{"id":335,"date":"2008-09-04T17:16:01","date_gmt":"2008-09-04T17:16:01","guid":{"rendered":""},"modified":"2016-08-09T18:15:33","modified_gmt":"2016-08-09T18:15:33","slug":"sneak-attack-national-mediation-board-wants-to-encourage-use-of-coercive-card-check","status":"publish","type":"post","link":"https:\/\/www.nrtw.org\/es\/blog\/sneak-attack-national-mediation-board-wants-to-encourage-use-of-coercive-card-check\/","title":{"rendered":"Sneak Attack: National Mediation Board Wants to Encourage Use of Coercive Card Check"},"content":{"rendered":"<p>\nIn recent weeks, the <a href=\"http:\/\/www.nmb.gov\/\" title=\"http:\/\/www.nmb.gov\/\">National Mediation Board<\/a>, a federal bureaucracy whose <a href=\"http:\/\/www.nmb.gov\/publicinfo\/mission.html\" title=\"http:\/\/www.nmb.gov\/publicinfo\/mission.html\">purpose<\/a> is to, among other things, \u201cto promote\u2026 the effectuation of employee rights of self-organization where a representation dispute exists\u2026\u201d within the railroad and airline industries, has proposed revisions to its Representational Manual that would open the floodgates to the use of coercive &quot;card check.&quot;\n<\/p>\n<p>\nWhile the NMB does \u201cdetermine and certify collective bargaining representatives of employees\u201d it also says that it functions to \u201censure that the process occurs without interference, influence or coercion.\u201d Despite this fact, the proposed NMB revisions are <a href=\"http:\/\/www.nmb.gov\/representation\/rep-man_062.pdf\" title=\"http:\/\/www.nmb.gov\/representation\/rep-man_062.pdf\">explicitly stated<\/a> to not be \u201cintended to interfere with or preclude either certification by card check\u2026or voluntary recognition.\u201d In other words, while its mission is to stop coercion, the NMB wants to modify its rules to encourage the coercive card check process for unionization.\n<\/p>\n<p>\nNational Right to Work Staff Attorney Glenn M. Taubman submitted opposing <a href=\"\/files\/nrtw\/Final%20NRTWLDF%20and%20NRTWC%20Comments.pdf\">comments<\/a> for the <a href=\"http:\/\/www.nrtwc.org\/\" title=\"http:\/\/www.nrtwc.org\/\">National Right to Work Committee<\/a> and the <a href=\"\/\">National Right to Work Legal Defense Foundation<\/a> regarding the sneaky changes proposed by the National Mediation Board. As Taubman points out, not interfering with \u201ccard check\u201d practices is essentially providing a rubber stamp for more union boss interference, influence and coercion.\n<\/p>\n<p>\nTaubman makes a forceful argument using historical fact and case law that having rules that allow \u201ccard check\u201d undermine employee free choice.
