National Right to Work Foundation Opposes NLRB Push to Mandate Abusive ‘Card Check’ Unionization Process

Amicus brief in Starbucks case says NLRB General Counsel’s plan will expose workers to coercive union tactics and contradicts SCOTUS precedent

Washington, DC (March 16, 2023) – The National Right to Work Legal Defense Foundation has just submitted an amicus brief at the National Labor Relations Board (NLRB) in a case involving SEIU union organizers’ attempt to impose unionization on workers at Starbucks without a secret ballot vote. The Foundation’s brief, attached to the motion, defends workers at Starbucks and workplaces nationwide from Biden-appointed NLRB General Counsel Jennifer Abruzzo’s attempt to effectively mandate coercive “card check” organizing campaigns.

In card check campaigns, professional union organizers can pressure workers into signing cards that are then used at “votes” for unionization in lieu of an NLRB-supervised secret ballot vote.

In the ongoing Starbucks case, former union lawyer Abruzzo is attempting to resurrect the long-discredited Joy Silk NLRB theory, which would force union monopoly control on workers who have not had an opportunity to vote in secret on whether they want a union in the workplace. SEIU officials attempted to impose union control on Starbucks baristas using the so-called “card check” process, in which union agents can bypass the traditional secret ballot method of gaining power in a workplace and can obtain union “authorization cards” directly from workers – often using coercive or misleading tactics.

Card check schemes are recognized by court and NLRB precedents and even AFL-CIO organizing handbooks as inaccurate gauges of true employee support for union control. Despite this, the Joy Silk theory that NLRB General Counsel Abruzzo seeks to revive forbids employers from challenging the results of a card check unionization.

Employers can contest the results of a card check by asking the NLRB to conduct a secret ballot union vote among the employees. Conversely, under Joy Silk, the NLRB has the power to force both workers and employers under union control if an employer objects to the results of a card check.

“Now, the General Counsel seeks to upend five decades of settled law to resurrect Joy Silk,” says the amicus brief. “She seeks a regime of instant unionization through compulsory bargaining orders issued to any employer that refuses to recognize a union based on authorization cards, even though such cards were most assuredly not collected through ‘laboratory conditions.’”

Joy Silk Prioritizes Union Power Over Employees’ Will and Conflicts with Court Precedent

 

The Foundation’s brief argues that card check unionization drives are “notoriously unreliable” for determining whether a majority of employees in a workplace want a union. Because card check schemes lack NLRB oversight and do not permit employees to vote in private, the brief argues, the door is open for union agents to deploy many kinds of pressure tactics, including soliciting ballots, electioneering, keeping lists of employees who have or have not signed cards, and more.

As opposed to employees in a secret ballot election who vote quickly and privately, “[t]his is not true for an employee caught in the maw of a year-long card check campaign, who may be solicited repeatedly and, perhaps coercively, month after month until he or she signs,” the brief says. If General Counsel Abruzzo brings back Joy Silk, that would allow union bosses to “bypass secret ballot elections at will and secure a compulsory bargaining order virtually anytime they are able to collect a bare majority of authorization cards.”

The amicus brief also maintains that the Joy Silk standard is at odds with a large number of court precedents, including from the D.C. Circuit Court (where many NLRB decisions are appealed), other circuit courts, and the U.S. Supreme Court twice. All of these courts have declared at one time or another that “authorization cards are inferior to secret ballot elections,” the brief says.

General Counsel Abruzzo Seeks to Compel Workers into Union Ranks Despite More Than 90% of American Workers Rejecting Unionization

“NLRB General Counsel Abruzzo – a former CWA union official – continues to show her extremist views when it comes to overturning precedent in the pursuit of greater coercive powers for her former colleagues in Big Labor’s upper echelon,” commented National Right to Work Foundation President Mark Mix. “Inevitably, this comes at the expense of the rights of independent-minded American workers, who want the right to choose whether or not they wish to associate with a union, free from the well-documented coercive tactics union organizers deploy during card check drives.”

“Big Labor advocates previously at least understood that a sweeping change to federal labor law, like eliminating secret ballot elections to mandate ‘card check,’ would at least require an act of Congress,” Mix added. “But with the Card Check Forced Unionism Bill dying in 2010 due to bipartisan opposition, and the so-called ‘PRO-Act’ blocked in the last and current Congress, the Biden Administration is apparently moving forward to radically rewrite federal labor law by bureaucratic fiat.”

Request for Review: In vote to remove union, NLRB Regional Director ordered employee ballots destroyed and never counted

Los Angeles, CA (December 19, 2022) – With free legal aid from the National Right to Work Legal Defense Foundation, Spanish Broadcasting System radio host Adal Loreto is defending his and his coworkers’ right to vote unwanted Stage Actors’ Guild (SAG-AFTRA) union officials out of their workplace. In July, Loreto filed a petition for a group of his coworkers seeking a vote to end union officials’ so-called “representation” over on-air talent of KLAX­FM and KXOL-FM radio stations.

