SEIU and Hospital Officials Hit With Federal Charges for Rigging Union Card Check 'Vote'
Union organizers enter into corrupt agreement with hospital to force healthcare workers into union ranks using coercive card check tactics
Orange, California (February 13, 2012) – A healthcare worker has filed federal charges against a major healthcare union and hospital officials for illegally rigging a union organizing "vote" and then forcing workers to accept an unwanted union in the workplace.
With free legal assistance from the National Right to Work Foundation, Marlene Felter of Costa Mesa filed the charges with the National Labor Relations Board (NLRB).
Service Employees International Union (SEIU) Healthcare Workers West union officials and Chapman Medical Center management entered into a backroom deal known as a so-called "neutrality agreement" designed to grease the skids for workers to be forced into union ranks.
In the agreement, company officials granted union operatives access to company facilities to conduct a coercive "card check" organizing campaign, and waived the right to have a federally-supervised secret ballot election to determine whether employees wished to be unionized. Union organizers frequently use "card check" organizing tactics to bribe, browbeat, or cajole workers into forced-union-dues payments against their will.
In response to the union's coercive tactics, a majority of hospital workers signed cards, letters, and petitions stating that they did not want the SEIU union bosses' so-called "representation." Instead of respecting the employees' wishes, Chapman officials accepted SEIU union officials as the workers' monopoly bargaining agents after a rigged "card count" was held. Chapman and SEIU officials are now negotiating a contract, which almost certainly will include a provision to force the workers to pay union dues or fees as a condition of employment because California does not have a Right to Work law that makes union membership and dues payment strictly voluntary.
The federal unfair labor practice charges ask for an injunction to stop hospital and SEIU officials from illegally negotiating a contract on the basis of the fraudulent "card check" union recognition because the union does not have majority support of the workforce.
"Chapman and SEIU officials have colluded to shove SEIU union bosses' 'representation' – and with it forced dues payments – down workers' throats," said Mark Mix, President of National Right to Work. "Schemes like this show that the ultimate goal of union officials is more forced dues collected from workers, even when rank-and-file employees want nothing to do with the union."

A worker?
How easy it is to find one person out of hundreds who doesn't agree with something? Not hard, there is always someone in every group who disagree's. I would say that the hospital is looking for the benefits of having union workers. Training, safety, and it makes good sense. Union workers have been proven time and time again that they are more productive.
Equal opportunity
When any opposing side is barred from speaking, it is unfair to all. Most of the neutrality agreements involving facilities like Chapman did not allow for open dialogue before a representation decision was made. Organizations like Chapman entered into neutrality agreements to gain union support in Sacramento and Washington regarding Medicare and Medi-Cal reimbursement. End result was beneficial to the hospital (reimbursements) and unions (dues) - NOT the employees!

So, I guess that worker should just get a new job, huh? There was fraud here - doesn't matter how "good" union workers are..btw, I work in a unionized public institution and I have to battle the laziness of so many union workers because they are guaranteed their jobs. Sorry, more union workers are out to do the least amount of work possible. That is why they protect it with their lives!!
Fraud?
When your in a union that deals with hundreds of employees like this hospital. Then you vote and a couple of people claim fraud since there side lost, well I call BS. If you had a large % of workers who felt they were cheated then it matters. It's america and majority rules. I've been through votes in our union, and it amazes me when you have 1 or 2 people who claim fraud. Funny thing is they were usually intoxicated.
Check Your Facts
Roofer - you need to check your facts. Look at the neutrality agreement and proposed contracts. In Chapman's case - neither were designed to benefit the employee. The employees we after thoughts. I encourage you to get the documents and check your facts.
Internal problem
I'm from a building and trades union, and if your not up to par on your skills and are worth the money you will get let go. When we ask for higher wages we must produce more. You should look to change your practices in you union. It will be hard and those who are not their worth will try and fight it. You will have to convince the other members who are valuable to accept the change for it will only strengthen your union to have good members.

Roofer - yes your ignorance is amazing. As you say, you come from a construction union. You may want to do your homework before you comment on the HEALTHCARE union neutrality agreements. Trust me, as some who was intimately involved with the SEIU neutrality agreements, you not of which you speak. Otherwise, continue in your bliss - it is only your bliss.
