WV Homecare Worker Asks Federal Labor Board to Stop Gambit by SEIU and Employer to Destroy Ballots in Vote to Remove Union

Employee attacks NLRB policy that union and employer used to “agree” to throw out ballots already cast and block future votes to remove union

Welch, WV (March 21, 2025) – An employee of senior homecare nonprofit McDowell County Commission on Aging has requested the National Labor Relations Board (NLRB) in Washington, D.C., overturn a regional NLRB official’s ruling that tossed his and his coworkers’ ballots in a union decertification vote because his employer and Service Employees International Union (SEIU) officials agreed in a settlement to stifle the worker-led union removal effort.

The worker, John Reeves, submitted his Request for Review with free legal aid from National Right to Work Legal Defense Foundation staff attorneys. In addition to asking the NLRB to order regional labor board officials to process Reeves’ petition for a union removal vote at his workplace, the Request for Review attacks regional NLRB officials’ application of the so-called “settlement bar” to his petition. The “settlement bar” is a non-statutory NLRB policy that lets union bosses and employers unilaterally block an employee-requested union decertification vote after finalizing a settlement.

Specifically, the Request for Review points out that the issues being settled by the union and employer – union-alleged accusations of employer wrongdoing that were never proven by the Board or admitted to by the employer in the settlement – provide absolutely no support for the idea that Reeves and his coworkers’ vote should be invalidated. The Request for Review states:

“[T]he Board has held that employer unfair labor practices can justify the dismissal of a decertification petition only if: (1) the Board holds the employer actually committed the unfair labor practices or (2) the employer admits in a settlement that it committed the unfair labor practices…Neither scenario exists here.”

Employer and SEIU Union Bosses Colluded to Eliminate Workers’ Shot at Voting Out Union

Reeves’ effort to remove the SEIU union began in June 2024, when he filed a petition asking the NLRB to administer a union decertification election at the McDowell County Commission on Aging. The petition had enough employee signatures under NLRB rules to trigger such a vote.

Commission management and union officials agreed to terms of a union decertification election and Reeves and his coworkers voted on July 9, 2024. However, regional NLRB officials announced the morning that the election took place that Reeves and his coworkers’ ballots would be impounded because of pending unfair labor practice allegations SEIU union officials had against Commission management

After continued delays from NLRB officials that prevented the ballots from being counted, Reeves sought to intervene in the union’s unfair labor practice case. Reeves wanted to demonstrate that there was no connection between the union’s accusations of employer wrongdoing and his and his colleagues’ desire to vote the union out, and thus no reason existed for regional NLRB officials to continue blocking a vote count. But the regional NLRB denied him this request.

In January 2025 – six months after Reeves and his colleagues had voted – Commission officials and SEIU union bosses entered into an agreement to settle the union’s unfair labor practice charges. Even though the regional NLRB never proved that the employer’s alleged malfeasance had any effect on the decertification effort and the Commission never admitted to such malfeasance in the settlement, the regional NLRB approved a unilateral decision by the employer and union to dismiss the decertification petition and “not entertain a new decertification for a…period of four months.”

“[The regional NLRB] dismissed Reeves’ decertification petition because the Employer settled an unfair labor practice case, even though the settlement contained no ‘admissions clause,’ and therefore the Union’s allegations were unproven and speculative,” Reeves’ Request for Review reads.

“Mr. Reeves and his coworkers, who voted months ago on whether to remove SEIU union officials from their workplace, deserve to have their voices heard and their votes counted,” commented National Right to Work Foundation President Mark Mix. “The NLRB’s ‘settlement bar’ policy is simply another way for self-interested union bosses to game the system and maintain control over dissenting workers, and it’s especially egregious when complicit employers and NLRB officials use it to turn speculative and unproven allegations of wrongdoing into a barrier between workers and their individual rights.”

“Workers have a statutory right under federal law to hold decertification votes, and employers and union officials should not be permitted to collusively ‘settle’ disputes by stripping workers of their right to vote to remove a union that most of them oppose,” added Mix.

