes, DOJ management maintained that very same concern about the NTEU’s unionization attempt until roughly three days after federal elections, when DOJ management abruptly reversed course and adopted the NTEU’s position.

Morrison’s applications contend that the FLRA “fail[ed] to conduct an independent investigation into the appropriateness of the unit,” despite the fact that it is required by law to do this before any unionization attempt on federal employees goes forward. “An agency agreeing with a union that a unit is appropriate does not mean that unit is actually appropriate. Agencies, like DOJ here, cannot usurp the Authority’s role in deciding unit appropriateness…” say the briefs.

“In the midst of a change in administration, NTEU union bosses and Biden DOJ officials appear to have colluded to flout longstanding precedent that says Justice Department attorneys cannot legally be unionized division by division,” commented National Right to Work Foundation President Mark Mix. “The FLRA has ignored both standard procedures and established precedent to let this hasty unionization attempt go through, and our attorneys are proud to assist Mr. Morrison in opposing this suspect legal maneuver.

“No worker should be subjected to unionization they oppose, and it is especially egregious that an outgoing Administration would violate the law in an attempt to entrench union bosses at the Justice Department, whose employees are charged with defending and enforcing federal law,” added Mix.

Foundation Helps Healthcare Workers Remove Unwanted Unions

Evidence of union boss “serious financial malpractice” exposed as workers seek to vote out SEIU

DETROIT, MI – Workers across America are increasingly fed up with union bosses’ self-serving so-called “representation.” National Right to Work Foundation legal aid requests are spiking from workers seeking assistance in filing decertification petitions to end union monopoly bargaining control in their workplaces. In 2021 alone, Foundation attorneys provided legal assistance in 54 National Labor Relations Board (NLRB) decertification efforts, which together sought to end union boss control of more than 7,000 workers.

This increased demand has continued in 2022, with healthcare workers in particular seeking the Foundation’s legal aid in exercising their legal right to free themselves from union ranks. In one such ongoing case, Foundation staff attorneys assisted Crystal Harper, an employee at Detroit’s Sinai-Grace Hospital, who along with coworkers battled to oust SEIU Healthcare Michigan union officials.

Harper’s initial petition was rejected after an NLRB regional official dubiously dismissed the petition on the grounds that “Midnight, February 8th” in the union monopoly contract was actually unambiguously a reference to the minute after 11:59 p.m. on May 7. This questionable interpretation of union officials’ sloppily written contract meant that the petition filed on the 8th was actually late under the controversial NLRB-created “contract bar” policy.

Undeterred, that decision was appealed and a second petition for a decertification vote was filed in May after the contract bar had expired and a vote was scheduled. Meanwhile, “substantiated allegations of serious financial malpractice” have come to light involving the SEIU local that were so glaring even SEIU International President Mary Kay Henry couldn’t ignore them, as she was pushed to use the SEIU’s “trusteeship” procedures to oust local officials and take full control of the local.

As a result, in June, Foundation President Mark Mix formally asked the Department of Labor and Department of Justice to investigate the serious allegations of financial and other wrongdoing by SEIU local officials. The letter calling for the federal investigation noted that “any internal SEIU International investigation will be insufficient [given the] long history of union officials attempting to ignore or downplay corruption in their own ranks.”

Foundation Counters Union Legal Tricks to Block Vote

Elsewhere in Michigan, lab technicians at Ascension Providence Rochester Hospital have finally won their effort to be free of unwanted so-called “representation” by union officials of the Office and Professional Employees International Union (OPEIU) Local 40.

During the protracted process, Foundation staff attorneys successfully fought off OPEIU union lawyers’ efforts to block the vote which cited the pending sale of the facility by Ascension to LabCorp as grounds for rejecting the workers’ request for an election. Union lawyers had urged the NLRB regional office to block a vote whether to remove the union on the grounds of an upcoming “cessation of operations” by the employer, a policy previously applied only to certification elections.

In briefs to the NLRB, Foundation staff attorneys countered that union attempts to block the vote were unjustified as a matter of law. Foundation attorneys also noted that the attempt to block the vote was likely a cynical attempt to keep power over the bargaining unit. If the sale ultimately went through, the union would have likely sought to block a decertification vote citing the NLRB-created “successor bar” that insulates union officials from decertification votes after a workplace’s change in ownership.

