Nurses Attack Backroom Deal Between Tenet and CNA To Force Texas Nurses Into Union Ranks

Right to Work attorneys hit union and hospital chain with federal unfair labor practice charges for statewide scheme to bypass employee protections

Houston, Texas (August 12, 2008) – Two registered nurses at Houston-based Tenet Healthcare medical centers have filed federal charges against the California Nurses Association (CNA) union and Tenet, after union officials and Tenet entered into agreements designed to force nurses into CNA union ranks.

Esther Marissa Cuellar, a nurse at Tenet’s Cypress Fairbanks location, and Linda D. Bertrand, a nurse at Tenet’s Park Plaza Medical Center, filed the unfair labor practice charges with the National Labor Relations Board (NLRB) Region 16 in Fort Worth, Texas with free legal assistance from National Right to Work Legal Defense Foundation staff attorneys.

The charges focus on a so-called “Election Procedures Agreement” (EPA) between Tenet officials and CNA union bosses designed to assist the CNA in corralling nurses into the union. The agreement affects Tenet locations across Texas. So far CNA organizers have obtained union monopoly bargaining power at Cypress Fairbanks, and they have campaigns underway at other Houston-area hospitals, including Park Plaza.

The nurses’ charges list multiple violations of employee rights, all designed to make it more difficult for nurses to resist unionization by the power hungry California union officials. The charges detail how the agreement signed by Tenet and CNA officials subverts the NLRB’s role in supervising union certification elections and bypasses employee protections. While eliminating NLRB oversight of election conduct, the agreement calls for the NLRB to merely count ballots and “certify” the union.

The unfair labor practice charges also detail unlawful organizing assistance given by Tenet to CNA organizers in violation of federal statutes and a 2008 U.S. Supreme Court ruling. Under the agreement, Tenet managers are gagged from responding to employee questions about unionization, and nurses who oppose the union have been forbidden from using any Tenet facilities to express their views. Yet pro-CNA nurses and non-employee union organizers are given broad access to Tenet facilities.

“California union militants, with the assistance of complicit Tenet officials, are attempting to sweep nurses across the state of Texas into union ranks, like it or not,” said Stefan Gleason, vice president of the National Right to Work Foundation. “What isn’t yet clear is exactly what Tenet received in exchange for helping union officials gain access to hundreds of thousands of dollars in union dues. If similar agreements elsewhere are any indication, CNA may have sold out the employees’ interests to become Tenet’s favored union.”

The charges, which will now be investigated by NLRB officials, also state that the EPA scheme amounts to illegal pre-recognition bargaining, with union officials negotiating substantive terms of employment for nurses before they have the legal authority to represent a single employee.

Worker Files Civil Damages Lawsuit for Massive Union Harassment Campaign

Union officials accused of conspiracy, forgery, and identity theft after bombarding dissenter with unwanted mail orders and subscriptions


Hartford, Connecticut (July 24, 2008)
– Today, National Right to Work Foundation staff attorneys are filing a state court lawsuit on behalf of a Connecticut resident who suffered from an ugly campaign of retaliation at the hands of area union officials. The suit alleges that union militants conspired to commit fraud and identity theft in order to bombard Patricia Pelletier with hundreds of mail-order magazines, violating her rights and sticking her with thousands of dollars in subscription and mail order fees.

Because Connecticut lacks a Right to Work law, Pelletier was forced to pay dues to the Communication Workers of America (CWA) Local 1103, as well as accept the union’s workplace representation as a condition of employment. After becoming dissatisfied with the union’s presence, Pelletier initiated a decertification petition to eject the CWA from the workplace. In retaliation, CWA officials apparently conspired to forge Pelletier’s signature on numerous magazine subscriptions. Union militants are also accused of committing identity theft by illegally soliciting business information cards and signing up for advertiser information packages under Pelletier’s name.

These actions resulted in a flood of unwanted magazines and advertisements arriving daily at Pelletier’s doorstep. Not only was Pelletier forced to spend several hours each day canceling individual subscriptions, she was also billed for thousands of dollars by unwitting magazine companies, jeopardizing her credit rating. Pelletier still receives excess mail from a variety of journals and magazines, and her name continues to be circulated through advertiser mailing lists across the country.

