{"id":2404,"date":"2005-03-30T00:00:00","date_gmt":"2005-03-30T00:00:00","guid":{"rendered":""},"modified":"2016-08-09T18:26:02","modified_gmt":"2016-08-09T18:26:02","slug":"ups-workers-force-teamsters-union-local-to-refund-dues-unlawfully-seized-from-their-paychecks-0","status":"publish","type":"post","link":"https:\/\/www.nrtw.org\/es\/news\/ups-workers-force-teamsters-union-local-to-refund-dues-unlawfully-seized-from-their-paychecks-0\/","title":{"rendered":"UPS Workers Force Teamsters Union Local to Refund Dues Unlawfully Seized From Their Paychecks"},"content":{"rendered":"<p><strong>Jacksonville, FL (March 30,  2005)<\/strong> \u2013 National Right to Work Foundation attorneys today announced they are withdrawing charges in a case brought by local United Parcel Service (UPS) workers against Teamsters Union Local 385, after union officials belatedly refunded dues money unlawfully seized from workers\u2019 paychecks. <\/p>\n<p>Upon receiving the reimbursement checks worth more than $2,500 combined, and written notice that union officials had finally accepted their resignations as required by law, the two workers withdrew their charge against the Teamsters union local.<\/p>\n<p>Johnny Bass and Kenneth Johnson obtained free legal assistance from National Right to Work Legal Defense Foundation attorneys and filed the charges in November of 2004 with the National Labor Relations Board (NLRB) after union officials repeatedly refused to accept employees\u2019 resignations from the union and continued to deduct full union dues from their paychecks.<\/p>\n<p>The employees alleged that the Teamsters union\u2019s practices were part of a pattern of discrimination against similarly situated employees who wish to exercise their rights to refrain from union membership.  <\/p>\n<p>\u201cUnion officials want workers like these simply to shut up and pay up,\u201d said <a href=\"mailto:shg@nrtw.org\">Stefan Gleason<\/a>, Vice President of the National Right to Work Foundation.  \u201cFor the Teamsters officials, it\u2019s all about the money \u2013 regardless of whether workers want anything to do with the union.\u201d<\/p>\n<p>The actions of Teamsters officials\u2019 actions violated employee rights explicitly recognized under the U.S. Supreme Court <a href=\"\/foundation-won.htm#PatternMakers\"><i>Pattern Makers v. NLRB<\/i><\/a> decision.  Under <i>Pattern Makers<\/i> and subsequent NLRB rulings, union officials are obligated to honor immediately the resignations of employees from union membership at any time.<\/p>\n<p>Additionally, Teamsters officials\u2019 actions violated the spirit of Florida\u2019s highly-popular Right to Work law, on the books since 1968, which prevents workers from having to join or pay dues to an unwanted union. <\/p>\n<p>\u201cUnfortunately, even in states like Florida where Right to Work protections exist, workers continue to face the heavy-handed tactics of union officials,\u201d said Gleason.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Jacksonville, FL (March 30, 2005) \u2013 National Right to Work Foundation attorneys today announced they are withdrawing charges in a case brought by local United Parcel Service (UPS) workers against Teamsters Union Local 385, after union officials belatedly refunded dues money unlawfully seized from workers\u2019 paychecks.
