To learn how to<br \/>\nbecome a non-member, <a href=\"\/a\/a_3_t.htm\">click here<\/a>.]<\/small><\/p>\n<p>If you work in a Right to Work state, you not only have the right to refrain<br \/>\nfrom becoming a union member, you cannot be required to pay anything to<br \/>\nthe union unless you choose to join the union. <\/p>\n<p>If you wish to see a list of the 22 Right to Work States, <A HREF=\"..\/rtws.htm\">click<br \/>\nhere<\/A>. <\/p>\n<p>Educators in non-Right to Work states who are required to pay union dues or fees of a condition of employment have the right to cut off the portion<br \/>\nof their dues used for political and other non-bargaining activities. As<br \/>\na result of <A HREF=\"http:\/\/caselaw.findlaw.com\/cgi-bin\/getcase.pl?court=US&#038;vol=431&#038;invol=209\"><I>Abood<br \/>\nv. Detroit Board of Education<\/I>, 431 U.S. 209 (1977)<\/A>, a lawsuit that<br \/>\nwas supported by the Foundation, educators cannot be required to do more<br \/>\nthan pay a union fee (typically called an &quot;agency fee&quot;) that equals<br \/>\ntheir share of what the union can prove is its costs of collective bargaining,<br \/>\ncontract administration, and grievance adjustment. <\/p>\n<p>Except in extraordinary cases, the union&#8217;s costs of collective bargaining,<br \/>\ncontract administration, and grievance adjustment do not equal the dues<br \/>\namount. <\/p>\n<p>If you are a nonmember, you have a right to object and obtain a reduction<br \/>\nof your compulsory agency fee payments so that they do not include the part<br \/>\nof dues that is used for purposes other than collective bargaining and contract<br \/>\nadministration. <\/p>\n<p>The employer and the union must establish certain procedures to safeguard<br \/>\nyour right to pay only a limited fee to the union. These safeguards include<br \/>\ngiving you: <\/p>\n<p>  *   Audited financial information about how the amount of the agency fee<br \/>\n  was calculated;<br \/>\n  *   An opportunity to challenge the amount of the agency fee before an impartial<br \/>\n  decisionmaker and make the union prove its fee claim; and, <\/p>\n<p>  *   The right to place the contested amount of the agency fee in escrow<br \/>\n  so that the union will not be able to illegally use your money while a<br \/>\n  decision on the proper amount of the agency fee is pending. <\/p>\n<p>Your right to proper safeguards is based upon <A HREF=\"http:\/\/caselaw.findlaw.com\/cgi-bin\/getcase.pl?court=US&#038;vol=475&#038;invol=292\"><I>Chicago<br \/>\nTeachers Union v. Hudson,<\/I> 475 U.S. 292 (1986)<\/A>, another lawsuit that<br \/>\nwas supported by the Foundation. <\/p>\n<p>In <A HREF=\"http:\/\/caselaw.findlaw.com\/cgi-bin\/getcase.pl?court=US&#038;vol=500&#038;invol=507\"><I>Lehnert<br \/>\nv. Ferris Faculty Association, <\/I>500 U.S. 507 (1991)<\/A>, another Foundation-supported<br \/>\nlawsuit, the Supreme Court discussed the type of expenses which are chargeable<br \/>\nand which are not chargeable to nonmember teachers. <\/p>\n<p>If you would like to get an idea of the types of union expenses which are<br \/>\nnot chargeable to nonmembers, <A HREF=\"..\/nce.htm\">click here<\/A>. <\/p>\n<p>If you are a non-member in a non-Right to Work state where state law or the contract<br \/>\nrequires you to pay union fees and would<br \/>\nlike to see a sample objection letter that will allow you to keep part of<br \/>\nthe money that you have been sending to the union, <A HREF=\"a_4_t_a.htm\">click<br \/>\nhere<\/A>.