In the 31-count suit to be filed today in Hartford Superior Court, Foundation staff attorneys allege that union officials committed identity theft, conspired to forge Pelletier’s signature, inflicted undue emotional distress on Pelletier and her family, and violated Connecticut’s Unfair Trade Practice Act by unlawfully retaliating against Pelletier for attempting to remove the union from her workplace. Foundation attorneys are now seeking damages in excess of $15,000 to compensate Pelletier for CWA union militants’ campaign of retaliation against her.

“Mrs. Pelletier’s plight demonstrates the vicious things union officials will do to punish workers who would rather do without a union,’” said Stefan Gleason, vice president of the National Right to Work Foundation. “Mrs. Pelletier is guilty of nothing more than helping her coworkers give an unwanted union the boot. Union Officials Forced to Agree to New Decertification Election after Workers Complained of Union Intimidation

California workers faced union threats, intimidation in an earlier bid to eject unwanted union from the workplace

Banning, California (July 11, 2008) – In response to objections filed by workers represented by the National Right to Work Foundation alleging union misconduct during a recent decertification election at Coastline Manufacturing, International Brotherhood of Painters and Allied Trades Local 636 union officials decided to save face rather than go through an embarrassing National Labor Relations Board (NLRB) hearing. Instead, they agreed to a new election to determine whether the union will retain its monopoly bargaining privileges.

After union officials unlawfully tampered with employees’ efforts to prove a majority didn’t want union representation, workers contacted the National Right to Work Foundation for free legal assistance. Employees at the glass manufacturing company then sought a union decertification election supervised by the NLRB to formally toss the International Brotherhood of Painters and Allied Trades local out of their workplace.

On May 19, a majority of workers voted to retain union representation, but the results were marred by union threats, intimidation, and other irregularities. Foundation staff attorneys filed official objections with the NLRB’s Regional Director, citing five union violations of federal labor election guidelines and asking for a new decertification election so that employees could freely express their preferences.

Workers reported that the union illegally tainted the election by installing a union official as a supposedly “neutral” election observer, threatening employees with financial penalties and employer confiscation of pension funds in the event of decertification, menacing workers with suggestions of lay-offs if the union were to be ejected, and threatening employees with disclosure of family members’ immigration status.

The NLRB Regional Director granted a hearing to resolve employees’ objections, but union officials apparently recognized the likelihood of an embarrassing loss and, at the 11th hour, decided to withdraw from the proceedings and instead agree to another federally-supervised decertification election.

“Union officials’ willingness to intimidate the very employees they are supposed to represent irreparably compromised the integrity of the decertification election,” said Stefan Gleason, vice president of the National Right to Work Foundation. “The union’s decision not to contest the workers’ charges clearly demonstrates the process was fatally flawed. We can only hope that this next election will fairly reflect employees’ preferences.”

Construction Workers File Charges against Union after Hit with $16,000 Fines for Nonunion Work

Right to Work attorneys file federal unfair labor practice charges for workers punished by union officials for trying to make a living

Sedro-Woolley, Washington (July 10, 2008) – With free legal aid from National Right to Work Foundation attorneys, two construction workers have filed unfair labor practice charges against the International Union of Operating Engineers Local 302 union for exorbitant and illegal $16,000 fines levied against them in an internal union kangaroo court – even though the workers were allegedly never voluntary union members.

Shane Davis and Chad Aldridge filed the charges with the National Labor Relations Board (NLRB) against IUOE Local 302 after union bosses declared them “guilty” of refusing to give up employment at TriMaxx Construction, a contractor whose employees had voted against unionization. Late last year, union bosses learned that Davis and Aldridge were earning paychecks from the nonunion firm and demanded that they quit their jobs. In February, after Davis and Aldridge refused to put themselves in the unemployment line and resigned from the union, the union hierarchy held its “trial” and levied the confiscatory fines of $16,728.40 each.

In NLRB v. General Motors (1963) and Communications Workers v. Beck (1988), the United States Supreme Court ruled that unions may force workers to pay certain fees as a condition of employment, but workers have the right to refrain from formal union membership. Employees who exercise the right to refrain from union membership cannot be subjected to internal union discipline. Unions have an obligation to tell workers about their General Motors and Beck rights, which Local 302 never did.

