FEC Fails to Investigate Teachers’ Complaint of NEA Union Money Laundering Scheme

Employee rights advocate weighs federal lawsuit

Washington, DC (January 5, 2010) – Apparently without conducting a field investigation, the Federal Election Commission (FEC) dismissed a complaint against one of the most politically active unions in America after evidence surfaced that union officials deposited illegally laundered dues money into its political action committee (PAC).

Citing in part lack of sufficient funding to enforce the law, the FEC junked a complaint filed by the National Right to Work Legal Defense Foundation and two Alabama teachers who discovered a union scheme to divert convention reimbursements into the National Education Association (NEA) union’s PAC.

When attending the NEA’s 2004 national convention, Daphne Middle School science department chair Claire Waites was deceived into supporting the NEA’s PAC and was determined that it would not happen again. However, Waites and Assistant Principal Dr. Jeanne Fox, both members of the Baldwin County Education Association (BCEA), Alabama Education Association (AEA), and NEA unions, discovered the practice continues.

In July 2008, Waites and Fox attended the NEA’s annual convention in Washington, DC as delegates of the BCEA. According to their sworn testimony, BCEA union president Saadia Hunter informed the educators that contributions in their names were made to a “children’s fund” using money included in their expense reimbursements for their trip to the convention.

Although Hunter told Waites that these contributions were not political in nature, they actually went to the NEA’s PAC. Hunter later admitted that the money would be contributed to Barack Obama’s presidential campaign. AEA union bosses also admitted to the educators that the PAC contributions were paid with BCEA members’ dues.

Foundation attorneys are considering a lawsuit against the FEC for shirking its duty of upholding the integrity of the political system, particularly since it is suspected this scheme affected many other teacher delegates to the union convention.

“The FEC made a conscious decision to not take these charges seriously,” said Mark Mix, president of the National Right to Work Foundation. “We suspect this scheme could involve many more teachers – potentially to the tune of hundreds of thousands of dollars.”

It is illegal for union officials to encourage and solicit contributions under false pretenses and without informing workers of their right to refuse to contribute without any reprisal. Federal law also forbids campaign contributions made in the name of another person.

The National Right to Work Legal Defense Foundation is a nonprofit, charitable organization providing free legal aid to employees whose human or civil rights have been violated by compulsory unionism abuses. The Foundation, which can be contacted toll-free at 1-800-336-3600, is assisting thousands of employees in over 200 cases nationwide.

If the Federal Election Commission dismissed the complaint and there was Illegal operations that violate the law of the land and the Constitution of America then the FBI should be investigating them to the full extent of the law. If they do not it is a further sign that the Current Administration is a treasonable one that will allow the Unions to buy their way out through the Political Action Committees thwarting the rights of the individuals right to work.

Money from expense reimbursements !?

Even if the money had gone to a "children's fund", why would that be OK? Who or what was the source of the reimbursement monies? Is a charitable donation incurred while attending a NEA convention an eligible expense?

Any monies taken from another is a "co-erced deduction" not a "charitable donation", so it would make no difference to whom the monies were given. However, doing such a thing when one does not know the wishes of the parties involved is theft and deserves the full extent of the law.

It is obvious to me that as soon as the Republicans and Or Tea Party Movement takes over at least one house of Congress, we should start on legislation to end unions, period. While this is TYPICAL of all the BIG UNIONS there is nothing that can be done with the current administration.

Remember our POTUS had over 800 MILLION UNACCOUNTABLE dollars to spend on BUYING the election.

NO ONE has investigated where the money came from, what it was spent on, and who denoted to his campaign. As far as that goes nobody knows where Obama hid what was left.

The NEA is worthless in the United States. My wife was in the Local teachers union and the NEA for 35 years... they did nothing about any complaints she had.. (two) in the entire 35 years... they just took her money and the school systems got WORSE, the administration got bigger and she received nothing in return.

FCC has no money to investigate. Fire a couple of do nothing big shots and use that money, or better yet... get some of that stimulus the Messiah keeps giving out to his friends and donors.

I have been in musicians's union for 40 years and have resigned because of the same reason. I sent a letter to the president of AFM stating I could not belong to an organization that wants to turn our country into another Soviet Union. I belonged two unions in my lifetime and they did nothing for me but to me. They took my money for their officers paycheck. At the rate they are going we will have the USSA. See the existing "free" lawsuits

Your donation was not in vain. If the FEC isn't sued (although it probably will be if they don't act), you're supporting many actions being taken around the country. Didn't you read some of the news under the blogs? Legal activity isn't free although this organization helps alot of little people take the unions and companies to court and doesn't charge them. You should be proud of your donation.

To be fair, the author noted a similar "sleight of hand" on your part, and duly called you on it. While I may disagree with his assertion that this needs to be the last donation (although he does have that right) I do believe that he has made a specific complaint against your site. Specifically your insistence that it is acceptable for you to use these techniques because you are doing good while you see a problem with such practices from the other side. I think you could have better resolved this issue if you had have have acknowledged your failure, corrected your behavior and moved on. Instead, you chose to defend and indefensible position and have lost a small amount of credibility.