The Board ultimately rejected the union lawyers’ arguments and scheduled a decertification vote by mail-in ballot. However, rather than go forward with a vote they seemingly knew they were going to lose, OPEIU officials instead disclaimed interest in the unit, finally giving the workers the freedom from unwanted union representation they sought.

Meanwhile in Minnesota, multiple groups of healthcare workers are seeking decertification votes with Foundation legal aid. At the Mayo Clinic Health System in Mankato, Minnesota, approximately 500 nurses filed a petition for a vote to remove the Minnesota Nurses Association (MNA) union, while two separate units of Cuyuna of the lawsuit, Regional Medical Center healthcare workers located at facilities in Crosby, Baxter, Longville, and Breezy Point, Minnesota, filed for decertification votes to free themselves from the SEIU.

Hundreds of Minnesota Nurses Petition to Be Union Free

“I’m extremely grateful to have the free legal assistance of the National Right to Work Foundation in fighting for our right to hold a vote to remove the union,” commented Mayo Clinic Mankato nurse Brittany Burgess. “I can’t wait until the day when we are all finally free of the MNA.”

One likely reason for the increased decertification activity is Foundation-advocated reforms that were adopted by the NLRB in 2020 to curtail union officials’ abuse of so-called “blocking charges,” which they use to delay or block workers from exercising their right to decertify a union. However, with the Biden-appointed NLRB majority recently announcing it was starting rulemaking to overturn those reforms, Foundation staff attorneys are now gearing up to challenge the Biden Board’s attempt to give union bosses more power to trap workers in union ranks they oppose.

“Foundation staff attorneys will continue to assist workers in exercising their rights under federal law to hold decertification elections to remove so-called ‘representation’ opposed by most workers,” commented National Right to Work Foundation Vice President and Legal Director Raymond LaJeunesse. “The Biden NLRB is clearly prioritizing union boss power to the detriment of the rights of rank-and-file workers. Look no further than the fact that just as the Board seeks to expand the ability of union officials to impose unionization on workers through coercive ‘Card Checks’ without even secret-ballot votes, it simultaneously plans to make it easier for union lawyers to block workers from holding votes to remove a union.”

Indiana US Brick Employees Target ‘Successor Bar’ for Demolition

INDIANAPOLIS, IN – National Right to Work Foundation staff attorneys have made big strides in recent years for independent-minded workers who want to exercise their right to vote unpopular unions out of their workplaces.

The National Labor Relations Board’s (NLRB) adoption in 2020 of Foundation-backed reforms to the decertification process have made it significantly less difficult for workers to exercise their rights. But, there’s much more work to be done to eliminate contrived, union boss-friendly NLRB policies that stifle worker rights just so unwanted unions can stay entrenched.

Enter Kerry Atkins and his coworkers at US Brick in Mooresville, Indiana. With free Foundation legal aid they are fighting an NLRB policy called the “successor bar” that arbitrarily blocks employees’ right to vote out an unwanted union when management changes hands in a workplace.

Atkins filed a petition signed by his colleagues in December 2021, asking the NLRB to hold a vote on whether to decertify Teamsters Local 135 union officials. NLRB Regional Director Patricia Nachand ruled on February 9 that US Brick’s recent acquisition of the plant triggered the so-called “successor bar” and rendered the employee petition invalid.

NLRB-Invented Policy Traps Workers in Union They Strongly Oppose

Nachand blocked the vote even though, according to her own order, plant management has in its possession a parallel petition expressing disaffection with the Teamsters, which bears the signatures of about 70 percent of the employees.

The “successor bar” is a non-statutory policy invented by NLRB appointees that immunizes union officials from being voted out by employees for up to a year after management changes as a result of a sale, merger, or acquisition.

The National Labor Relations Act (NLRA), the federal law the NLRB is charged with enforcing, explicitly states that employees have a right to remove union monopoly “representation” they oppose. The “successor bar,” however, is found nowhere in the NLRA’s text.

The only “bar” to employees requesting a decertification election that is mentioned in the NLRA is a one-year restriction after employees certify a union in a secret-ballot vote. That the “successor bar” — which isn’t even in the NLRA — can stave off attempts to vote out a union for up to four years when combined with a “contract bar” makes it especially offensive to workers’ rights.