College Park MOM’s Organic Employees Demand Vote to Remove UFCW Local 400 Union Officials

Earlier this year DC-area Union Kitchen workers voted 24-1 to remove Local 400, but union lawyers continue fighting to block certification & overturn result

Washington, DC (November 7, 2024) – Employees from MOM’s Organic Market’s College Park, MD, location are petitioning a federal labor board for an election to remove United Food and Commercial Workers (UFCW) Local 400 union officials from power at the store. MOM’s employee Maria Sanya Dobbins, who is leading the effort, submitted the petition to the National Labor Relations Board (NLRB) at the beginning of the month with free legal assistance from National Right to Work Legal Defense Foundation staff attorneys.

The NLRB is the federal agency responsible for enforcing federal labor law, which includes administering elections to install (or “certify”) and remove (or “decertify”) unions. Dobbins’ decertification petition contains employee signatures well in excess of the threshold needed to trigger a decertification vote under the National Labor Relations Act (NLRA).

According to Dobbins’ petition, the workers’ requested vote should take place among “[a]ll full-time and regular part-time MOM’s team members” at the grocery store’s College Park branch.

Because Maryland lacks Right to Work protections for its private sector workers, UFCW union officials can legally enforce contracts that require Dobbins and her coworkers at MOM’s to pay union dues or fees as a condition of staying employed. In contrast, in Right to Work states, union membership and all union financial support are strictly voluntary.

A successful decertification vote strips union officials of both their forced-dues power and their ability to impose union monopoly bargaining contracts on every employee in a workplace, even those who voted against the union’s presence or otherwise oppose it.

“I have been working for MOM’s for 19 years,” commented Dobbins. “We have an understanding management team that has always been there for us and our families. We do not need a union to come and take money out of our paycheck when we have the best management team.”

DC-Area Union Kitchen Employees Also Seek to Boot UFCW Local 400 Union Officials

This isn’t the first time that DC-area grocery employees have banded together to remove UFCW Local 400 union officials. In January, workers from five locations of regional grocery concept Union Kitchen voted 24-1 to kick out UFCW Local 400, following employee Ashley Silva’s submission of a majority-backed decertification petition.

That effort began amid aggressive union boss-ordered pickets and boycotts against Union Kitchen Grocery locations, which sometimes escalated to the point that police intervention was needed. Despite that overwhelming ouster vote, UFCW union officials have so far successfully blocked the vote from being certified as they seek to cling to power by overturning the workers’ near unanimous vote to remove Local 400.

Biden-Harris NLRB Making It Harder for Workers to Oust Unwanted Unions

Dobbins and her coworkers may face similar stonewalling from UFCW bosses in their case, and unfortunately may face headwinds from the NLRB as well. Despite an over 50% increase in the number of decertification petitions filed annually over the last four years, Biden-Harris NLRB bureaucrats recently repealed key reforms (known collectively as the “Election Protection Rule”) that made it easier for workers to request decertification elections.

Now, under rules that took effect in late September, union officials have a nearly unlimited ability to manipulate unproven allegations against an employer (also known as “blocking charges”) to stop workers from exercising their right to vote out a union. The new rules also end the ability of workers to hold decertification elections as a way to challenge a union’s ascent to power via “card check.” Card check is an unsecure, abuse-prone process that bypasses the protections of a traditional secret-ballot election.

“UFCW Local 400 officials have a track record of stifling the will of the workers they claim to ‘represent,’ and the Biden-Harris NLRB’s cynical policy shifts have unfortunately given them more ways to do that,” commented National Right to Work Foundation President Mark Mix. “While such cases show why workers need more freedom to have secret ballot votes to eliminate union officials that they disapprove of, they also demonstrate the importance of Right to Work protections – workers who find themselves under the control of a union they oppose should never be forced to pay for that ‘representation.’”

