{"id":1182,"date":"2007-11-13T17:55:32","date_gmt":"2007-11-13T17:55:32","guid":{"rendered":""},"modified":"2023-12-03T18:02:28","modified_gmt":"2023-12-03T23:02:28","slug":"decertification-under-the-railway-labor-act","status":"publish","type":"page","link":"https:\/\/www.nrtw.org\/es\/decertification-under-the-railway-labor-act\/","title":{"rendered":"La decertificaci\u00f3n seg\u00fan la Ley de Trabajo en Ferrocarriles"},"content":{"rendered":"<p><a href=\"\/decertification-under-the-railway-labor-act\">[In English]<\/a><\/p>\n<p>Seg\u00fan la Ley Laboral de Ferrocarriles (RLA por sus siglas en ingl\u00e9s), no hay ning\u00fan procedimiento por el cual los empleados puedan simplemente deshacerse de la cl\u00e1usula de sindicalismo forzoso del contrato entre el sindicato y su patrono. Sin embargo, los empleados de las aerol\u00edneas y ferrocarriles pueden \u201cdecertificar\u201d una uni\u00f3n y eliminar de su lugar de trabajo la representaci\u00f3n sindical monopolizada y la cl\u00e1usula de sindicalismo forzoso. El proceso de decertificaci\u00f3n fue optimizado por unas reglas nuevas emitidas el 26 de julio de 2019 por el Consejo Nacional de Arbitraje (NMB por sus siglas en ingl\u00e9s), la agencia federal que supervisa elecciones bajo el RLA. Empleados que ya no quieren ser representados pueden gestionar la decertificaci\u00f3n del representante actual de un oficio o clase mediante una elecci\u00f3n directa. Los empleados tienen que seguir el procedimiento establecido en \u00a7 1203.2.\u201d<\/p>\n<p>As\u00ed, empleados de las aerol\u00edneas y ferrocarriles en un \u201coficio o clase\u201d tienen el derecho de expulsar a su uni\u00f3n como agente exclusivo de negociaciones si: (1) una mayor\u00eda de los empleados en un \u201coficio o clase\u201d firma tarjetas de autorizaci\u00f3n las cuales digan claramente que ellos est\u00e1n opuestos a la representaci\u00f3n de la uni\u00f3n; (2) un empleado-peticionario radica una solicitud para la \u201cInvestigaci\u00f3n de Disputa Representativa\u201d ante el NMB; y (3) una mayor\u00eda de los votantes vota en contra de la uni\u00f3n cuando el NMB lleve al cabo la elecci\u00f3n por voto secreto.<\/p>\n<p>Tarjetas de autorizaci\u00f3n: Una tarjeta de autorizaci\u00f3n es una tarjeta o documento firmado por un empleado declarando que el empleado desea a ser representado por una organizaci\u00f3n o individuo para prop\u00f3sitos de negociaciones colectivas, o que se opone a la representaci\u00f3n de una organizaci\u00f3n o individuo.<\/p>\n<p>Seg\u00fan la p\u00e1gina web del NMB, las tarjetas de autorizaci\u00f3n tienen que incluir el nombre de la organizaci\u00f3n que representa (o busca a representar) al oficio o clase, e tienen que ser firmadas y fechadas por el empleado.
