Penske Leasing Workers Free Themselves from Teamsters’ ‘Representation’

Dallas area workers increasingly demanding individual freedom from unions

Dallas, TX (December 22, 2025) – Employees of Penske Truck Leasing’s facility in the Redbird neighborhood of Dallas have freed themselves from the control of Teamsters Local 745 union officials. A majority of workers, with assistance from National Right to Work Foundation staff attorneys, filed a petition requesting decertification of the local union with the National Labor Relations Board (NLRB) on November 14, 2025.

The NLRB is the federal agency responsible for enforcing federal labor law, a task that includes administering votes to install (or “certify”) and remove (or “decertify”) unions in workplaces. By law, the NLRB should administer a decertification election if employees submit a petition in which at least 30% of workers demand such an election (this petition far exceeded that threshold).

The decertification election was scheduled for December 18, but on the day of the election, union officials formally disclaimed interest in continuing as the workers’ “representative,” removing the need for an election. Teamsters bosses presumably knew they would have lost the vote overwhelmingly, and preemptively conceded defeat.

Texas Employees Free from Union’s Twin Coercive Powers

Texas is a Right to Work state, meaning that Teamsters union officials cannot enforce union contracts that require workers to pay union dues or fees to keep their jobs. In non-Right to Work states, union bosses can have workers fired solely for refusing to financially support union officials’ activities.

However, in both Right to Work and non-Right to Work states, union officials can wield exclusive “representation” power over every employee in a workplace, unless the union is decertified. The workers at Penske’s Redbird facility are now free of both of these powers granted to union bosses by the government.

“I support decertifying the Teamsters union because the union isn’t benefiting us the way it should,” commented Penske employee Epifanio Hernandez in early December, shortly after his petition for decertification was filed. “The union rules aren’t beneficial to everyone, and instead of helping us progress, they end up holding many of us back. We deserve the freedom to exercise our own rights, speak for ourselves, and make decisions that reflect what we actually want — not what the union decides for us.”

Teamsters Union Continues Streak of Decertification

In just the last year, Foundation staff attorneys have helped several groups of employees free themselves from unwanted union “representation” by the Teamsters. These include two other cases in Dallas, where both delivery drivers for Restaurant Technologies, Inc. and employees at FCC Environmental Services recently booted Teamsters Local 745 bosses from their workplaces, the same union as in this case.

Foundation staff attorneys have also noticed a marked rise in requests from workers seeking legal assistance in Teamsters decertification cases. Recent NLRB statistics also suggest no union faces more decertification petitions than the Teamsters.

“More and more, American workers across the country are deciding they are better off without Teamsters union bosses who prioritize their own interests over that of the workers they claim to ‘represent,’” commented National Right to Work Foundation President Mark Mix. “We’re proud to support the growing number of workers engaged in the transportation and trucking industries who are demanding freedom from coercive unionism.”

Majority of Dallas Penske Leasing Workers Request Vote to Remove Teamsters Local 745

In last year, several groups of Penske employees across the country have sought to escape coercive union control

Dallas, TX (December 2, 2025) – A majority of employees at Penske Truck Leasing’s facility in the Redbird neighborhood of Dallas are demanding a vote to remove Teamsters Local 745 union officials from power at their workplace. Penske employee Epifanio Hernandez submitted a union “decertification petition” backed by his colleagues to the National Labor Relations Board (NLRB) with free legal aid from National Right to Work Legal Defense Foundation staff attorneys.

The NLRB is the federal agency responsible for enforcing federal labor law, a task that includes administering votes to install (or “certify”) and remove (or “decertify”) unions in workplaces. By law, the NLRB should administer a decertification election if an employee submits a petition in which at least 30% of his coworkers demand such an election. Hernandez’s decertification petition contained signatures from a majority of his coworkers, well exceeding that threshold.

Texas Penske Workers Join Wider Opposition to Teamsters Officials & Other Union Bosses

In just the last year, Foundation staff attorneys have helped several groups of Penske employees around the country break free from unwanted union control. These have included Penske workers in Minneapolis and Nashville, who last year overwhelmingly voted to oust International Association of Machinists (IAM) union bosses. In December 2024, Philadelphia-area Penske Logistics workers also voted to remove Teamsters Local 500 union officials.

Teamsters union officials’ workplace actions and political activity have also come under increased worker scrutiny recently. During the 2024 election cycle, the union’s upper echelon chose not to endorse Donald Trump because he would not commit to eliminating Right to Work and granting forced-dues power to union bosses nationwide. Teamsters top officials’ prioritizing of their forced-dues powers comes despite polls showing nearly 80% of American union members support Right to Work and voluntary union dues.

Foundation staff attorneys have also noticed a marked rise in requests from workers seeking legal assistance in Teamsters decertification cases. Recent NLRB statistics also suggest no union faces more decertification petitions than the Teamsters.

Penske Truck Rental Employees in Minneapolis and Nashville Overwhelmingly Vote to Remove Machinists Union

Majority of workers in both work units have prevailed in effort to free themselves of unwanted IAM union bosses’ so-called ‘representation’

MINNEAPOLIS, MN & NASHVILLE, TN – Majorities of Penske Truck Rental employees at locations in Minnesota and Tennessee have voted to remove the International Association of Machinists (IAM) union from their respective workplaces. The decertification petitions were filed by workers with free legal aid from the National Right to Work Legal Defense Foundation in April with the National Labor Relations Board (NLRB), asking the agency to hold votes to formally remove IAM union officials’ monopoly bargaining power.

