{"id":313,"date":"2008-07-29T11:50:08","date_gmt":"2008-07-29T11:50:08","guid":{"rendered":""},"modified":"2016-08-09T18:16:12","modified_gmt":"2016-08-09T18:16:12","slug":"even-a-big-labor-ally-concedes-the-seiu-may-be-breaking-federal-election-law","status":"publish","type":"post","link":"https:\/\/www.nrtw.org\/es\/blog\/even-a-big-labor-ally-concedes-the-seiu-may-be-breaking-federal-election-law\/","title":{"rendered":"Even a Big Labor Ally Concedes the SEIU May Be Breaking Federal Election Law"},"content":{"rendered":"<p>\nYesterday, a pro-Big Labor blogger at OpenLeft inadvertently <a href=\"http:\/\/www.openleft.com\/showDiary.do?diaryId=7192\">highlighted<\/a> the absurdity of the SEIU&#8217;s apparently <a href=\"\/blog\/wall-street-journal-department-justice-invest82908\">illegal fundraising scheme<\/a> (emphasis mine):\n<\/p>\n<blockquote>\n<p>\n\t<b>If the local doesn&#8217;t put enough money into the national PAC, they will have to pay a penalty of regular funds <\/b>out of union dues to the international.  <b>PAC contributions are voluntary and only come when members feel empowered<\/b>, whereas union dues are automatic, <b>so this is a strong incentive for locals to organize and empower their members. <\/b> It&#8217;s a good policy move, and it was voted on and ratified at the SEIU Convention.\n\t<\/p>\n<\/blockquote>\n<p>\nSurely the author realizes that there&#8217;s some tension between &quot;voluntary contributions&quot; and an SEIU policy that penalizes local affiliates for failing to meet MANDATORY political fundraising targets? Actually, he does:\n<\/p>\n<blockquote>\n<p>\n\tThe requirement and penalty do somewhat cut against what it means to voluntarily give to political causes. A possible lawsuit might be viable.\n\t<\/p>\n<\/blockquote>\n<p>\nFor sure. Here&#8217;s the relevant <a href=\"http:\/\/www.law.cornell.edu\/uscode\/uscode02\/usc_sec_02_00000441---b000-.html\">section<\/a> of US code quoted in the National Right to Work Foundation&#8217;s <a href=\"\/files\/nrtw\/SEIU-DOJ-DOL-letters.pdf\">letters<\/a> (.pdf) to the Departments of Justice and Labor (emphasis mine):\n<\/p>\n<blockquote>\n<p>\n\t<span class=\"enumbell\">(2)<\/span> <span class=\"ptext-2\">For purposes of this section and section 79l(h) of title 15,<span class=\"footref\"><sup>[1]<\/sup><\/span> <b>the term \u201ccontribution or expenditure\u201d <\/b>includes a contribution or expenditure, as those terms are defined in section 431 of this title, and also i<b>ncludes any direct or indirect payment, distribution, loan, advance, deposit, or gift of money, or any services, or anything of value<\/b> (except a loan of money by a national or State bank made in accordance with the applicable banking laws and regulations and in the ordinary course of business) to <b>any candidate, campaign committee, or political party or organization, in connection with any election<\/b> to any of the offices referred to in this section or for any applicable electioneering communication, but shall not include<\/span>\n\t<\/p>\n<p>\n\t. . .\n\t<\/p>\n<p>\n\t<span class=\"ptext-2\"><b>It shall be unlawful\u2014<\/b><br \/>\n\t<\/span>\n\t<\/p>\n<\/blockquote>\n<blockquote><p>\n\t<a title=\"b_3_A\" name=\"b_3_A\"><\/a><span class=\"enumbell\">(A)<\/span> <span class=\"ptext-3\"><b>for such a fund to make a contribution or expenditure by utilizing money or anything of value secured by<\/b> physical force, job discrimination,<b> financial reprisals, or the threat of<\/b> force, job discrimination, or <b>financial reprisal<\/b>; or by dues, fees, or other moneys required as a condition of membership in a labor organization or as a condition of employment, or by moneys obtained in any commercial transaction;<\/span>\n<\/p><\/blockquote>\n<p>\nNo political expenditures &quot; . . . secured by financial reprisals or the threat of financial reprisals?&quot; Sounds like a pretty explicit violation of U.S. law.\n<\/p>\n<p>\nThe SEIU&#8217;s political fundraising apparatus is absolutely <a href=\"http:\/\/www.battlebornpac.com\/archives\/79\">enormous<\/a>. As the author of the OpenLeft post notes, its institutional clout and massive campaign expenditures dwarf other organizations&#8217; contributions.
