DC-Area Union Kitchen Employees Overwhelmingly Vote to Remove UFCW Union

Workers requested decertification vote amid contentious boycott and picket ordered by union officials against rank-and-file workers

Washington, DC (January 8, 2024) – Employees of five Union Kitchen locations in the Washington, DC, metro area have voted to remove United Food and Commercial Workers (UFCW) Local 400 union officials from power at the chain. The final vote tally was 24-1 in favor of ending UFCW Local 400’s monopoly bargaining power over the workers. Pending certification of the vote result by National Labor Relations Board (NLRB) Region 5 in Baltimore, the employees will be free of the union.

The effort to oust the UFCW union began in July 2023 when Union Kitchen employee Ashley Silva submitted a petition asking the NLRB to hold a union decertification vote among her coworkers, the vast majority of whom backed the petition. She received free legal aid from National Right to Work Foundation staff attorneys.

Because the District of Columbia lacks Right to Work protections for its private sector workers, UFCW union officials had the power to force Silva and her coworkers at the four DC Union Kitchen locations to pay union dues or fees as a condition of keeping their jobs. In contrast, in Right to Work jurisdictions like Virginia (home to one of the affected Union Kitchen locations), union membership and financial support are strictly voluntary. However, in both Right to Work and non-Right to Work jurisdictions, union officials can use their monopoly bargaining power to dictate the work conditions of all employees in a work unit, even those who voted against or otherwise oppose the union. A union decertification vote ends that union monopoly power.

Employees Voted to Remove Divisive Union Despite Union Attempts to Delay Vote Count

Silva and her coworkers’ effort began amid union boss-ordered pickets and boycotts against Union Kitchen Grocery locations, which inflamed tensions among workers. In some instances, union picketers endangered workers by blocking exits, requiring the intervention of police.

“The vast majority of the workers at Union Kitchen are sick and tired of the UFCW’s picketing, harassment of employees, and constant disruptions of our day-to-day work life,” Silva said at the time. “If the union cares at all about what we want, they will respect our wishes and immediately disclaim their interest in representing workers who have overwhelmingly rejected them.”

While Silva and her coworkers cast ballots in the union decertification election in October 2023, tension increased when UFCW union officials used “blocking charges” to stop the votes from being counted. “Blocking charges” are often unverified or unrelated charges of employer misconduct that union officials can manipulate to stall a ballot tally in a union decertification case.

However, as per NLRB rules, if the NLRB does not issue a complaint based on union officials’ allegations within 60 days of a decertification election, the ballots must be counted. NLRB Region 5 did not issue a complaint based on UFCW lawyers’ allegations within the 60-day window, thus allowing the ballot count to proceed.

However, despite the overwhelming 24-1 vote against the union, UFCW officials may still try to manipulate their charges to stop certification of the vote result. The union also challenged eight employee ballots (meaning that 32 workers total likely voted against further union presence), but the number of challenged ballots is not enough to alter the final result of the vote.

“We’re happy that Ms. Silva and her coworkers were finally able to exercise their right to vote out a union that actively worked against their interests,” commented National Right to Work Foundation President Mark Mix. “What’s concerning, however, is the fact that UFCW union officials could still prop up questionable allegations to stall the certification of an election that the very employees they claim to ‘represent’ asked for.”

“That, combined with the fact that UFCW officials’ combative tactics made life harder for Union Kitchen employees, again shows why all American employees deserve the freedom to abstain from funding a union they disapprove of,” Mix added.

“We call on union officials to withdraw their allegations and let the decision of the Union Kitchen workers stand,” Mix concluded.

DC-Area ‘Union Kitchen’ Employees Vote 24-1 to Remove UFCW Union

Foundation now defending workers against union attempt to overturn employee vote

Union Kitchen, a unique grocery concept that helps local DC entrepreneurs get their food products to market, was the target of a dangerous UFCW picket scheme.

WASHINGTON, DC – Ashley Silva, an employee at independent DC-area food store Union Kitchen, could sense in July 2023 that her coworkers had had enough of the United Food and Commercial Workers (UFCW) union in their workplace.

UFCW union officials had been ordering contentious boycotts and pickets on the stores, and some of the demonstrations even required police intervention after union picketers blocked store exits.

“The vast majority of the workers at Union Kitchen are sick and tired of the UFCW’s picketing, harassment of employees, and constant disruptions of our day-to-day work life,” Silva said at the time.

Despite Searing Worker Rejection, UFCW Bosses Trying to Cling to Power

With free legal aid from the National Right to Work Foundation, Silva filed a decertification petition with the National Labor Relations Board (NLRB), asking the federal agency to hold a vote among the employees of Union Kitchen’s five stores on whether the union should be ousted. The vast majority of her coworkers signed the petition.

