{"id":11404,"date":"2019-07-26T14:36:12","date_gmt":"2019-07-26T19:36:12","guid":{"rendered":"\/?p=11404"},"modified":"2019-07-26T15:00:25","modified_gmt":"2019-07-26T20:00:25","slug":"nmb-decert-rule-07262019","status":"publish","type":"post","link":"https:\/\/www.nrtw.org\/es\/news\/nmb-decert-rule-07262019\/","title":{"rendered":"National Mediation Board Issues Foundation-Advocated &#8216;Commonsense Reform&#8217; to Union Decertification Rules"},"content":{"rendered":"<p>Today the National Mediation Board (NMB) issued its <a href=\"https:\/\/nmb.gov\/NMB_Application\/index.php\/press-releases\/final-rule-to-simplify-decertification\/\">final rule<\/a> simplifying the process workers under the Railway Labor Act can use to decertify a union they oppose. National Right to Work Legal Defense Foundation President Mark Mix issued the following comment regarding the rule change:<\/p>\n<blockquote><p>At long last the National Mediation Board is providing airline and railroad workers covered by the Railway Labor Act a straightforward way to remove unwanted union \u00abrepresentation\u00bb through a decertification vote.<\/p>\n<p>The previous system \u2013 where workers had to create a \u00abstraw man\u00bb union just to challenge an incumbent union \u2013 only served to stymie workers\u2019 rights and demonstrated the historic bias of the NMB in favor of compulsory unionism. In fact, it wasn\u2019t until the Foundation-won case of Russell v. NMB in 1983 that workers even had an established legal right to throw off their union \u201crepresentative,\u201d albeit only through the unnecessarily complicated strawman system which is now finally being replaced with a simplified process to allow workers to exercise that right.<\/p>\n<p>The Foundation has long advocated this type of change in the union decertification process and we are pleased the NMB has &#8211; as we called upon it to do in comments filed earlier this year &#8211; finally made this commonsense reform.<\/p><\/blockquote>\n<p>The full rule can be read <a href=\"https:\/\/www.federalregister.gov\/documents\/2019\/07\/26\/2019-15926\/decertification-of-representatives\">here<\/a>.<\/p>\n<p>In April the Foundation <a href=\"https:\/\/nrtw.org\/news\/worker-advocate-urges-federal-labor-board-to-simplify-process-for-workers-to-vote-out-union-representation\/\">submitted formal comments<\/a> during the NMB\u2019s rulemaking procedure.