To make matters even worse, two different federal agencies — the NLRB and the Department of Justice — effectively worked together to impose the “successor bar” on Atkins and his coworkers. The Department of Justice in an antitrust complaint forced the former owner of the Mooresville brick facility to sell it to US Brick. The NLRB now says that event should be grounds for blocking the employees from ejecting a union they overwhelmingly oppose.

‘Successor Bar’ Disregards Desires and Experiences of Workers, Brief Says

Atkins’ Foundation attorneys have filed a Request for Review of Nachand’s order with the NLRB in Washington, D.C. It contends that the “successor bar” serves no purpose other than to block the will of rank-and-file employees, entrenching union bosses who ought to be accountable to the employees.

“The successor bar undermines the NLRA’s core purpose of employee free choice by disregarding employees’ actual desires and past experiences with their union representative,” the Request for Review argues.

Restriction Shows How NLRB-Invented Policies Stifle Individual Rights

“The NLRB-invented ‘successor bar’ is just one example of how the Board neglects its mandate to protect the rights of individual workers, including those opposed to forced union affiliation, just to protect union boss power,” observed National Right to Work Foundation Vice President Patrick Semmens. “The ‘successor bar’ not only overrides the statutory right of workers to vote out unions they oppose, but does so at the very moment when workers are most likely to reevaluate their union status: the turnover of the old management that perhaps was the reason for unionization in the first place.”

Michigan hospital workers seek to oust Healthcare Michigan union SEIU International recently put into trusteeship

Detroit, MI (June 6, 2022) – Today, National Right to Work Legal Defense Foundation President Mark Mix formally asked the Department of Labor, the Department of Justice, the U.S. Attorney of Michigan, and the Office of Labor-Management Standards to investigate serious allegations of financial wrongdoing by the Service Employees International Union (SEIU) affiliate Healthcare Michigan (HCMI). Foundation staff attorneys are providing free legal aid to workers at Sinai-Grace Hospital who are seeking a National Labor Relations Board (NLRB) decertification vote whether to remove HCMI officials from their workplace.

About the time the workers filed their second decertification petition to end the union’s so-called “representation” of the bargaining unit, the SEIU International announced it was putting the local into trusteeship due to serious and longstanding wrongdoing by local union officials. In her letter announcing the decision to take over the local, SEIU International President Mary Kay Henry concluded that there are “substantiated allegations of serious financial malpractice” and other issues of impropriety at HCMI.

Citing the SEIU’s trusteeship announcement, the National Right to Work Foundation President demanded that officials at the Department of Justice and Department of Labor also investigate HCMI union officials for illegally abusing their power, committing financial misdeeds, and possibly filing false reports with the Labor Department: “Any internal SEIU International investigation will be insufficient. There is a long history of union officials attempting to ignore or downplay corruption in their own ranks.”

The Sinai-Grace Hospital workers’ first petition seeking a vote to oust HCMI union officials was blocked after the NLRB sided with union lawyers in interpreting ambiguous union contract language to find that petition untimely. The sloppy contract language was negotiated by the union officials whom the SEIU International has now removed from power for, among other things, apparent malfeasance in properly accounting for how they spent workers’ dues money.

Undeterred by that NLRB ruling, the workers filed a second decertification petition after the contract with the vague language expired, again with sufficient number of signatures of Sinai-Grace Hospital employees to trigger the vote. NLRB Region 07 is expected to set dates to begin a decertification vote in the very near future.

“These latest developments show why these workers should not have been blocked in their earlier attempt to have a vote to oust HCMI from their workplace,” commented National Right to Work Foundation President Mark Mix. “Union officials frequently look the other way when confronted with wrongdoing by others within the union hierarchy, so it is telling that even an SEIU International top boss says HCMI officials are unfit to run the local.”

“This situation demonstrates that it is time to end Big Labor’s government-granted power to impose its so-called ‘representation’ on workers who don’t want anything to do with a union,” continued Mix. “Rank-and-file workers should not have to navigate the NLRB’s labyrinth of rules for decertification elections just to escape an unwanted union, and individual workers should be allowed to decide for themselves whether to have a union represent them.”