KIPP St. Louis Charter High School Educators to Vote This Week on Whether to Oust AFT Union Bosses

Union decertification election will take place among wide swath of school employees, including teachers, advisors, administrative staff, and others

St. Louis, MO (May 14, 2024) – Teachers, advisors, nurses, and other employees at KIPP St. Louis High School will vote this week on whether to remove American Federation of Teachers (AFT) union officials from power at the school. The union decertification vote follows KIPP teacher Robin Johnston’s submission of a “decertification petition” earlier this month to National Labor Relations Board (NLRB) Region 14 in St. Louis. Johnston filed the decertification petition with free legal aid from the National Right to Work Foundation.

The NLRB is the federal agency responsible for enforcing federal labor law, which includes administering elections to install (or “certify”) and remove (or “decertify”) unions. Johnston’s petition contains signatures from enough of her coworkers to trigger a decertification vote under NLRB rules.

Because Missouri lacks Right to Work protections for its private sector workers (which includes employees at public charter schools like KIPP), union officials have the legal privilege to enforce contracts that force workers to pay union dues or fees as a condition of getting or keeping a job. In contrast, in Right to Work states, union membership and union financial support are strictly voluntary.

However, in both Right to Work and non-Right to Work states, union officials in a unionized workplace are empowered by federal law to impose a union contract on all employees in the work unit, including those who oppose the union. A successful decertification vote strips union officials of both their forced-dues and monopoly bargaining powers.

Vote Set to Take Place May 17

“AFT union officials haven’t stood up for us,” commented Johnston. “I think the majority of my coworkers agree that they’ve only made it harder for us to help our students succeed, especially through a divisive strike order, and that’s a trend I hope we can reverse with this vote. We hope the election proceeds without delay and without interference from union officials.”

The NLRB has scheduled a vote to occur on Friday, May 17. According to Johnston’s petition, the vote will occur among “College and Career Advisors, English Language Learners, Leads, Lead Teachers, Learning Support Teachers, Mental health Professionals, School Nurses, Special Ed. Teachers, Specials Teachers, Speech Language Pathologists, Virtual Learning Facilitators, Behavior Support Specialists, High School Registrars, Long Term Subs, Office Coordinators, Paraprofessionals, Permanent Building Subs and Receptionists” at the school.

Foundation attorneys have recently aided other charter school educators in efforts to remove unwanted union officials, most recently in San Diego, CA, where employees of Gompers Preparatory Academy prevailed in 2023 after a nearly four-year effort to vote out the San Diego Education Association (SDEA) union, an affiliate of the National Education Association (NEA).

San Diego Gompers Preparatory Academy Charter School Educators Vote Out SDEA Union

Gompers teachers sought to remove union as early as 2019, but union bosses stymied last attempt with unproven allegations and pressure from elected officials

San Diego, CA (June 8, 2023) – Teachers at Gompers Preparatory Academy, a public charter school in the Chollas View neighborhood of San Diego, have successfully voted to remove San Diego Education Association (SDEA) union bosses from the school. The educators received free legal aid from National Right to Work Foundation staff attorneys.

While Gompers teachers have been seeking to exercise their right to free themselves from the SDEA union’s control as early as 2019, the current effort began in March 2023 after a majority of Gompers educators signed a petition asking the California Public Employment Relations Board (PERB) to hold an employee vote on whether to oust the union (known as a “union decertification vote”). After collecting ballots from Gompers educators from May 10 to June 6, PERB yesterday announced a majority of teachers voted to remove the union.

Union Tactics Delayed Earlier Efforts to Vote Out Unwanted Union

The initial union decertification effort took place not long after SDEA officials gained power at the school in January 2019 via “card check,” a process that bypasses the traditional secret-ballot vote system to install a union. Gompers made an impressive transition to being a union-free charter school in 2005 after years of being plagued by unresponsive union bureaucracies, violence, and poor academic achievement, so many teachers and parents viewed the reinstallation of union monopoly power at the school with suspicion. Some accused SDEA agents of actively sowing division at the school, including by supporting anti-charter school legislation and needlessly disparaging the school’s leadership.

