Employment relations for employees in the railway and airline<br \/>\nindustries are covered by the <A HREF=\"http:\/\/www4.law.cornell.edu\/uscode\/45\/151.shtml\">Railway<br \/>\nLabor Act (RLA)<\/A>. Railway and airline employees are not protected by<br \/>\nstate Right to Work laws. <\/p>\n<p>Under the RLA, you cannot be required to be a member of a union or pay<br \/>\nit any monies as a condition of employment unless the collective bargaining<br \/>\nagreement between your employer and your union contains a provision requiring<br \/>\nall employees to either join the union or pay union fees. <\/p>\n<p>Even if there is such a provision in the agreement, the most that can be<br \/>\nrequired of you is to pay the union fees (generally called an &quot;agency<br \/>\nfee.&quot;) <\/p>\n<p>If you are not a member, you are still fully covered by the collective<br \/>\nbargaining agreement that was negotiated between your employer and the<br \/>\nunion, and the union is obligated to represent you.  Any benefits that are<br \/>\nprovided to you by your employer pursuant to the collective bargaining<br \/>\nagreement (e.g., wages, seniority, vacations, pensions, health insurance)<br \/>\nare not affected by your nonmembership. (If the union offers some<br \/>\n\u00abmembers-only\u00bb benefits, you might be excluded from receiving those.)<\/p>\n<p>If you are not a member, you may not be able to participate in union<br \/>\nelections or meetings, vote in collective bargaining ratification<br \/>\nelections, or participate in other \u00abinternal\u00bb union activities.  However,<br \/>\nyou cannot be disciplined by the union for anything you do while not a member.<\/p>\n<p>The Supreme Court, in <A HREF=\"http:\/\/caselaw.findlaw.com\/cgi-bin\/getcase.pl?court=US&#038;vol=466&#038;invol=435\"><I>Ellis<br \/>\nv. BRAC,<\/I> 466 U.S. 435 (1984)<\/A>, a lawsuit that was supported by the<br \/>\nFoundation, ruled that objecting nonmembers cannot be required to pay union<br \/>\ndues. The most that nonmembers can be required to pay is an agency fee that<br \/>\nequals their share of what the union can prove is its costs of collective<br \/>\nbargaining, contract administration, and grievance adjustment with their<br \/>\nemployer. <\/p>\n<p>Except in extraordinary cases, the union&#8217;s costs of collective bargaining,<br \/>\ncontract administration, and grievance adjustment do not equal the dues<br \/>\namount. <\/p>\n<p><I>Ellis<\/I> makes clear that nonmembers required to pay union fees as<br \/>\na condition of employment have a right under the RLA to object and obtain<br \/>\na reduction of their compulsory payments so that they do not include union<br \/>\nexpenses for purposes other than collective bargaining, contract administration,<br \/>\nand grievance adjustment. <\/p>\n<p>The union must establish certain procedures to safeguard your<br \/>\nright to pay only a limited fee to the union. These safeguards include giving<br \/>\nyou: <\/p>\n<p><UL><br \/>\n<LI>audited financial information about how the amount of the agency fee<br \/>\n  was calculated; <\/LI><br \/>\n<LI>an opportunity to challenge the amount of the agency fee before an impartial<br \/>\n  decisionmaker; and, <\/LI><br \/>\n<LI>the right to place the contested amount of the agency fee in escrow<br \/>\n  so that the union will not be able to illegally use your money while a<br \/>\n  decision on the proper amount of the agency fee is pending. <\/LI><br \/>\n<\/UL><\/p>\n<p>Your right to proper safeguards is based upon <A HREF=\"http:\/\/caselaw.findlaw.com\/cgi-bin\/getcase.pl?court=US&#038;vol=475&#038;invol=292\"><I>Chicago<br \/>\nTeachers Union v. Hudson, <\/I>475 U.S. 292 (1986)<\/A>, another lawsuit that<br \/>\nwas supported by the Foundation.
