Detroit Board of Education<\/I>, 431 U.S. 209 (1977)<\/A>, a Foundation-supported<br \/>\nlawsuit, makes clear that you cannot constitutionally be prevented from<br \/>\nresigning from your union at any time. Some states, but not all, also have<br \/>\nstatutes that guarantee public employees the right to resign. <\/p>\n<p>If you work in a <a href=\"\/rtws.htm\">Right to Work state<\/a>, or neither<br \/>\nstate law nor the contract between your employer and the union contains<br \/>\na provision requiring you to join the union or pay union fees, after resigning,<br \/>\nyou would have no obligations whatsoever to the union. (However, if you<br \/>\nhave signed a dues deduction authorization, that authorization may contain<br \/>\na limitation on when it can be revoked.) <\/p>\n<p>If you work in a non-Right to Work state and state law or the contract<br \/>\ndoes contain a provision requiring you to join the union or pay union fees,<br \/>\nafter resigning you would still have to pay union fees (generally called<br \/>\n&quot;agency fees&quot;). <\/p>\n<p>As a nonmember, you would have a right to object to the amount of the agency<br \/>\nfees and obtain a reduction of your compulsory payments so that they do<br \/>\nnot include the part of dues that is used for purposes other than collective<br \/>\nbargaining, contract administration, and grievance adjustment. <\/p>\n<p>The decision to resign is yours alone. In addition to the reduction in<br \/>\nyour financial obligations to the union, as a nonmember you would not be<br \/>\nsubject to union rules and discipline. The union would have to continue<br \/>\nto represent you fairly and without discrimination in all matters subject<br \/>\nto collective bargaining, and you could not be denied any benefits under<br \/>\nthe labor contract with your employer because of nonmembership. <\/p>\n<p>On the other hand, you would not have the right to vote on ratification<br \/>\nof the contract or election of union officers, and there may be benefits<br \/>\nprovided under the union&#8217;s constitution or bylaws that are not available<br \/>\nto nonmembers (however, a nonmember cannot be charged a share of the costs<br \/>\nof member-only benefits). <\/p>\n<p>If you would like to see a sample union resignation letter for a Right<br \/>\nto Work state, or where neither state law nor the contract requires you<br \/>\nto join the union or pay union fees, <A HREF=\"\/a\/RTWresignPub.htm\">click<br \/>\nhere<\/A>. You should check your union&#8217;s constitution and bylaws to see if<br \/>\nit specifies to whom a resignation must be sent. <\/p>\n<p>Although you may wish to include in your objection letter the line that<br \/>\nsays your objection is continuing and permanent, some unions will not honor<br \/>\nthis and will make you annually renew your objections.