On May 1 in Minneapolis, Minnesota workers voted 26 to 7 to remove IAM District Lodge No. 77 union officials. The NLRB-supervised decertification election took place after Penske employee Kyle Fulkerson submitted a petition on April 4, 2024 signed by a majority of his coworkers asking the NLRB to hold a vote to remove the union from the facility.

“This lopsided vote is a testament to the fact that after having seen the IAM up close and personal in our workplace, my colleagues and I are confident that we are better off without union officials so-called ‘representation,” said Fulkerson about the outcome, which became final on May 8 after a one-week objection period passed with no union challenge to the outcome being filed.

Meanwhile in Tennessee, Penske employee David Saylor filed his decertification petition on April 11 backed by a majority of the employees at the downtown Nashville Penske location. On May 8, they voted 15 to 8 to oust IAM District Lodge No. 735. Today, on Thursday, May 16, 2024, the vote became finalized absent a last ditch attempt by union officials to overturn the workers’ vote.

The Minneapolis and Nashville-based workers are not the only Penske employees to remove unwanted union so-called “representation” with legal aid from the National Right to Work Foundation. In 2022, every worker but one as a Penske facility in Indiana signed a petition seeking to decertify the Teamsters union officials at that location. Before an NLRB-supervised decertification election was scheduled, Teamsters officials issued a statement, disclaiming representation in an apparent attempt to spare themselves the embarrassment of an overwhelming vote by workers to reject the union’s so-called “representation.”.

“Workers across the country are increasingly exercising their rights to remove unwanted unions, with more decertification elections held last year than in any year since 2017,” said National Right to Work Foundation President Mark Mix. “No worker anywhere should be forced under the so-called ‘representation’ of a union they oppose, and Foundation staff attorneys stand ready to assist workers wanting to hold a decertification election to oust a union they oppose and believe they would be better off without.”

Penske Truck Rental Employees in Minneapolis and Nashville Seeking Votes to Remove IAM Union Officials

Majorities of workers in both work units want federal Labor Board to administer union decertification vote

Washington, DC (April 17, 2024) – Employees of Penske Truck Rental have submitted petitions seeking votes to remove International Association of Machinists (IAM) union officials from power at Penske locations in the Minneapolis, MN, metro area, and in Nashville, TN. Penske employees Kyle Fulkerson and David Saylor filed the petitions at the National Labor Relations Board (NLRB) with free legal aid from the National Right to Work Legal Defense Foundation.

The NLRB is the federal agency responsible for enforcing federal labor law, which includes administering elections to install (or “certify”) and remove (or “decertify”) unions. Fulkerson, acting on behalf of the Minnesota employees, and Saylor, acting on behalf of the Tennessee employees, both filed petitions containing signatures from a majority of their coworkers, clearly exceeding the 30% support threshold needed to trigger a decertification vote under NLRB rules.

Because Minnesota lacks Right to Work protections for its private sector workers, IAM union officials have maintained contracts with Penske management that require Fulkerson and his coworkers to pay union dues or fees as a condition of keeping their jobs. As for Saylor and his coworkers in Right to Work Tennessee, IAM union officials are forbidden from enforcing a contract that mandates union membership and dues payments.

In both Right to Work and non-Right to Work states, union officials in a unionized workplace are empowered by federal law to impose a union contract on all employees in the work unit, including those who oppose the union. A successful decertification vote strips union officials of both their forced-dues and monopoly bargaining powers.

Workers in Transportation and Other Industries Increasingly Seek Exit from Unions

Across the country, workers are choosing to affiliate with unions in record-low numbers, according to the most recent Gallup poll on the subject. Workers are also increasingly attempting to exercise their right to vote out union officials they disapprove of. According to NLRB data, since 2020 decertification petition filings have gone up by over 40%. To resist this trend, the Biden NLRB is attempting to make it substantially more difficult for workers to decertify unions, and could soon issue a final rule invalidating the Election Protection Rule. The Election Protection Rule is a policy that contains multiple important safeguards regarding employees’ right to decertify unions they oppose.

In the transportation industry specifically, Foundation staff attorneys have recently assisted drivers and warehouse workers in a number of high-profile union removal efforts. Earlier this month, Foundation attorneys assisted Dependable Highway Express employees in Southern California remove Teamsters union officials who had threatened a worker for revealing info on union boss salaries, and in January they aided Keurig Dr. Pepper distribution workers from three locations across Wisconsin in ousting another Teamsters local.

“Transportation and trucking employees across the country are realizing that monopoly union control is frequently harmful. While workers’ right to vote out union bosses they oppose is vital in every state, it’s especially important in forced-dues states like Minnesota, where union bosses can force workers to pay for ‘representation’ they don’t agree with,” commented National Right to Work Foundation President Mark Mix. “It’s outrageous this current Administration is intent on paring back this right just to give union officials more tools to expand their coffers and their coercive influence over workers.”
