National Right to Work Foundation Issues Special Legal Notice to Employees of Big Three Automakers as UAW Brass Orders Strike
Foundation notifies employees that those wishing to continue working during a strike should resign their memberships before returning to work
Detroit, MI (September 12, 2023) – The National Right to Work Legal Defense Foundation has released a special legal notice to the thousands of autoworkers who may be impacted if United Auto Workers (UAW) union officials issue a strike order this week. UAW President Shawn Fain has threatened to order workers from Ford, General Motors, and Stellantis – the “Big 3” unionized American automakers – off the job if new contracts aren’t struck by Thursday, September 14.
The Foundation’s legal notice informs autoworkers of their rights, including their right to rebuff the strike order and to keep working to support their families as the strike is ongoing. The notice discusses why workers across the country frequently turn to the National Right to Work Foundation for free legal aid in such situations.
“This situation raises serious concerns for autoworkers who may believe there is much to lose from a strike and who do not want to abandon their jobs,” the notice reads. “Autoworkers have the legal right to rebuff union officials’ strike demands, but it is important for them to know their rights before they do so.”

The notice outlines the process that autoworkers should follow if they want to exercise their right to return to work during the strike and avoid punishment by union bosses, complete with sample union membership resignation letters. The notice reminds workers that UAW union officials have no disciplinary power over workers who are not union members, and advises employees who wish to work during a strike to resign their memberships at least one day before returning to work.
“The reason is that union officials can (and often do) levy heavy fines against union members who work during a strike,” the notice says.
Further, the notice reminds employees of their rights to cut off all union dues payments in the absence of a monopoly bargaining contract between UAW union officials and company management. The notice encourages employees to seek free legal aid from the Foundation if they experience union resistance as they attempt to exercise any of these rights.
“UAW union bosses have a long history of throwing workers under the bus while pursuing their own interests, something made clear by the federal corruption and embezzlement probe that resulted in many of the UAW’s top brass going to prison,” commented National Right to Work Foundation President Mark Mix. “Rank-and-file workers have good reason to wonder if Shawn Fain’s combative stance and apparent eagerness to initiate a strike is really what is best for them, their careers, and their families, or rather is yet another example of UAW bosses looking out for themselves and their personal ambitions to the detriment of those they claim to represent.”

Lucas County Employees Win Back Unconstitutionally Seized Money from AFSCME Union
Employees exercised constitutional right to stop funding union activities, but union-imposed restriction blocked exercise of right for over 90 percent of year
Toledo, OH (April 4, 2023) – Three Lucas County Job and Family Services (JFS) employees have emerged victorious in their federal civil rights lawsuit against the American Federation of State, County, and Municipal Employees (AFSCME) Ohio Council 8 union. The employees, Penny Wilson, Theresa Fannin, and Kozait Elkhatib, charged AFSCME union bosses in December 2022 with seizing money from their paychecks in violation of the First Amendment.
Wilson, Fannin, and Elkhatib received free legal assistance from the National Right to Work Legal Defense Foundation and The Buckeye Institute. They asserted their constitutional rights recognized in the landmark 2018 Foundation-won Janus v. AFSCME U.S. Supreme Court decision. In Janus, the Court declared it a First Amendment violation to force public sector workers to pay union dues or fees as a condition of employment. The Court also ruled that union officials can only deduct money from the paycheck of a public sector employee who has voluntarily waived his or her Janus rights.
Now, as part of a settlement, AFSCME Ohio Council 8 must return illegally seized money to each woman, and the union bosses are forbidden from having Lucas County deduct union dues from any of their paychecks going forward. The settlement fully vindicates the employees’ First Amendment Janus rights.
Lucas County Employees Weren’t Informed of First Amendment Right to Abstain from Union Dues
Officials from AFSCME Council 8 and Lucas County JFS enforced a policy against the women which permitted the taking of union dues directly from their wages. According to the policy, employees who wish to stop subsidizing the union have only a handful of days per year in which to do so – an “escape period” that effectively forbids the exercise of their First Amendment Janus rights for more than 90 percent of the year.
AFSCME union officials never informed Wilson, Fannin, and Elkhatib of this restriction. Union officials also never told the women that they had a First Amendment right under Janus to abstain from dues deductions, or that union dues could only be taken from them if they waived that right.
The employees discovered their Janus rights independently. Each attempted to exercise those rights twice by sending letters to AFSCME union officials stating that they were ending their union memberships and terminating dues deductions. AFSCME union officials denied all three women’s requests, stating that union dues deductions would continue because the letters missed the narrow “escape period” the union imposed.
