Cincinnati, OH (September 10, 2019)<\/strong> \u2013 A school bus driver for the Ripley Union Lewis Huntington School District has filed a federal lawsuit against the Ohio Association of Public School Employees (OAPSE) after union officials ordered the school district to seize union dues from her paycheck in violation of her First Amendment rights. The lawsuit was filed in the U.S. District Court for the Southern District of Ohio with free legal aid from National Right to Work Legal Defense Foundation staff attorneys.<\/p>\nAccording to Donna Fizer\u2019s complaint, in September 2018 she notified school board officials that she was \u201cimmediately withdrawing [her union] membership\u201d and exercising her rights under the Foundation-won Janus v. AFSCME<\/i> Supreme Court decision to cut off union dues deductions. Janus, which the High Court issued in June 2018, mandates that no public employee can be required to pay union fees as a condition of employment, and that union fees can only be collected from a public employee with an \u201caffirmative and knowing\u201d waiver of his or her First Amendment rights.<\/p>\n
The school district treasurer, following Janus<\/i>, ceased deductions from Fizer\u2019s paycheck shortly after receiving her request. However, OAPSE union bosses quickly countered by filing a grievance which alleged that Fizer did not submit her revocation within a tiny, union-created \u201cescape period\u201d that occurs only 10 days every few years. OAPSE officials demanded in the grievance that the school district continue to seize fees from Fizer as well as \u201cmake OAPSE whole for all lost dues.\u201d<\/p>\n
Though the district initially rebuffed the union\u2019s request and responded that \u201cthe district will honor the Supreme Court \u2018Janus Decision,\u2019\u201d later arbitration proceedings between the district and OAPSE came down in favor of the union and upheld enforcement of the narrow \u201cescape period.\u201d<\/p>\n
Now, Foundation staff attorneys representing Fizer are taking the battle to federal court, where they argue that \u201cescape periods\u201d impose an illegal hindrance on public employees\u2019 ability to exercise their First Amendment rights under Janus<\/i>.<\/p>\n
\u201cContrary to the wishes of union bosses, their concocted \u2018escape period\u2019 schemes cannot limit public employees\u2019 First Amendment rights to just a few days every few years,\u201d commented National Right to Work Foundation President Mark Mix. \u201cOAPSE union officials are ignoring the Janus<\/i> decision so they can greedily continue siphoning off Fizer\u2019s hard-earned money.\u201d<\/p>\n