Davis and Aldridge claim that as involuntary members, they cannot be lawfully subjected to internal union discipline. They also claim that union officials would not have imposed such severe fines had they not resigned from union “membership.” It is illegal for unions to fine workers as retaliation for resigning.

“Criminals convicted of misdemeanors in the state of Washington can be socked with $5,000 fines,” said Stefan Gleason, vice president of the National Right to Work Foundation. “It is unconscionable that Local 302 union bosses would slam Shane Davis and Chad Aldridge with fines greater than three times that amount just for trying to earn an honest living.”

The NLRB Regional Office in Seattle will now investigate the charges and decide whether to issue a formal complaint and prosecute the union before an administrative law judge.

SEIU Union Officials Face Federal Prosecution for Illegal Threats against Non-Striking Nurses

Right to Work attorneys trigger prosecution after union bosses threatened Pomona Valley nurses with jail time for refusing to abandon patients

Los Angeles, California (July 3, 2008) – Federal labor board officials in Los Angeles will prosecute the Service Employees International Union (SEIU) Local 121RN for illegally threatening nurses at the Pomona Valley Hospital Medical Center with financial penalties and arrest for refusing to abandon their patients during a union-ordered strike.

Last October, SEIU officials ordered a general strike after the collective bargaining agreement between the union and the hospital expired, but many nurses refused to abandon their patients. To continue treating patients during the union-ordered strike without union retaliation, the nurses resigned from formal union membership. However, union bosses – citing an unenforceable California state law deterring “strikebreakers” (i.e. dutiful employees) – told the nurses that they could face stiff fines and even up to 90 days in jail if they did not join the strike. With free legal aid from National Right to Work Foundation attorneys, nurse Carole Jean Badertscher filed unfair labor practice charges with the National Labor Relations Board (NLRB).

When the NLRB Regional Director originally declined to prosecute the law-breaking SEIU bosses, Foundation attorneys filed an appeal with the NLRB’s General Counsel. The General Counsel determined that the Regional Director improperly dropped the case and ordered issuance of an unfair labor practice complaint against the abusive union hierarchy.

According to the complaint, union bosses illegally threatened nurses with arrest and jail under the invalid California law that is preempted by federal labor law. Additionally, the complaint alleges that union officials misled nurses by suggesting that non-member employees would continue to owe compulsory union dues even though no contract containing a valid forced-dues clause was in effect.

North Carolina AT&T Employees File Suit against Union Officials for Exposing Sensitive Personal Data

Union boss intimidation campaign against nonmember employees led to vindictive release of social security numbers

Burlington, NC (June 13, 2008) – National Right to Work Foundation attorneys have filed a lawsuit in North Carolina state court for 16 AT&T employees against Communication Workers of America (CWA) union officials for the illegal release of confidential personal information.

The complaint, filed late Wednesday in Gaston County, alleges widespread union violations of the North Carolina Identity Theft Protection Act by CWA union officials, who are accused of illegally posting nonunion employees’ personal information – including workers’ social security numbers – in a public area. The plaintiffs were also subjected to an extended union campaign of workplace harassment and intimidation.

Around November of 2007, union officials posted nonmember employees’ personal information. The spreadsheet that contained employees’ personal data was sent via e-mail from union official Judy Brown to other CWA officials with instructions to “. . . forward this information to your affected locals.” CWA officials proceeded to post the spreadsheet on a public bulletin board and likely disseminated the information through e-mail and other means.

By posting the information, union officials left employees vulnerable to identity theft and credit fraud. Foundation attorneys now seek a jury trial for the assessment of statutory and punitive damages.

North Carolina is one of 22 states with Right to Work protections that ensure employees are not forced to pay union dues as a condition of employment. At the time the notice was posted, all 16 plaintiffs had exercised their Right to Work and were not formal dues-paying union members. The employees believe their personal information was posted in retaliation for exercising their legal rights, and a recent National Labor Relations Board investigation substantiated these allegations.

The case highlights the fact that, even in Right to Work states, union officials have extraordinary power over nonmember employees who have been forced to accept a union’s “representation.” Union officials are able to dictate nonunion workers’ terms of employment and have access to employees’ private and confidential information.

“By releasing the personal and confidential information of employees who exercised their legal right, CWA union bosses were trying to send a message that workers who refuse to support the union will face retribution,” said Stefan Gleason, vice president of the National Right to Work Foundation.

