Dear Union:

I, [insert resigning member’s full name] notify the [insert union name], herein UNION, and my employer, [insert employer’s name], herein EMPLOYER, of the following:

I hereby resign my union membership, from my local and all of its affiliates, effective immediately.

If I am required to pay fees to the union as a condition of employment, I will pay those fees to keep my job. However, I object to the collection and expenditure of a fee for any purpose which I cannot lawfully be required to subsidize, and request that you provide me with the financial notice and other procedural rights required under Chicago Teachers Union v. Hudson, 475 U.S. 292 (1986). This objection is permanent and continuing in nature. In the event that the United States Supreme Court declares all public-sector compulsory fee requirements to be unconstitutional, I insist that you and my employer immediately cease deducting any and all union fees from my paycheck.

Finally, I hereby revoke any prior dues checkoff authorization I may have signed. Instead, I authorize only the deduction from my wages of representation fees which are limited and reduced to those costs that are lawfully chargeable under the First Amendment to the United States Constitution. If you refuse to accept this letter as changing my checkoff authorization from full dues to reduced fees, please promptly inform me, in writing, of exactly what steps I must take to effectuate that change. If I am required to sign a specific form to make that change from deduction of full dues to reduced fees, please provide me with the necessary form.

Please reply promptly to my request. The further exaction of full union dues or fees from me in a manner inconsistent with this letter will violate my rights under the United States Constitution.

Sincerely yours,

[insert resigning member’s full name]