Gompers teachers’ first effort to eliminate the SDEA union stemmed from an October 2019 petition that had the backing of the requisite number of teachers to prompt the PERB to hold a decertification vote. However, SDEA union bosses attempted to avert the election by filing so-called “blocking charges” containing allegations of employer misconduct.

Union officials often manipulate “blocking charges” at the PERB and other state and federal labor relations agencies to stifle worker attempts to eliminate unpopular union “representation.” Despite the PERB never holding a hearing into whether SDEA union bosses’ claims had any merit or whether they were related to the workers’ dissatisfaction with the union, PERB officials denied a decertification election to Gompers educators in October 2020.

Foundation attorneys’ case defending the first petition to remove SDEA union agents from the school also sought to overturn PERB Regulation 32752, which requires PERB agents and attorneys to accept union bosses’ “blocking charge” allegations as true – a stipulation almost guaranteeing union defeat of any worker attempt to vote a union out.

“I chose to work at a school that didn’t have a union and now they’ve come in and they’re running everything about my contract and my work,” Kristie Chiscano, then a Gompers chemistry teacher and proponent of the decertification effort, said at the time.

Union Agents Targeted Teachers Who Led Effort to Vote Out Union

Even worse, shortly after the PERB’s ruling halting the original decertification effort, Chiscano and another Gompers educator filed charges maintaining that SDEA agents targeted them on social media for opposing the union hierarchy. California law makes it illegal for union officials to intimidate or retaliate against employees who exercise their right to refrain from union membership.

Union boss-aligned state legislators even chimed in to pressure Gompers management to give in to union demands. In a letter to Gompers management, then-Assemblywoman Lorena Gonzalez (now an AFL-CIO president) attacked the National Right to Work Foundation for simply providing legal aid to Gompers educators as they sought to exercise their right to hold a decertification election. Gonzalez was best known during her tenure for authoring AB5, a California law that drastically reduced opportunities for freelance workers and independent contractors across the state.

Teachers’ Union Decertification Efforts Expose Massive Power of California Public Sector Unions

Gompers educators submitted the March 2023 petition at the earliest time permitted by California labor regulations, which immunize union officials from employee-led decertification efforts for all but a tiny window while union contracts are active. Now, nearly four years after their original effort began, Gompers educators have finally voted to free themselves from union control. Gompers teachers and Foundation attorneys are still prepared to fight any objections the union files in an attempt to throw out the result.

“Gompers educators witnessed that SDEA union officials were not acting in the best interests of the students or the school community at large, and fought courageously for years to bring back the independent environment that made Gompers a success,” commented National Right to Work Foundation President Mark Mix. “While we at the Foundation are proud to have helped them win the fight, the hardship these teachers faced just to vote out a union they disapproved of should raise serious questions about union officials’ privileges under California law.”

“Gompers teachers endured years of legal roadblocks just to exercise their rights, and that’s to say nothing of the retaliation they faced from union officials and even pressure from union-label policymakers,” Mix added. “No special interest group in California, or in America, should wield this kind of power over teachers and the public education system.”

Western Louisiana Chemical Workers Vote Out Unpopular Steelworkers Union Bosses

Several more efforts by employees are ongoing across the country to vote out union officials

DeRidder, LA (October 31, 2022) – GEO Specialty Chemicals employee Ryne Fox and his coworkers have just voted unwanted United Steelworkers (USW) Local 13-725 union bosses out of power at their workplace. The vote, in which 75% of the work unit voted to remove the union, came after Fox filed a petition for a “decertification vote” with free legal assistance from National Right to Work Legal Defense Foundation staff attorneys.

Fox filed the “decertification petition” on September 24, 2022, asking the National Labor Relations Board (NLRB) to hold a vote among employees on whether the union should be removed. Because of a union boss-friendly NLRB policy known as the so-called “contract bar,” Fox timed the filing of the petition to coincide with the expiration of USW officials’ contract with GEO management. The non-statutory “contract bar” arbitrarily immunizes union officials from being voted out of a workplace during the life of a union contract, typically lasting one to three years.