“Plaintiffs did not knowingly, intelligently, or voluntarily waive their First Amendment rights…The restrictions on stopping government dues deductions…are unenforceable as against public policy because the restriction significantly impinges on employees’ First Amendment rights,” read the federal complaint.
Employees Often Must Seek Return of Dues Seized Without Consent
Wilson, Fannin, and Elkhatib’s win is the latest in a chain of successful Foundation-backed lawsuits defending Ohio public servants’ Janus rights. In 2020, for example, Foundation attorneys challenged a so-called “maintenance of membership” requirement that AFSCME Ohio Council 11 used to lock public employees out of their Janus rights for three years at a time. Rather than face off against Foundation attorneys, Council 11’s union officials backed down and settled the case. As a result, Foundation attorneys freed almost 30,000 Ohio public employees from the onerous arrangement.
“Once again Foundation-backed Ohio public employees have successfully defended their Janus rights against the schemes of AFSCME union officials, who were more concerned with accumulating dues money than respecting the First Amendment,” commented National Right to Work Foundation President Mark Mix. “America’s public workers should not have to file federal lawsuits to defend their Janus rights. Instead, before taking dues, union officials should inform workers about their Janus rights and honor those rights.”
“It’s heartening that the union has agreed to resolve this dispute by honoring their former members’ wishes; it’s disappointing that a lawsuit was required to reach that common-sense result,” said Jay R. Carson, senior litigator at The Buckeye Institute.
Northern PA Metal Worker Prevails in Federal Case Charging CWA Union with Illegal Dues Deductions
CWA officials also refused worker’s membership resignation and sought to force him to remain union steward
Galeton, PA (March 3, 2023) – Curtis Coates, an employee of metal corporation Catalus, has successfully forced Communications Workers of America (CWA) union officials to stop illegally seizing money from his paycheck for union politics and ideological causes. National Right to Work Legal Defense Foundation staff attorneys represented Coates for free before the National Labor Relations Board (NLRB).
Coates charged CWA union officials in May 2022 with unlawfully snubbing both his request to resign from his position as a union shop steward and his request to formally end his union membership. Full union dues deductions also continued to flow out of his paycheck even after his requests. Coates argued that CWA bosses violated his rights under the National Labor Relations Act (NLRA).
Because Pennsylvania lacks Right to Work protections for its private sector workers, unions can legally coerce workers into paying union fees just to keep their jobs even if they choose not to become union members. However, under the U.S. Supreme Court’s decision in CWA v. Beck, won by Foundation attorneys, this is limited to only the part of union dues that union officials claim goes toward a union’s core “representational” functions, and excludes deductions for union political or ideological activities. In contrast, in states with Right to Work protections, union membership and all union financial support are both strictly voluntary.
A Foundation-won settlement now requires CWA union officials to post a notice at Coates’ workplace declaring that they “will not fail and refuse to honor your request to resign your union membership,” and “will not fail and refuse to honor your request to resign your role as a union steward.” CWA union officials have also stopped siphoning money for union politics and ideological activities from Coates’ wages.
CWA Forced Dissenting Worker to Remain Shop Steward, Took Full Dues Illegally from Paycheck
According to his charge, Coates sent a message to CWA union officials on October 20, 2021, declaring that he was resigning from his position as shop steward and terminating his union membership. A union official rebuffed both of Coates’ requests the next day, insisting that he had to remain both a union member and a shop steward.
In December 2021, January 2022, and February 2022, Coates followed up with union officials several times via email and mail. He asked when union officials would cease taking dues money from his wages and what process he had to follow to revoke his dues deduction authorization.
Coates’ charge asserted that CWA union officials, by refusing his repeated requests to resign his union membership, violated his rights under Section 7 of the NLRA, which recognizes workers’ right to “refrain from any or all” union activities.
Foundation President: No Place for Compulsory Union Support in Federal Law
“CWA officials summarily denied Mr. Coates’ valid exercise of his right to refrain from union membership, unlawfully seized money for union politics, and even forced him to remain a union shop steward,” commented National Right to Work Foundation President Mark Mix. “The extreme aversion CWA union officials seem to have to any kind of dissociation with the union shows where their focus lies: maintaining forced worker subsidization of union activities and not on respecting workers’ individual rights.”
“Such union malfeasance is only buoyed by federal labor law, which permits states to deny Right to Work protections to private sector workers,” Mix added. “No American worker should be forced to fund any kind of unwanted union purpose as a condition of keeping his or her job, which is why securing Right to Work protections for all Americans is absolutely vital.”
