{"id":2411,"date":"2005-02-25T00:00:00","date_gmt":"2005-02-25T00:00:00","guid":{"rendered":""},"modified":"2016-08-09T18:26:03","modified_gmt":"2016-08-09T18:26:03","slug":"uaw-union-forced-to-abandon-1-100-worker-thomas-built-bus-facility-after-illegally-corralling-workers-into-union-0","status":"publish","type":"post","link":"https:\/\/www.nrtw.org\/es\/news\/uaw-union-forced-to-abandon-1-100-worker-thomas-built-bus-facility-after-illegally-corralling-workers-into-union-0\/","title":{"rendered":"UAW Union Forced to Abandon 1,100-Worker Thomas Built Bus Facility After Illegally Corralling Workers into Union"},"content":{"rendered":"<p><strong>High Point, North Carolina (February 25, 2005)<\/strong> \u2013 Facing intense employee opposition and pending unfair labor practice charges, United Auto Workers (UAW) union officials have agreed to pull up stakes at the massive Thomas Built Bus facility after having obtained recognition through the coercive \u201ccard check\u201d process. <\/p>\n<p>National Right to Work Foundation attorneys helped Thomas Built worker Jeff Ward file unfair labor practice charges early last year that led to issuance of a National Labor Relations Board (NLRB) complaint against the company and union.  The complaint alleged unlawful coercion during a \u201ccard check\u201d drive and unlawful premature bargaining when a majority of employees had not yet chosen to unionize.  <\/p>\n<p>Although union and company officials are eager to sign a settlement agreement stipulating that UAW disclaims representation power over employees at the Thomas Built Bus facility, Ward is objecting to the settlement.  He is asking the NLRB to void the entire \u201cneutrality\u201d or \u201ccard check\u201d agreement negotiated by parent company Freightliner.<\/p>\n<p>The UAW union\u2019s controversial recognition as the monopoly representative of the facility\u2019s workers has been in dispute since last year.  NLRB prosecutors, based in Winston-Salem, agreed with employees\u2019 contentions that union and company officials jointly conducted unlawful mandatory pro-union \u201ccaptive audience speeches\u201d to coerce the plant\u2019s workers to sign union recognition cards.  They also found that the \u201ccard check\u201d agreement involved unlawful premature bargaining over substantive terms of employment.<\/p>\n<p>\u201cThis victory is an encouraging step towards holding union officials across the country accountable for trampling workers\u2019 rights under abusive \u2018card check\u2019 schemes,\u201d said Foundation Vice President <a href=\"mailto:shg@nrtw.org\">Stefan Gleason<\/a>.  <\/p>\n<p>\u201cBut the UAW hierarchy is only cutting its losses at Thomas Built in the hopes of keeping their illegal \u2018neutrality\u2019 and \u2018card check\u2019 agreement alive so that they can continue to coerce workers at other Freightliner facilities into union ranks.\u201d <\/p>\n<p>Bowing to pressure brought by UAW union operatives, Freightliner-Daimler Chrysler signed the so-called \u201cneutrality agreement\u201d that includes a prohibition of the traditional and less-abusive secret ballot election process.  The company instead agreed to recognize the union on the basis of a majority of employees signing union authorization cards.