Though many non-statutory NLRB policies like the “contract bar” still exist which prevent workers from voting out union bosses they oppose, Foundation-supported reforms adopted by the NLRB in 2020 have made the decertification process easier. The reforms pared back union officials’ ability to block decertification votes by filing so-called “blocking charges,” which often contain unrelated and unverified accusations of employer wrongdoing. Now, employees usually have a chance to at least cast ballots before any allegations surrounding the election are resolved.

Foundation Also Aiding Pennsylvania Employees in Ousting Corrupt, Unaccountable Steelworkers Officials

Fox and his coworkers’ endeavor is the third Foundation-assisted employee effort to vote out USW union officials in just the past couple months. Just last week, New Jersey building materials employee Michael Cobourn and his coworkers at Gold Bond Building Products in Burlington, NJ, voted out USW bosses by a nearly 70-30 margin. In Pennsylvania, Foundation attorneys are currently helping Carpenter Technologies/Latrobe Specialty Steel employee Kerry Hunsberger and her coworkers in their bid to decertify USW officials who blatantly ignored two votes by workers rejecting contracts union officials had negotiated.

In the situation at Hunsberger’s workplace, USW officials sought to trigger the “contract bar” and avoid an attempt by employees to vote the union out by secretly “ratifying” a contract that workers had voted against. USW bosses even held a second contract vote after the unpopular contract took effect. Union officials misled the workers, who unsurprisingly voted the contract down again, to believe their second vote would count, even though it was meaningless because the contract had already been “ratified.”

“Workers across the country are increasingly exercising their right to vote out union officials they oppose, and we at the Foundation are happy to aid workers in defending this essential element of free association,” commented National Right to Work Foundation President Mark Mix. “However, we’re also acutely aware of the obstacles that stand in the way of this freedom, and one of those, which Steelworkers officials seem to have no reservations about exploiting, is the ‘contract bar.’”

“The unjustified ‘contract bar’ is always wrong because it prevents workers from voting out unions they oppose when they want to. But even worse, this NLRB-invented doctrine actually incentivizes union officials to rush ahead and impose unpopular, self-serving contracts for the very purpose of insulating the union’s forced representation powers from a vote of the workers they claim to ‘represent,’” Mix added.

Maine Medical Center Nurses Secure Vote to Remove Unwanted Maine State Nurses Association Union Officials’ ‘Representation’

More than 500 workers petitioned for union “decertification election” seeking a vote as soon as allowed following imposition of unwanted union

Portland, ME (July 21, 2022) – Maine Medical Center nurses will soon vote in an election that could send Maine State Nurses Association (MSNA-NNU, an affiliate of National Nurses United) union officials packing from the hospital. This follows Nurse Davin Brooks’ submission of a petition containing signatures of more than 500 of his colleagues.

Brooks and his fellow nurses are receiving free legal assistance from the National Right to Work Legal Defense Foundation. The petition comes as Foundation staff attorneys are increasingly assisting healthcare workers in obtaining votes to remove unwanted unions, including in Michigan, Minnesota, New York, and Massachusetts.

The NLRB is the federal agency responsible for enforcing federal private-sector labor law, a duty which includes conducting votes to both certify and decertify unions. Foundation staff attorneys recommended reforms the NLRB adopted in 2020 that significantly eased processes by which workers can request a vote to remove an unwanted union. Those reforms included limiting union officials’ ability to manipulate often-unverified allegations of employer wrongdoing to stop an employee-requested union decertification vote.

Union Installed Through Dubious Mail-Ballot Process, Employees Soon Wanted Ouster

MSNA union officials were originally installed at Maine Medical Center in Portland in May 2021, after the NLRB conducted a mail-ballot union certification vote among the hospital employees. Mail-ballot NLRB elections, which before COVID were very rare and only held where in-person votes were not feasible, have lower turnout rates than standard in-person elections. Studies show mail-ballot elections benefit union organizers in part due to that lower turnout. Conducting such votes through the mail also has resulted in post office errors that disenfranchise workers, and ballot harvesting by union organizers that undermines the privacy of workers’ votes.

