{"id":14893,"date":"2022-05-26T04:00:07","date_gmt":"2022-05-26T08:00:07","guid":{"rendered":"https:\/\/www.nrtw.org\/?p=14893"},"modified":"2022-05-27T14:56:09","modified_gmt":"2022-05-27T18:56:09","slug":"red-rock-casino-card-check-05262022","status":"publish","type":"post","link":"https:\/\/www.nrtw.org\/es\/newsletter-articles\/red-rock-casino-card-check-05262022\/","title":{"rendered":"Casino Worker Challenges Order Installing Unwanted Union via \u2018Card Check\u2019"},"content":{"rendered":"<p>LAS VEGAS, NV \u2013 A large<br \/>\nmajority of the workers at Red Rock<br \/>\nCasino in Las Vegas, Nevada voted<br \/>\n\u201cno\u201d to unionization, but a federal<br \/>\ndistrict court judge ordered their<br \/>\nemployer to bargain with union<br \/>\nofficials anyway. Casino officials<br \/>\nappealed, and Red Rock employee<br \/>\nRaynell Teske supported their efforts<br \/>\nto overturn the judge\u2019s coercive order<br \/>\nthat overrides the choice workers<br \/>\nmade at the ballot box.<br \/>\nWith free Foundation legal aid,<br \/>\nTeske filed a brief arguing that the<br \/>\ndistrict judge had no reason to<br \/>\nimpose a union onto workers who<br \/>\nhad already soundly voted to reject<br \/>\nit. A Ninth Circuit panel denied the<br \/>\ninitial appeal, but issued an unusual<br \/>\nconcurring opinion in which all<br \/>\nthree judges said they disagreed with<br \/>\nthat outcome, but were bound by<br \/>\nNinth Circuit precedent to uphold<br \/>\nthe district judge\u2019s order.<br \/>\nBinding precedent can only be<br \/>\noverturned through an en banc<br \/>\nhearing before a larger Ninth Circuit<br \/>\npanel. Red Rock lawyers filed for an<br \/>\nen banc rehearing of their appeal.The<br \/>\ncourt then ordered National Labor<br \/>\nRelations Board (NLRB) lawyers<br \/>\ndefending the order to respond,<br \/>\nanother signal the judges may be<br \/>\nwilling to overturn this ridiculous<br \/>\nprecedent and rule in the workers\u2019<br \/>\nfavor. Teske filed a second amicus<br \/>\nbrief, urging the court to hear the<br \/>\ncase en banc.<br \/>\nJudge Overrides Workers\u2019<br \/>\nVote Against Union<br \/>\n\u2018Representation\u2019<br \/>\nThe situation at Red Rock began in<br \/>\nDecember 2019, when the NLRB held<br \/>\na secret-ballot election on whether<br \/>\nto unionize the Casino\u2019s workers.<br \/>\nEmployees rejected union officials\u2019<br \/>\neffort to become their monopoly<br \/>\nbargaining \u201crepresentatives\u201d in an<br \/>\nNLRB-supervised vote by a nearly<br \/>\n100-vote margin. Despite that<br \/>\noutcome, NLRB Region 28 Director<br \/>\nCornele Overstreet sought a federal<br \/>\ncourt injunction imposing the union<br \/>\nover the workers\u2019 objections.<br \/>\nOn July 20, 2021, District Judge<br \/>\nGloria Navarro agreed with the<br \/>\nNLRB Director\u2019s request, and<br \/>\nordered Red Rock to bargain with<br \/>\nunion officials despite the employees\u2019<br \/>\nvote against unionization. The judge<br \/>\nsaid the order was justified because<br \/>\nunion officials claimed that, before<br \/>\nthe vote, a majority of workers had<br \/>\nsigned union authorization cards.<br \/>\nTeske\u2019s amicus briefs argue those<br \/>\n\u201cCard Check\u201d signatures don\u2019t prove<br \/>\nthat union officials ever had majority<br \/>\nsupport. She contends the level of<br \/>\nunion support was tested fairly by<br \/>\nthe secret-ballot election, in which<br \/>\nworkers voted 627-534 against<br \/>\nunionization.<br \/>\nHer briefs point out that the<br \/>\nNLRB and federal courts have long<br \/>\nrecognized that secret ballots are a<br \/>\nmore reliable way of gauging worker<br \/>\nsupport for a union, because workers<br \/>\nare often pressured, harassed, or<br \/>\nmisled by union organizers into<br \/>\nsigning cards.<br \/>\nUnions officials know that Card<br \/>\nCheck signatures do not indicate<br \/>\nsolid worker support. The AFL-CIO<br \/>\nadmitted in its internal organizing<br \/>\nhandbook that it needed at least 75%<br \/>\nCard Check support before having<br \/>\neven a 50-50 chance of winning a<br \/>\nsecret-ballot election. Union bosses<br \/>\nprefer Card Check unionization<br \/>\nbecause they can more easily take<br \/>\ncontrol of workplaces where they<br \/>\nlack popular support, and partisan<br \/>\nNLRB appointees now are working<br \/>\nto grant their wish.<br \/>\nPartisan NLRB Pushes<br \/>\nUnreliable \u2018Card Check\u2019<br \/>\nPast legislative attempts to enact<br \/>\nCard Check unionization, including<br \/>\nthe so-called \u201cPRO Act,\u201d pending<br \/>\nin the U.S. Senate right now, faced<br \/>\nbipartisan opposition. However,<br \/>\nNLRB General Counsel Jennifer<br \/>\nAbruzzo, a former high-ranking<br \/>\nunion lawyer, believes she can<br \/>\nimplement Card Check without<br \/>\ncongressional approval.
