Aaron Solem will call for demise of coercive Biden-era policies

Washington, DC (June 11, 2025) – In a hearing today, veteran National Right to Work Foundation Staff Attorney Aaron Solem will testify before the U.S. House Committee on Education and the Workforce’s Subcommittee on Health, Employment, Labor, and Pensions. He will discuss the reforms needed to reverse the ways the National Labor Relations Board (NLRB), especially under the Biden Administration, rigged the rules to promote union boss power at the expense of the rights of independent-minded workers.

During a hearing titled “Restoring Balance: Ensuring Fairness and Transparency at the NLRB,” Solem will discuss how current NLRB rules allow union officials to corral and keep workers in union ranks without a vote, and let union officials force workers to subsidize union ideological activities. Solem, who has a thirteen-year career of defending workers from union coercion before the courts and administrative agencies like the NLRB, will be urging several reforms to protect workers’ individual rights.

Solem will appear as an expert witness at the hearing chaired by Georgia Congressman Rick Allen. Also appearing on the witness stand will be Jennifer Abruzzo, a former high-ranking lawyer for the Communications Workers of America (CWA) union and ex-General Counsel of the Biden NLRB, who during her time at the agency pushed to make it more difficult for workers to escape union control.

“These are anti-employee policies because they cancel worker choices and replace them with decisions made by unions and the government,” Solem’s written testimony reads. “President Trump won reelection because he was the candidate who listened to employees. The Board should follow in those footsteps by pursuing a truly pro-employee agenda. This agenda would put power in the hands of workers—not unions or employers—— to decide whether they want to be represented by a labor union.”

Biden-Era NLRB Policies Stripped Workers of Right to Exit & Defund Unwanted Unions

Solem’s written testimony breaks down several policies advanced by the Biden NLRB that strip workers of their right to vote themselves free of unwanted union influence. Among these are the “blocking charge” policy, which “allows unions to unilaterally block [union] decertification elections just by filing a charge against an employer, no matter how meritless it may be,” and the so-called “voluntary recognition bar,” which prevents workers from requesting an election to remove a union after union officials gain power through the unreliable “card check” method. Card check abandons the security of a secret-ballot union vote and instead relies on union authorization cards collected by union officials from workers – often through coercive tactics.

Solem also urges the NLRB to “follow Supreme Court precedent and require non-member employees to opt-in to paying for union political expenditures.” As it currently stands, employees who are not union members must “jump through several procedural hoops” to pay a reduced amount of union dues that excludes expenses for union political activities they may staunchly disagree with. The right to pay this reduced amount is enshrined in the Foundation-won CWA v. Beck Supreme Court decision, but current NLRB policies don’t sufficiently protect it.

Freedom vs. Coercion for Workers on Display

“At this hearing, House members will see two starkly differing visions for American workers,” commented National Right to Work Foundation President Mark Mix. “Aaron Solem will advocate for a future where workers can decide for themselves whether or not a union in their workplace is right for them, while Jennifer Abruzzo will double down on granting union officials sweeping coercive powers to impose their will on working people.

“American workers, who are affiliating with unions at near-record-low numbers and overwhelmingly support voluntary and not forced unionism, deserve to have an NLRB where their individual rights are protected and not ceded to union officials and their political cronies,” Mix added. “The incoming Trump NLRB should relegate the cynical, top-down, forced-unionism approach of Jennifer Abruzzo and the Biden NLRB to the dustbin of history, and empower workers by protecting their individual freedoms.”

Foundation Exposes Union Boss Coercion & Discrimination Before Congress

U.S. House relies on Foundation for insight on ‘card check’ and forced-dues-for-politics

“The Law Has Failed Me”: This was MIT Ph.D. student Will Sussman’s response when asked by Rep. Tim Walberg (R-MI) whether current federal labor law protects union dissenters. Sussman recommended nationwide Right to Work protections.

WASHINGTON, DC – Within the past few months, National Right to Work Foundation attorneys and recipients of free Foundation legal aid have appeared multiple times before the U.S. House Committee on Education and the Workforce, revealing the anti-freedom tactics union bosses use to sweep workers under their power and prop up their radical political agenda.

In May, U.S. House members called Foundation Vice President and Legal Director William Messenger as an expert witness in a hearing named “Big Labor Lies: Exposing Union Tactics to undermine Free and Fair Elections.” The hearing was designed to probe how current federal labor policies are letting union bosses deprive American workers of even the basic protection of a secret ballot election when union organizers target their workplace for monopoly unionization.

In July, Massachusetts Institute of Technology (MIT) Ph.D. student Will Sussman, who received free Foundation legal aid in filing federal anti-discrimination charges against union bosses on his campus, appeared before the U.S. House to recount his battle against MIT Graduate Student Union (GSUUE) officials. GSU union bosses demanded Sussman, who is Jewish, fund union activities despite his repeated and forceful objections to the union’s anti-Israel pursuits.

The July hearing, called “Confronting Union Antisemitism: Protecting Workers from Big Labor Abuses,” also featured testimony from veteran Foundation staff attorney Glenn Taubman, who is providing free legal representation to Sussman and other MIT graduate students challenging forced-dues demands from GSU.

“Whether it’s union officials seizing power in a workplace without giving employees a chance to vote, or using graduate students’ money to fuel radical protests and other unrest on college campuses, these outrageous activities all have one thing in common — union boss privileges heavily ingrained in federal labor law,” commented National Right to Work Foundation Vice President Patrick Semmens. “No organization in the country has been more active than the Foundation in countering these coercive practices on behalf of rank-and-file workers.