Since the union was installed last year, MSNA union officials and Maine Medical Center management have been unable to finalize a contract. Brooks filed the decertification petition signed by his coworkers in June, the soonest allowed by the NLRB’s “election bar” which prevents more than one such election within a year. The election is scheduled for August 17 and 18, and will be held in person at multiple Maine Medical Center locations.

“Maine Medical Center employees are more than reasonable in their desire to oust MSNA union officials, who came to power at the facility through a questionable mail-ballot vote and have failed to produce a contract in over a year,” commented National Right to Work Foundation President Mark Mix. “No healthcare worker should be subject to the monopoly control of a union that they don’t believe serves their interests. We are proud to aid Mr. Brooks and his coworkers in exercising their right to free themselves of union officials that clearly made promises to nurses on which the union could not actually deliver.”

National Right to Work Foundation Slams Decision Trapping Michigan Construction Workers in Unpopular Union

NLRB rules that ballots employees already cast in vote to oust union cannot be counted, highlighting Labor Board’s pro-union boss bias

Washington, DC (June 21, 2022) – The National Labor Relations Board (NLRB) in Washington, DC, has permitted the destruction of hundreds of ballots already cast by Michigan Rieth-Riley Construction Company workers in an election whether to oust International Union of Operating Engineers (IUOE) union officials. The decision shuts down a years-long effort by Rieth-Riley employees to remove IUOE Local 324 officials, allowing the union to stifle the workers’ vote with questionable “blocking charges” against Rieth-Riley management.

Rieth-Riley employee Rayalan Kent led the effort to vote out IUOE union officials. With the assistance of National Right to Work Foundation staff attorneys, he submitted two petitions in 2020 with enough worker support to trigger the NLRB’s administration of a “decertification vote.” A vote finally occurred in October 2020, but Regional NLRB officials in Detroit ruled, just hours before the ballots were to be counted, that union boss-concocted “blocking charges” invalidated the employees’ petition. The NLRB in Washington has now affirmed that decision.

Both rulings fly in the face of Foundation-backed reforms the NLRB adopted in 2020 regarding “blocking charges,” which provided that ballots in union decertification elections should be counted first before any unfair labor practice charges surrounding the election are dealt with. Moreover, even prior NLRB precedent required that an evidentiary hearing be held to determine whether there is any “causal nexus” between union allegations of employer misconduct and employee dissatisfaction engendering a union decertification effort. But the NLRB never held any such hearing in this case.

Settlements Foundation attorneys won in 2021 for Rieth-Riley employees Rob Nevins and Jesse London indicate that malfeasance by IUOE officials, not Rieth-Riley misdeeds, likely caused the company’s workers to push for the union’s ouster. London and Nevins decided to end their union memberships and keep working to support their families despite a union boss-ordered strike in 2019.

Nevins charged union officials with threatening to “blackball” him if he didn’t strike, and London reported that IUOE officials refused to hand over health insurance premium money they owed him for time he participated in the strike. The settlements mandated that IUOE union bosses not discriminate against London and Nevins for exercising their right to refrain from union membership, and also ordered them to pay London the health insurance premium money he was owed.

“The current decision demonstrates how the NLRB and its bureaucrats have twisted a law that is allegedly designed to protect the free choice rights of rank-and-file workers. Instead of supporting workers’ rights, this Board and past Boards have weaponized the National Labor Relations Act against workers solely to entrench union boss power,” commented National Right to Work Foundation President Mark Mix. “Rather than apply the letter and spirit of the 2020 Election Protection rule, Joe Biden’s NLRB has undermined and rendered useless even those modest reforms. Given this awful ruling, it is now likely that Rieth-Riley workers’ votes to remove the union will simply be dropped in a trash can.”

Mix added: “Workers have a statutory right to vote out a union they oppose and NLRB bureaucrats should not be able to nullify that right on the basis of unproven and often unrelated allegations of employer misconduct.”