That National Labor Relations Board (NLRB) decertification petition resulted in a mail ballot election conducted in August and September. However, the workers’ ballots were never actually counted. Now, Loreto and his National Right to Work Foundation staff attorneys have filed a Request for Review at the National Labor Relations Board in Washington, DC, asking the Board to overturn NLRB Region 31 Director Mori Rubin’s order that the workers’ ballots be destroyed and never counted.

Loreto’s appeal says that regional NLRB officials are illegally refusing to count votes that he and his colleagues have already cast in their decertification election to decide whether SAG-AFTRA officials should be booted from the workplace. According to Loreto’s Request for Review, regional NLRB officials not only improperly relied on unverified charges (also called “blocking charges”) from SAG-AFTRA union officials to block the vote, but ignored the NLRB’s own election rules and polices.

NLRB Rules and Regulations state that, if NLRB regional officials do not issue a complaint related to a union decertification election within 60 days of the election, the votes “shall be promptly opened and counted.” Because no timely complaint was issued and NLRB Region 31 nevertheless ordered the ballots tossed, Loreto’s Request for Review argues that the regional officials are clearly disobeying NLRB Rules and Regulations in violation of the Administrative Procedure Act (APA), and are violating the workers’ rights under the National Labor Relations Act (NLRA).

SBS Radio Host Fights Unpopular Union’s Scheme to Stay in Power

In July 2022, Loreto submitted a valid employee-backed petition to the NLRB, asking the agency to hold a vote in his workplace on whether to remove, or “decertify,” the SAG-AFTRA union. The NLRB is the agency responsible for enforcing federal private-sector labor law and will normally conduct a “decertification vote” among workers when the required number express support, by petition, to remove the union from their workplace.

Loreto and his coworkers began voting in the decertification election on August 26, and the scheduled date for the ballot count was September 20. However, in response to SAG-AFTRA union officials’ “blocking charges,” NLRB Region 31 impounded the ballots for 60 days while it investigated the union charges.

National Right to Work Foundation-backed reforms adopted in rulemaking by the NLRB in 2020 eased the process by which employees can free themselves of an unpopular union. Under the reforms, union officials in most cases can no longer unilaterally derail an employee-requested decertification vote simply by filing “blocking charges,” which often contain unrelated and unverified allegations of employer misconduct.

In most cases, employees can still exercise their right to vote, though in some limited cases NLRB officials can impound ballots for up to 60 days while dealing with “blocking charges.” After that period, however, the vote counting must commence absent the filing of a formal complaint by the NLRB Regional Director based on the union-instigated “blocking charges.”

Loreto’s Request for Review notes that, instead of counting the votes as mandated by NLRB rules, NLRB Region 31 instead continued impounding the ballots past 60 days and later dismissed Loreto and his coworkers’ petition. This order effectively ends the workers’ effort to oust the unpopular union and would destroy the workers’ ballots without them ever being counted, despite no complaint being issued at the time when Regional Director Rubin ordered the workers be disenfranchised.

Loreto’s petition now asks the NLRB in Washington to reverse the NLRB Regional Director’s ruling and to immediately order the counting of ballots in the election as mandated by the NLRB’s own rules.

Foundation Fights Union Boss Moves to Scale Back Worker Free Choice Rights

Foundation staff attorneys aid workers across the country in exercising their right to vote out union officials who don’t serve their interests. Foundation attorneys have recently guided workers in California, Pennsylvania, New Jersey, and many other states in navigating the NLRB decertification process. Foundation attorneys will also oppose the Biden NLRB’s recently-announced plan to reverse the 2020 Foundation-backed reforms to the NLRB’s election rules, an action which would make exercising decertification rights significantly harder for countless workers across the country.

“Mr. Loreto’s situation illustrates perfectly how the NLRB, an agency that is supposed to neutrally enforce federal labor law, puts its thumb on the scale to assist union boss schemes to retain power over the wishes of rank-and-file workers,” commented National Right to Work Foundation President Mark Mix. “This situation is even more egregious as the NLRB is disobeying its own rules and regulations to disenfranchise workers who simply want their votes to remove SAG-AFTRA from their workplace counted.”

“Workers should not have to endure months of litigation simply to exercise their right to oust a union they no longer want, and Foundation attorneys will fight with Mr. Loreto to right this injustice,” Mix added.

Western Louisiana Chemical Workers Vote Out Unpopular Steelworkers Union Bosses

Several more efforts by employees are ongoing across the country to vote out union officials

DeRidder, LA (October 31, 2022) – GEO Specialty Chemicals employee Ryne Fox and his coworkers have just voted unwanted United Steelworkers (USW) Local 13-725 union bosses out of power at their workplace. The vote, in which 75% of the work unit voted to remove the union, came after Fox filed a petition for a “decertification vote” with free legal assistance from National Right to Work Legal Defense Foundation staff attorneys.

Fox filed the “decertification petition” on September 24, 2022, asking the National Labor Relations Board (NLRB) to hold a vote among employees on whether the union should be removed. Because of a union boss-friendly NLRB policy known as the so-called “contract bar,” Fox timed the filing of the petition to coincide with the expiration of USW officials’ contract with GEO management. The non-statutory “contract bar” arbitrarily immunizes union officials from being voted out of a workplace during the life of a union contract, typically lasting one to three years.