Houston-Area Kroger Employee Slams UFCW Union with Federal Charges for Seizing Union Dues Using Altered Union Card
Employee objected to union membership and financial support during orientation meeting; union taking dues under guise of altered form
Houston, TX (February 21, 2023) – Cypress-area Kroger employee Jessica Haefner has just hit the United Food and Commercial Workers (UFCW) union at her workplace and her employer with federal charges. Haefner maintains that union and Kroger officials are unlawfully seizing union dues from her paycheck based on an altered union membership form that ostensibly indicates her consent to union dues deductions, even though she followed instructions on how to exercise her right to refrain from union membership and support. Haefner filed the charges at the National Labor Relations Board (NLRB) with free legal representation from National Right to Work Foundation staff attorneys.
Haefner’s charges state that UFCW Local 455 union officials’ actions violate her and her coworkers’ rights under Section 7 of the National Labor Relations Act (NLRA), which guarantees American private sector workers’ right to abstain from any and all union activities. The NLRB is the federal agency responsible for enforcing the NLRA.
Texas’ Right to Work protections also prohibit union officials from forcing private sector workers like Haefner to join or pay dues to a union as a condition of getting or keeping a job. In contrast, states lacking Right to Work laws permit the firing of private sector workers for refusal to pay money to a union hierarchy.
Union Form Was Altered
On August 22, 2022, Haefner attended a mandatory orientation meeting during which she was required to listen to a UFCW agent, her charges state. The UFCW agent passed out a union membership application and a dues checkoff on a single form that he claimed was mandatory for attendees to complete. Another piece of onboarding literature stated that Kroger management had the “opinion that you should participate and be active in the Union.”
When Haefner asked about how she could exercise her right to refrain from joining the union or paying union dues, the union agent instructed Haefner to write “$0” in the field marked “union dues” on the form. Texas’ Right to Work law protects Haefner’s right to abstain from union membership and dues payment.
Haefner followed these instructions, but later found out that union dues were coming out of her wages, her charges say. Haefner quickly obtained a copy of the form that Kroger and UFCW officials based their dues deductions on, and discovered that the “$0” she had written in the union dues field had been replaced with an amount of several dollars to induce dues deductions from her paycheck.
UFCW Bosses Across Country Illegally Snubbing Worker Requests to Abstain from Union Activity
UFCW’s violation of Haefner’s rights is not an isolated incident. In Pennsylvania, Foundation staff attorneys are also representing Giant Eagle supermarket cashier Josiah Leonatti, who charges UFCW Local 1776KS union officials with refusing to accommodate his religious objections to union membership. His charges say union officials tried to subject him to an illegal “religion test” before they considered granting him an accommodation.
“UFCW union officials seem to adhere to a nationwide policy of prioritizing dues revenue over employees’ free association rights,” commented National Right to Work Foundation President Mark Mix. “Foundation attorneys have already witnessed that UFCW bosses are willing to discriminate against religious employees in the pursuit of more dues deductions, and in Ms. Haefner’s case their malfeasance may be as bad as flat out altering employee forms to deduct dues.”
“As cases brought for workers with free Foundation legal aid show, UFCW bosses have a long and documented history of violating workers’ rights, whether through thousands of dollars in illegal strike fines, illegal religious discrimination, threatening teenagers’ jobs, and now by altering a worker’s dues authorization,” Mix added.
Louisville Ford Assembly Plant Worker Slams UAW Union with Federal Charges for Seizing Money from Her Paycheck Illegally
Charge detailing violation of employee’s rights comes after multiple top UAW chiefs have been sentenced to prison for widespread corruption and embezzlement of workers’ dues money
Louisville, KY (October 27, 2022) – Shiphrah Green, an employee at Ford’s Louisville Assembly Plant, has filed federal charges against the United Automobile Workers (UAW) Local 862 union at the plant. Her charges contend that union officials are violating her rights by seizing dues money from her paycheck after she resigned her membership and requested a stop to all dues. Green, who is represented for free by National Right to Work Legal Defense Foundation staff attorneys, also hit Ford with federal charges for their officials’ role in the unlawful deduction of union dues.
National Labor Relations Board (NLRB) Region 9 in Cincinnati will now investigate Green’s charges. The charges detail UAW and Ford officials forcing Green to navigate several unnecessary and unlawful steps to end her financial support for the union. They even state that the Local 862 president made threatening comments regarding Green’s job just because she exercised this basic free choice right. To date, the charges state, Ford and the UAW have not stopped collecting full union dues from Green’s paycheck.