Bush Labor Board Authorizes Congressmen to Issue Union “Certifications” Intended to Deceive Employees

Labor Subcommittee Chairman Congressman Rob Andrews (D-NJ) conducted televised sham union “certification” at union hall just days before the real vote

Atlantic City, NJ (June 3, 2008) – The National Labor Relations Board (NLRB) has issued a controversial and ground-breaking ruling that gives Congressmen and other public officials the green light to stage fake “certification” ceremonies that give the misimpression of official government recognition of a union during “card check” organizing drives.

The case dismissed objections to the conduct of Congressman Robert Andrews (D-NJ) and other government officials who participated in a televised sham union “certification” ceremony and public announcement that workers had selected a union immediately prior to a NLRB certification election last summer at the Trump Plaza Hotel in Atlantic City.

The NLRB’s ruling raised the burden of proof requirements for arguing that conduct tainted a certification election. Earlier Board law did not require challengers to present incontrovertible evidence that many employees were actually aware of the objectionable conduct – only that it was likely that many were.

In addition to filing a brief supporting Trump Plaza’s request that the Board set aside the election, the National Right to Work Legal Defense Foundation filed unfair labor practice charges and a House Ethics Committee complaint.

The Foundation’s unfair labor practice charge, which has been held in abeyance pending the appeal regarding certification, points out that Congressman Andrews led an extraordinary public event (which was televised and disseminated by other media) and aided UAW union officials in interfering with the free exercise of employee rights in choosing whether to unionize. “Acting under the false imprimatur of NLRB authority,” Andrews counted union authorization cards that were not necessarily intended by employees to be considered formal votes, and he signed and announced a “Certification of Majority Status” for unionization.

Andrews’s participation, given his position as Chairman of House of Representative’s subcommittee that oversees labor issues, made the union’s televised public announcement of its “certification” particularly problematic. Given his prominent role in the creation of federal labor policy, employees could think that the union had already been formally installed, or that the union’s election was a forgone conclusion. As the Foundation’s brief in the case pointed out, Andrew’s actions likely had the effects of suppressing turnout for the election, and inducing employees to vote for a “pre-certified” union, thus disenfranchising employees and destroying the “laboratory conditions” under which NLRB elections are required to take place.

“The Bush Labor Board has just opened the floodgates. Workers will be faced with union officials’ aggressive use of Members of Congress during coercive union organizing campaigns,” said Foundation vice president Stefan Gleason.

NLRB General Counsel Orders Prosecution of SEIU Union Officials for Illegally Threatening Non-Striking Nurses

Union bosses threatened Pomona Valley nurses with arrests, jail time, and financial penalties for refusing to abandon their patients

Los Angeles, California (May 27, 2008) – National Labor Relations Board (NLRB) General Counsel Ronald Meisburg has granted an appeal filed by National Right to Work Foundation attorneys for union-abused nurses at the Pomona Valley Hospital Medical Center. The federal government will now prosecute Service Employee International Union (SEIU) Local 121 RN union officials for threatening nurses with financial penalties and arrest for refusing to abandon their patients during a union-ordered strike.

In October of 2007, SEIU Local 121 RN officials ordered a general strike after the nurses’ collective bargaining agreement with the hospital expired. In an effort to intimidate nurses into toeing the union line, SEIU officials told nurses that refusal to strike could result in financial penalties or even arrest – citing an unenforceable California state law. Nurse Carole Jeane Badertscher, a non-union member, subsequently contacted the National Right to Work Foundation for free legal assistance and filed class action unfair labor practice charges with the NLRB Regional Director.

After the NLRB Regional Director declined to prosecute, Foundation attorneys filed an appeal with the NLRB’s General Counsel. Following a lengthy review process, the General Counsel found merit to the charges, determined that union officials violated the nurses’ legal rights.

An NLRB administrative law judge will now evaluate Ms. Badertscher’s twin charges: The first alleges SEIU union officials misled nurses by suggesting that nonunion employees would continue to owe compulsory union dues after the nurses’ collective bargaining agreement expired. The second alleges that SEIU officials illegally threatened nurses for refusing to participate in a union-ordered strike.

