{"id":667,"date":"2010-04-01T15:15:44","date_gmt":"2010-04-01T15:15:44","guid":{"rendered":""},"modified":"2020-01-22T17:35:52","modified_gmt":"2020-01-22T22:35:52","slug":"craig-becker-watch-right-to-work-exposes-becker-threat-in-national-media","status":"publish","type":"post","link":"https:\/\/www.nrtw.org\/es\/blog\/craig-becker-watch-right-to-work-exposes-becker-threat-in-national-media\/","title":{"rendered":"Craig Becker Watch: Right to Work Exposes Becker Threat in National Media"},"content":{"rendered":"<p><\/p>\n<p>\nAfter the Senate rejected an attempt to confirm President Barack Obama&#8217;s nomination of <a href=\"\/en\/blog\/obama-nlrb-05202109\">pro-compulsory unionism radical<\/a> Craig Becker to the National Labor Relations Board (NLRB), Obama appointed Becker <a href=\"http:\/\/www.cnsnews.com\/news\/article\/63503\">via a recess appointment<\/a>.\n<\/p>\n<p>\nOn the heals of the appointment, National Right to Work Foundation attorneys <a href=\"\/en\/blog\/legal-aid-foundation-demands-radical-obama-re03292110\">sprang into action<\/a> and filed 12 recusal motions asking Becker to step aside in any pending case involving the Foundation, citing Becker&#8217;s bias against independent-minded workers and the Foundation (download two of the motions in .pdf format <a href=\"\/files\/nrtw\/Becker1.pdf\">here<\/a> and <a href=\"\/files\/nrtw\/Becker2.pdf\">here<\/a>). The <a href=\"http:\/\/blogs.wsj.com\/washwire\/2010\/03\/29\/nlrb-fight-begins-anew\/\"><i>Wall Street Journal<\/i><\/a> reports:\n<\/p>\n<blockquote>\n<p>\n\tThe National Right to Work Legal Defense Foundation said Becker, who has served as counsel for the Service Employees International Union and the AFL-CIO, should not hear cases in which the foundation is providing legal aid to workers, because Becker directly opposed the group while serving as counsel for the SEIU and because his prior writings demonstrate a bias against the group.\n\t<\/p>\n<\/blockquote>\n<blockquote>\n<p>\n\t\u201cWe just don\u2019t think he\u2019s going to be able to impartially adjudicate cases involving the Foundation\u2019s attorneys,\u201d said Nick Cote, a spokesman for the group. He cited several writings, including a 2005 article that Becker co-wrote in the Berkeley Journal of Employment and Labor Law in which the foundation is referred to as \u201cfunded by the most anti-union fringe of the employer community.\u201d\n\t<\/p>\n<\/blockquote>\n<p>\nAnd as Mark Hemmingway from the Washington Examiner <a href=\"http:\/\/www.washingtonexaminer.com\/opinion\/blogs\/beltway-confidential\/will-obama-labor-relations-appointee-craig-becker-recuse-himself-from-cases-involving-national-right-to-work-89516127.html\">observes<\/a>:\n<\/p>\n<blockquote>\n<p>\n\tWell, here\u2019s a new wrinkle. One of the biggest interests groups on labor issues in Washington is National Right to Work. Unions try and portray the organization as a shill for big business, but the fact is that National Right to Work is the only organization providing free legal aid to workers with grievances against their union, and is otherwise responsible for doing a lot to keep unions in check.\n\t<\/p>\n<\/blockquote>\n<blockquote>\n<p>\n\tNot surprisingly, Becker hates National Right to Work and has written several pointed things about the group including that they are \u201cfunded by the most anti-union fringe of the employer community\u201d and are \u201cideologically driven.\u201d Considering that Becker believes \u201cemployers should have no right to be heard in either a representation case or an unfair labor practice case,\u201d he\u2019s probably not the best judge of what it means to be \u201cideologically driven\u201d or part of \u201cthe anti-union fringe.\u201d\n\t<\/p>\n<\/blockquote>\n<blockquote>\n<p>\n\tBecker has also written \u201cat the urging of the [National] Right to Work Committee the Supreme Court has developed a virtual obsession [with cases where workers get legal aid from the National Right to Work].\u201d And there are other examples of National Right to Work antipathy.\n\t<\/p>\n<\/blockquote>\n<blockquote>\n<p>\n\tWell, the fact is that you can\u2019t swing a dead cat in the labor relations world without hitting something National Right to Work is involved in. It\u2019s hard to imagine that Becker is capable of giving them (or just about anyone who isn\u2019t a union) a fair hearing. National Right to Work has responded by filing&#8230; recusal motions against Becker on the National Labor Relations Board.