UFCW union officials levied allegations against Union Kitchen management in an attempt to stop the vote from happening. Despite some delays, Silva and her coworkers cast ballots in October 2023, and a January 2024 vote count revealed that she and her colleagues had voted against the union 24-1.

The union challenged eight employee ballots, meaning the full tally of votes against the union is most likely 32-1.

Once the NLRB certifies this election result, Silva and her coworkers will be free of the union. However, in an attempt to stop this, UFCW officials continue to press the “blocking charges” against Union Kitchen management that they filed at the NLRB before the vote, and have also piled on objections to the election that contain the same basic accusations as the blocking charges.

Blocking charges are often unverified or unrelated charges of employer misconduct that union officials can manipulate to stall a ballot count or a certification of results in a union decertification case.

If the NLRB issues a complaint against an employer based on a union’s “blocking charges,” the decertification process is halted.

Foundation Will Fight UFCW Bid to Overturn Vote

Foundation staff attorneys are defending Silva and her colleagues’ victory at the ballot box from UFCW union officials’ bald-faced attempts to oppose their will.

“We’re happy that Ms. Silva and her coworkers were finally able to exercise their right to vote out a union they oppose,” commented National Right to Work Foundation Vice President Patrick Semmens. “It’s unfortunate, though hardly surprising, that despite such an overwhelming rejection UFCW union officials won’t take a hint and stop attempting to impose their unwanted so-called ‘representation’ on Union Kitchen employees.

“The Foundation is proud to defend Silva and her coworkers against these union tactics as they seek freedom from coercive unionism,” Semmens concluded.

Overwhelming Majority of Union Kitchen Workers File Petition Seeking to Remove UFCW Union

Request for end of union so-called ‘representation’ comes amid contentious boycott and picket ordered by union officials against rank-and-file workers

Washington, DC (July 14, 2023) – Employees of five Union Kitchen Grocery locations in the Washington, DC, metro area have filed a petition seeking to end United Food and Commercial Workers (UFCW) Local 400’s monopoly bargaining power over workers. The employees submitted their decertification petition to the National Labor Relations Board (NLRB) Region 5 with free legal aid from the National Right to Work Legal Defense Foundation.

Union Kitchen employee Ashley Silva submitted a union decertification petition that was supported by the vast majority of her coworkers. Under NLRB rules, this should trigger an NLRB-administered decertification vote. Under federal labor law, it is illegal for employers to engage in monopoly bargaining that impacts the employment terms of all employees, even those opposed to unionization, with a minority union that lacks the support of a bare majority of workers.

With the petition now filed, the NLRB should now promptly schedule a secret ballot election so the workers can formally vote to end union officials’ power to impose a contract, including forced dues, on the workers.

Because the District of Columbia lacks Right to Work protections for its private sector workers, UFCW union officials have the power to enter into an agreement with Union Kitchen forcing Silva and her coworkers at the four DC locations to pay union dues or fees as a condition of keeping their jobs. Union Kitchen Effort Latest in Wave of Union Decertification Efforts Nationwide

Foundation attorneys are currently assisting workers nationwide in a number of high-profile decertification efforts. Most notably, Starbucks employees at locations in Buffalo, New York City, Pittsburgh, and Bloomington, MN, are seeking to remove the Starbucks Workers United (SBWU) union only one year after the union launched a highly-publicized campaign in an attempt to unionize the coffee chain.

In Miami, Foundation attorneys also recently aided XPO Logistics freight drivers in removing an unwanted Teamsters union from their facility. Teamsters bosses, including James Hoffa, considered the Miami XPO contract a breakthrough. Now those workers have rejected the Teamsters.

The NLRB’s data shows a unionized private sector worker is now far more likely to be involved in a decertification effort as their nonunion counterpart is to be involved in a unionization campaign. NLRB statistics also show a 20% increase in decertification petitions last year versus 2021. However, union officials still have many ways to manipulate federal labor law to prevent workers from voting them out, including by filing unrelated or unverified charges against management.

“Disrupting a work environment with continuous pickets and boycotts is not what Union Kitchen Grocery employees want or need. The employees’ overwhelming support for a union decertification vote should send a strong message to UFCW union officials that they need to leave,” commented National Right to Work Foundation President Mark Mix. “Foundation attorneys will defend these employees in the exercise of their rights, and will oppose any attempts by UFCW officials to disenfranchise the Union Kitchen workers of their legal right to remove a union they so clearly want nothing to do with.”