Though many non-statutory NLRB policies like the “contract bar” still exist which prevent workers from voting out union bosses they oppose, Foundation-supported reforms adopted by the NLRB in 2020 have made the decertification process easier. The reforms pared back union officials’ ability to block decertification votes by filing so-called “blocking charges,” which often contain unrelated and unverified accusations of employer wrongdoing. Now, employees usually have a chance to at least cast ballots before any allegations surrounding the election are resolved.

Foundation Also Aiding Pennsylvania Employees in Ousting Corrupt, Unaccountable Steelworkers Officials

Fox and his coworkers’ endeavor is the third Foundation-assisted employee effort to vote out USW union officials in just the past couple months. Just last week, New Jersey building materials employee Michael Cobourn and his coworkers at Gold Bond Building Products in Burlington, NJ, voted out USW bosses by a nearly 70-30 margin. In Pennsylvania, Foundation attorneys are currently helping Carpenter Technologies/Latrobe Specialty Steel employee Kerry Hunsberger and her coworkers in their bid to decertify USW officials who blatantly ignored two votes by workers rejecting contracts union officials had negotiated.

In the situation at Hunsberger’s workplace, USW officials sought to trigger the “contract bar” and avoid an attempt by employees to vote the union out by secretly “ratifying” a contract that workers had voted against. USW bosses even held a second contract vote after the unpopular contract took effect. Union officials misled the workers, who unsurprisingly voted the contract down again, to believe their second vote would count, even though it was meaningless because the contract had already been “ratified.”

“Workers across the country are increasingly exercising their right to vote out union officials they oppose, and we at the Foundation are happy to aid workers in defending this essential element of free association,” commented National Right to Work Foundation President Mark Mix. “However, we’re also acutely aware of the obstacles that stand in the way of this freedom, and one of those, which Steelworkers officials seem to have no reservations about exploiting, is the ‘contract bar.’”

“The unjustified ‘contract bar’ is always wrong because it prevents workers from voting out unions they oppose when they want to. But even worse, this NLRB-invented doctrine actually incentivizes union officials to rush ahead and impose unpopular, self-serving contracts for the very purpose of insulating the union’s forced representation powers from a vote of the workers they claim to ‘represent,’” Mix added.

Maine Medical Center Nurses Secure Vote to Remove Unwanted Maine State Nurses Association Union Officials’ ‘Representation’

More than 500 workers petitioned for union “decertification election” seeking a vote as soon as allowed following imposition of unwanted union

Portland, ME (July 21, 2022) – Maine Medical Center nurses will soon vote in an election that could send Maine State Nurses Association (MSNA-NNU, an affiliate of National Nurses United) union officials packing from the hospital. This follows Nurse Davin Brooks’ submission of a petition containing signatures of more than 500 of his colleagues.

Brooks and his fellow nurses are receiving free legal assistance from the National Right to Work Legal Defense Foundation. The petition comes as Foundation staff attorneys are increasingly assisting healthcare workers in obtaining votes to remove unwanted unions, including in Michigan, Minnesota, New York, and Massachusetts.

The NLRB is the federal agency responsible for enforcing federal private-sector labor law, a duty which includes conducting votes to both certify and decertify unions. Foundation staff attorneys recommended reforms the NLRB adopted in 2020 that significantly eased processes by which workers can request a vote to remove an unwanted union. Those reforms included limiting union officials’ ability to manipulate often-unverified allegations of employer wrongdoing to stop an employee-requested union decertification vote.

Union Installed Through Dubious Mail-Ballot Process, Employees Soon Wanted Ouster

MSNA union officials were originally installed at Maine Medical Center in Portland in May 2021, after the NLRB conducted a mail-ballot union certification vote among the hospital employees. Mail-ballot NLRB elections, which before COVID were very rare and only held where in-person votes were not feasible, have lower turnout rates than standard in-person elections. Studies show mail-ballot elections benefit union organizers in part due to that lower turnout. Conducting such votes through the mail also has resulted in post office errors that disenfranchise workers, and ballot harvesting by union organizers that undermines the privacy of workers’ votes.

Since the union was installed last year, MSNA union officials and Maine Medical Center management have been unable to finalize a contract. Brooks filed the decertification petition signed by his coworkers in June, the soonest allowed by the NLRB’s “election bar” which prevents more than one such election within a year. The election is scheduled for August 17 and 18, and will be held in person at multiple Maine Medical Center locations.

“Maine Medical Center employees are more than reasonable in their desire to oust MSNA union officials, who came to power at the facility through a questionable mail-ballot vote and have failed to produce a contract in over a year,” commented National Right to Work Foundation President Mark Mix. “No healthcare worker should be subject to the monopoly control of a union that they don’t believe serves their interests. We are proud to aid Mr. Brooks and his coworkers in exercising their right to free themselves of union officials that clearly made promises to nurses on which the union could not actually deliver.”
