Personnel <br \/>\nChapter 20. Public Employment Relations (Collective Bargaining)<\/b><o:p><\/o:p>\n<\/p>\n<div align=\"left\">\n<\/div>\n<div align=\"left\">\n<\/div>\n<div align=\"left\">\n<b>\u00a7 20.8. Public employee rights<\/b>\n<\/div>\n<p class=\"MsoNormal\" align=\"left\">\nPublic employees shall have the right to:\n<\/p>\n<div align=\"left\">\n1. Organize, or form, join, or assist any employee organization.\n<\/div>\n<div align=\"left\">\n\u00a0\n<\/div>\n<div align=\"left\">\n<\/div>\n<div align=\"left\">\n2. Negotiate collectively through representatives of their own choosing.\n<\/div>\n<div align=\"left\">\n\u00a0\n<\/div>\n<div align=\"left\">\n<\/div>\n<div align=\"left\">\n3. Engage in other concerted activities for the purpose of collective<br \/>\nbargaining or other mutual aid or protection insofar as any such activity is<br \/>\nnot prohibited by this chapter or any other law of the state.\n<\/div>\n<p class=\"MsoNormal\" align=\"left\">\n4. Refuse to join or participate in the activities of employee organizations,<br \/>\nincluding the payment of any dues, fees or assessments or service fees of any<br \/>\ntype. (Enacted 1974.)<o:p><\/o:p>\n<\/p>\n<div align=\"left\">\n<\/div>\n<div align=\"left\">\n<\/div>\n<div align=\"left\">\n<\/div>\n<p class=\"MsoNormal\" align=\"left\">\n<b>\u00a7 20.10. Prohibited practices<\/b><br \/>\n. . . .\n<\/p>\n<div align=\"left\">\n2. It shall be a prohibited practice for a public employer or the employer&#8217;s<br \/>\ndesignated representative willfully to:<\/p>\n<p>a. Interfere with, restrain or coerce public employees in the exercise of<br \/>\nrights granted by this chapter.\n<\/div>\n<p class=\"MsoNormal\" align=\"left\">\n. . . .<o:p><\/o:p>\n<\/p>\n<div align=\"left\">\nc. Encourage or discourage membership in any employee organization, committee<br \/>\nor association by discrimination in hiring, tenure, or other terms or<br \/>\nconditions of employment.<o:p><\/o:p>\n<\/div>\n<div align=\"left\">\n<\/div>\n<p class=\"MsoNormal\" align=\"left\">\n. . . .\n<\/p>\n<div align=\"left\">\n3. It shall be a prohibited practice for public employees or an employee<br \/>\norganization or for any person, union or organization or their agents willfully<br \/>\nto:<\/p>\n<p>a. Interfere with, restrain, coerce or harass any public employee with respect<br \/>\nto any of the employee&#8217;s rights under this chapter or in order to prevent or<br \/>\ndiscourage the employee&#8217;s exercise of any such right, including, without<br \/>\nlimitation, all rights under section 20.8. (Enacted 1974.)<o:p><\/o:p>\n<\/div>\n<div align=\"left\">\n<\/div>\n<div align=\"left\">\n<\/div>\n<div align=\"left\">\n<\/div>\n<p class=\"MsoNormal\" align=\"center\">\n<b>Title XVI. Criminal Law and Procedure<o:p><\/o:p><br \/>\nSubtitle 1. Crime Control and Criminal Acts<o:p><\/o:p><\/b><b><br \/>\nChapter 731. Labor Union Membership <o:p><\/o:p><\/b>\n<\/p>\n<div align=\"left\">\n<\/div>\n<div align=\"left\">\n<b><o:p><\/o:p><\/b>\n<\/div>\n<div align=\"left\">\n<b> <\/b>\n<\/div>\n<div align=\"left\">\n<b>\u00a7 731.1 Right to join union<\/b>\n<\/div>\n<p><\/center><\/p>\n<p>\nIt is declared to be the policy of the state of Iowa that no person within its boundaries shall be deprived of the right to work at his chosen occupation for any employer because of membership in, affiliation with, withdrawal or expulsion from, or refusal to join, any labor union, organization, or association, and any contract which contravenes this policy is illegal and void. (Enacted April 28, 1947; Recodified 1977.)\n<\/p>\n<p>\n<b>\u00a7 731.2 Refusal to employ prohibited<\/b>\n<\/p>\n<p>\nIt shall be unlawful for any person, firm, association or corporation to refuse or deny employment to any person because of membership in, or affiliation with, or resignation or withdrawal from, a labor union, organization or association, or because of refusal to join or affiliate with a labor union, organization or association. (Enacted April 28, 1947; Recodified 1977.)\n<\/p>\n<p>\n<b>\u00a7 731.3 Contracts to exclude unlawful<\/b>\n<\/p>\n<p>\nIt shall be unlawful for any person, firm, association, corporation or labor organization to enter into any understanding, contract, or agreement, whether written or oral, to exclude from employment members of a labor union, organization or association, or persons who do not belong to, or who refuse to join, a labor union, organization or association, or because of resignation or withdrawal therefrom. (Enacted April 28, 1947; Recodified 1977.)\n<\/p>\n<p>\n<b>\u00a7 731.4 Union dues as prerequisite to employment-prohibited<\/b>\n<\/p>\n<p>\nIt shall be unlawful for any person, firm, association, labor organization or corporation, or political subdivision, either directly or indirectly, or in any manner or by any means as a prerequisite to or a condition of employment to require any person to pay dues, charges, fees, contributions, fines or assessments to any labor union, labor association or labor organization. (Enacted April 28, 1947; Recodified 1977.)\n<\/p>\n<p>\n<b>\u00a7 731.5 Deducting dues from pay unlawful<\/b>\n<\/p>\n<p>\nIt shall be unlawful for any person, firm, association, labor organization or corporation to deduct labor organization dues, charges, fees, contributions, fines or assessments from an employee&#8217;s earnings, wages or compensation, unless the employer has first been presented with an individual written order therefor signed by the employee, which written order shall be terminable at any time by the employee giving at least thirty days&#8217; written notice of such termination to the employer. (Enacted April 28, 1947; Amended 1959, Recodified 1977.)\n<\/p>\n<p>\n<b>\u00a7 731.6 Penalty<\/b>\n<\/p>\n<p>\nAny person, firm, association, labor organization, or corporation or any director, officer, representative, agent or member thereof, who shall violate any of the provisions of this chapter or who shall aid and abet in such violation shall be guilty of a serious misdemeanor. (Enacted April 28, 1947; Recodified 1977, Amended 1978.)\n<\/p>\n<p>\n<b>\u00a7 731.7 Injunction<\/b>\n<\/p>\n<p>\nAdditional to the penal provisions of this chapter, any person, firm, corporation, association, or any labor union, labor association or labor organization, or any officer representative, agent or member thereof may be restrained by injunction from doing or continuing to do any of the matters and things prohibited by this chapter, and all of the provisions of the law relating to the granting of restraining orders and injunctions, either temporary or permanent, shall be applicable. (Enacted April 28, 1947; Recodified 1977.)\n<\/p>\n<p>\n<b>\u00a7 731.8 Exception<\/b>\n<\/p>\n<p>\nThe provisions of this chapter shall not apply to employers or employees covered by the federal <a href=\"http:\/\/www4.law.cornell.edu\/uscode\/45\/151.shtml\">Railroad Labor Act<\/a> [sic].