“It’s outrageous for union officials to suggest that nurses could be financially penalized or even sent to jail for continuing to care for their patients,” said Stefan Gleason, vice president of the National Right to Work Foundation. “While we’re pleased that SEIU bosses will be prosecuted for breaking the law, this type of abuse will continue until California employees have the protection of a Right to Work law that makes union membership and dues-payment strictly voluntary.”

Transit Union Slapped With Federal Labor Charges for Muscling Back into a Facility After Employees’ Revolt Forced it Out

**Batavia, IL (November 2, 2007)** – The bus company First Group, Inc. and the Amalgamated Transit Union (ATU) Local 1028 have been hit with federal labor board charges for illegally bargaining over employees who the union does not even represent. First Group employee Russell Haasch filed the charges at the National Labor Relations Board (NLRB) earlier this week with free legal assistance from National Right to Work Legal Defense Foundation attorneys.

As Haasch details in his charges, ATU union officials have been negotiating a contract with First Group, despite the fact that Haasch and his coworkers had successfully ousted the union earlier this year. According to First Group’s website, on October 1 the UK-based transit company completed the purchase of Haasch’s employer, Laidlaw Transit.

In Spring 2007, Haasch collected signatures from an overwhelming majority of his co-workers and in June presented the petition to their employer Laidlaw Transit, which legally and properly ended its recognition of the ATU union as the monopoly bargaining agent for the approximately 160 employees. Only recently did Haasch and his co-workers realize that their new employer, First Group, was negotiating a contract with ATU officials, despite the fact that the employees had successfully shown that the union did not have their support.

According to the National Labor Relations Act, by bargaining over the contracts of employees that the union does not legally represent, the union and First Group are engaging in illegal “pre-recognition” bargaining. As part of their negotiations, the union is once again seeking a forced-dues clause in the contract that makes payment of union dues a job requirement. Indeed, union officials have been given access to First Group facilities and are now demanding that employees pay union dues or be fired.

“Union officials and First Group management are illegally attempting to force this unpopular union down employees’ throats,” said Stefan Gleason, vice president of the National Right to Work Foundation. “With the lack of respect these union officials have for the employees, it is not surprising that workers rejected the union last June.”

The unfair labor practice charges ask the NLRB to seek an injunction to immediately stop First Group from continuing to negotiate a contract with the rogue ATU union and to cease all demands for union dues. The NLRB Regional Director will now investigate the charges and decide whether to prosecute the charges and seek injunctive relief.

Union Officials at Pomona Valley Hospital Illegally Threaten Non-striking Nurses with Arrest, Jail, and Fines

**Pomona, CA (October 31, 2007)** – A nurse at the Pomona Valley Hospital Medical Center has filed unfair labor practice charges against the Service Employees International Union (SEIU) Local 121RN after SEIU union officials illegally threatened her and her coworkers with jail and fines. The nurses wished to resign from formal union membership, cut off union dues, and continue working during any union-ordered strike.

The charges come after the collective bargaining contract at the hospital expired and after union officials ordered a five day strike during October.

In response to the intimidation, nurse Carole Jean Badertscher filed the class action charges at the National Labor Relations Board (NLRB) with free legal assistance from National Right to Work Legal Defense Foundation attorneys. The charges detail how union officials misled and threatened employees in violation of the nurses’ rights under federal labor law. The charges also cite that union officials violated their so-called “duty of fair representation,” which is intended to prevent union discrimination against employees.

In a particularly egregious violation of the employees’ rights, a top local union official threatened that nurses who defied the union’s strike order could be subject to fines and criminal penalties, including 90 days in jail. The California law referenced by union officials is clearly pre-empted by federal labor law establishing that workers can remain at their jobs and avoid all union disciplinary fines if they first resign from formal union membership.

Union officials also distributed a flier illegally misleading the nurses, claiming that the NLRB requires employees to continue paying compulsory union dues after the expiration of a contract. The flier told nurses that, when a new contract goes into effect, union officials could require all employees to pay “back dues,” implying that they could be fired if they didn’t pay.

“Union officials are shamelessly flouting federal law in an effort to intimidate these nurses into heeding the union’s unpopular demands to turn their backs on their patients,” said Stefan Gleason, vice president of the National Right to Work Foundation. “Unfortunately, in states like California where there is no Right to Work law prohibiting compulsory unionism, union officials face little accountability.”