“As the Biden Administration ramps up its attacks on worker freedom, we are honored and gratified that U.S. representatives look to Foundation attorneys and Foundation-backed workers for perspectives on how to defend worker freedom.”

Foundation Legal Director: ‘Card Check’ Permits Union Boss Tyranny

At its hearing in May, the U.S. House Committee on Education and the Workforce listened to William Messenger testify regarding union bosses’ two favorite tactics for gaining power: “card check” drives and censorship of speech critical of the union.

Card check is a process that lets union bosses gain power in a workplace without giving employees a chance to vote in secret on whether they want a union. Union officials can gang up on workers and even harass them to obtain signatures on union authorization cards, which are later counted as “votes” for the union. This process opens workers to intimidation and threats, something not found with secret balloting.

Union Censorship Exposed by Foundation

As if that weren’t bad enough, Messenger testified how the Biden-Harris NLRB “operates the most repressive regime of government censorship in the nation” by censoring employees’ ability to hear basic truthful information from employers that union officials don’t want workers to hear.

“Just imagine if the ruling party of a third-world nation decided to use such a process instead of having secret-ballot elections for political office,” Messenger testified. “Instead of having elections, the ruling party would go around to people’s homes and workplaces and collect ‘votes’ for the party. Instead of free speech, only the ruling party would be allowed to campaign.

“I submit this process is nothing like a democratic process,” Messenger declared. “Yet the Biden NLRB is . . . mandating card check with its Cemex decision, under which it’s now an unfair labor practice . . . for an employer to refuse to recognize a union based on cards.”

At the July hearing, Will Sussman detailed the harrowing story of how GSU union bosses continued demanding dues payments from him and other Jewish MIT graduate students even after they had informed the union of their religious objections and requested religious accommodations due to their beliefs. Title VII of the Civil Rights Act of 1964 requires union officials to accommodate those that have religious objections to subsidizing union activities; in practice this usually entails letting the employee pay an amount equivalent to dues to a charity.

But Sussman explained that the union blew off this legal duty, and legal action by the Foundation’s attorneys was needed: “The union denied my request, telling me in a letter that ‘no principles, teachings or tenets of Judaism prohibit membership in or the payment of dues or fees to a labor union’ . . . In other words, UE thinks it understands my faith better than I do.

“This Congress should pass the National Right to Work Act, so that unions have to earn their dues and think twice before discriminating against minorities,” Sussman added.

Foundation-Aided Employees Tell Congress: All Workers Need Right to Work

Workers’ real-life battles against union bosses emphasize need to end forced union dues

WASHINGTON, DC – In November, two recipients of National Right to Work Foundation free legal representation went to Capitol Hill to testify before the U.S. House Committee on Education and the Workforce about their battles against union bosses.

This was the first-ever congressional hearing on the National Right to Work Act, legislation that will safeguard American private sector workers’ freedom to refrain from paying dues to an unwanted union.

Jeanette Geary, a retired nurse, and Brunilda Vargas, a Philadelphia-based public defender, both successfully challenged illegal forced-dues demands with Foundation aid. Their testimony at the hearing, alongside Foundation President Mark Mix, gave policymakers stark examples of how union officials often manipulate their forced-dues powers to advance coercive agendas over the objections of workers.

Vargas, Geary Share Stories of Union Coercion

The current federal law governing most private sector workers in America — the National Labor Relations Act (NLRA) — grants union bosses the power to force workers to pay union dues just to keep their jobs. Only by passing Right to Work laws can states protect workers covered by the NLRA from forced dues.

Meanwhile, airline and railroad employees covered by the Railway Labor Act (RLA) can be required to pay union dues no matter where they work because federal law prevents them from being covered by state Right to Work laws. The one-page National Right to Work Act discussed in the hearing would repeal the portions of both the RLA and NLRA that authorize union officials to require union payments as a condition of employment.

“We’re proud and thankful that Ms. Geary and Ms. Vargas both agreed to testify before Congress on the struggles independent-minded workers face every day because of federal law’s lack of protection for worker freedom,” Mix commented. “Union bosses and their allied politicians don’t want to hear it, but the truth is rank-and-file workers are the victims of Big Labor’s government-granted coercive powers, which makes the stories of those victims especially powerful.”

Geary discussed her struggle against United Nurses and Allied Professionals (UNAP) union bosses, who subjected her and her fellow nurses in Rhode Island to an illegal scheme in which they were compelled to pay for union political expenditures, including lobbying in state legislatures. Geary fought UNAP union officials over the illegal dues demands for 12 years with free legal representation from Foundation staff attorneys. She finally prevailed in 2021, when the First Circuit Court of Appeals unanimously ruled in her favor and rejected a union appeal.

Vargas and Geary: Unions Purposely Hide Rights from Employees

“Unions do not tell employees about their rights because union officials have no incentive to do so, and regular employees without lawyers . . . are left to fend for themselves,” Geary testified before the House Committee. “This is America, and membership in a union and payment of dues should be strictly voluntary.”

Vargas testified about her case against United Auto Workers (UAW) union officials, who threatened to dock the salary of her and any other public defender in her office who refused to let the union seize money directly from their paychecks. Under federal law, even in forced-dues states, union officials must obtain express consent from workers before taking dues money by direct deduction. With Foundation legal aid, Vargas secured a favorable finding from the National Labor Relations Board (NLRB) that initiated a formal prosecution against the union. Eventually, UAW union bosses were forced to settle the matter and end their illegal conduct.

“As attorneys, we do have a level of sophistication when it comes to the law and legal processes. However, I cannot imagine a lay person having to face this type of pressure. I believe that most people sign union membership and authorization cards because they believe they have no choice, and they are often told that,” Vargas testified.