Green’s charges argue that both the UAW union and Ford infringed on her rights under Section 7 of the National Labor Relations Act (NLRA), which protects American private sector employees’ right to refrain from any or all union activities. Additionally, Kentucky is a Right to Work state, meaning union officials are forbidden by state law from getting workers fired merely for refusal to join or financially support a union.
UAW Officials Block Employee from Exercising Basic Rights
According to her charges, Green sent correspondence to both UAW and Ford officials on April 21, 2022 informing them she was resigning her union membership and cutting off union dues deductions from her wages. Neither party granted her request, and Green instead received an email from UAW Local 862’s president notifying her that she needed to be shown the purportedly “correct” method to leave the union.
At a meeting with union officials at the UAW union hall on April 25, UAW officials forced Green to answer questions about why she wanted to leave the union. They also demanded she sign a letter listing “benefits” Green would supposedly forgo if she went through with exiting the union.
The charge contends that NLRB precedent prohibits requiring workers to sign such a document just so they can exercise their right to end their union membership and stop dues deductions. UAW Local 862’s president apparently went even further. According to the charge, he told Green “if it were up to me, you’d lose your job for leaving the union.”
As this chain of events was ongoing, Green was also trying to get Ford management to end the dues deductions. This also proved fruitless, as Ford officials gave her several confusing responses and even told her at one point that she could only cease dues deductions in February 2023 – even though the previously authorized dues deduction document stated it could be revoked at will.
The charges contend that Ford violated federal law by “continuing to take full union dues” from Green’s paycheck at union bosses’ behest even after she had requested that they stop, and that UAW Local 862 violated federal law by continuing to accept those illegally-seized dues, by “restricting her union membership resignation, and by making threatening comments that would chill an ordinary employee’s exercise of Section 7 rights.”
New Evidence of UAW Corruption Emerges After Top UAW Chiefs Receive Jail Sentences
Green’s charges come as the UAW union is still reeling from the effects of a years-long investigation by federal prosecutors into massive corruption within the union hierarchy. The probe, as of July 2022, has already resulted in convictions of at least 17 people, including two former UAW presidents and at least nine other UAW top officials. The convicted former UAW presidents, Gary Jones and Dennis Williams, were sentenced to a combined 49 months in prison.
UAW officials were convicted most notably of embezzling millions from the union’s dues-stocked coffers for luxury golf vacations, expensive liquor and cigarettes, steak dinners, amusement park tickets, and more.
“The past few years have shown how deep anti-worker corruption runs within the UAW hierarchy. Foundation Defends Michigan Teacher from Union Boss Money Grab as Union Sues for Dues Teacher Never Owed
Foundation helps teacher respond to Michigan Education Association lawsuit seeking collection of ‘back dues’ from her after she resigned her union membership
Ann Arbor, MI (April 24, 2020) – With free legal aid from the National Right to Work Legal Defense Foundation, Ann Arbor-area teacher Deborah Wolter is defending herself against Michigan Educators Association (MEA) union lawyers who filed a lawsuit claiming she owes thousands of dollars in back dues, despite the fact that the purportedly owed dues are for a period after she resigned her union membership. Under Michigan’s Right to Work law, nonmembers cannot be required to make any payments of union dues or fees.
As her response to the union lawsuit notes, Wolter does not owe MEA any dues because she resigned her union membership in August 2014. Because MEA’s demands for dues violate Michigan’s Right to Work law, Wolter’s attorneys are fighting to dismiss the union’s false claims that she owes them anything.
MEA union lawyers are suing Wolter for not paying dues as a nonmember, while Wolter’s attorneys charge the union lawsuit violates Michigan’s Right to Work law—which protects nonmembers from being forced to pay union dues or fees and allows workers to cut off all dues payments after resigning their union membership.
Union lawyers further claim in their lawsuit that Wolter did not resign union membership before she stopped paying dues, despite Wolter’s August 2014 resignation. As her legal filings state, Wolter “terminated her membership in both law and fact,” and therefore does not owe MEA union bosses anything.
Last year, Foundation staff attorneys won a victory for two other teachers at Wolter’s school facing similar demands from officials of the Ann Arbor Education Association (AAEA), an MEA affiliate. In that case, the Michigan Court of Appeals ruled AAEA violated the rights of teachers Jeffrey Finnan and Cory Merante under Michigan’s Right to Work Law by demanding that they continue to pay union fees even though they had resigned their union membership.
Since Michigan passed its Right to Work law, which became effective in March 2013, Foundation staff attorneys have brought over 120 cases for Michigan workers subjected to coercive union boss tactics.
