{"id":2732,"date":"2001-01-30T00:00:00","date_gmt":"2001-01-30T00:00:00","guid":{"rendered":""},"modified":"2016-08-09T18:29:19","modified_gmt":"2016-08-09T18:29:19","slug":"mccain-feingold-deliberately-guts-employees-right-not-to-fund-union-electioneering-0","status":"publish","type":"post","link":"https:\/\/www.nrtw.org\/es\/news\/mccain-feingold-deliberately-guts-employees-right-not-to-fund-union-electioneering-0\/","title":{"rendered":"McCain-Feingold Deliberately Guts Employees&#8217; Right Not to Fund Union Electioneering"},"content":{"rendered":"<p>The National Right to Work Legal Defense Foundation today released an analysis revealing that the McCain-Feingold campaign finance bill is a \u00abTrojan Horse,\u00bb containing crafty language designed specifically to gut the U.S. Supreme Court <i>Beck<\/i> decision.<\/p>\n<p>National Right to Work Foundation attorneys won the U.S. Supreme Court <a href=\"\/foundation-won.htm#Beck\"><i>Communications Workers of America v. Beck<\/i><\/a> decision in 1988, allowing employees to halt and reclaim all forced union dues not used for collective bargaining activity, like politics. <\/p>\n<p><b>The legal analysis, written by one of the Foundation attorneys who won the Supreme Court&#8217;s <i>Beck<\/i> decision, demonstrates that the McCain-Feingold legislation would:<\/b><\/p>\n<ul>\n<li>Hand the National Labor Relations Board (NLRB) <u>exclusive<\/u> jurisdiction to enforce <i>Beck<\/i> &#8212; stripping the federal courts of their jurisdiction to do the same. (<u>The NLRB has consistently dragged its heels with regard to <i>Beck<\/i> enforcement<\/u>.)\n<\/li>\n<li>Overrule 40 years of the U.S. Supreme Court&#8217;s interpretation of federal labor laws by sanctioning the use, now prohibited, of compulsory dues for a broad range of political and ideological purposes.\n<\/li>\n<li>Repudiate the U.S. Supreme Court&#8217;s 1961 decision in <i>Machinists v. Street<\/i> that no political and ideological activities may be subsidized with compulsory union dues.\n<\/li>\n<li>Gut the U.S. Supreme Court <a href=\"\/foundation-won.htm#Hudson\"><i>Chicago Teachers Union v. Hudson<\/i><\/a> decision requiring union officials to provide nonmembers with an independent audit of union expenditures before seizing any forced dues.
