Local Union and Food Service Contractor Face Federal Prosecution for Workers' Rights Violations

Company and union officials obstruct workers from exercising rights to refrain from union membership and dues payments

Fort Leonard Wood, MO (November 7, 2014) – A local government union and an Overland Park, Kansas-based food services company are facing a federal prosecution for violating Fort Leonard Wood food service workers' rights.

The National Labor Relations Board (NLRB) prosecution comes in the wake of federal charges filed by two workers with free legal assistance from National Right to Work Foundation staff attorneys.

Because Missouri does not have Right to Work protections for workers, workers can be required to pay union dues or fees as a condition of employment. However, under Foundation-won U.S. Supreme Court precedent, nonmember workers can refrain from paying for union boss politics and many other activities.

Kimsha Rosensteel, an 11-year employee with food services provider EDP Enterprises, Inc, was president of the National Association of Government Employees (NAGE) Local R14-139 union for about one and a half years. While she was union president, Rosensteel discovered that the union was failing to follow federal disclosure requirements designed to better inform workers about their rights to refrain from full-dues-paying union membership.

University Hospital Nurse Files Federal Charge Against Major Healthcare Union for Rights Violations

Case underscores need for Right to Work protections in the Show Me State

Saint Louis, MO (May 14, 2014) – A Saint Louis University Hospital nurse has filed a federal charge against a major California-based healthcare union for violating workers' rights.

With free legal assistance from National Right to Work Foundation staff attorneys, Saint Louis University Hospital nurse Brian Hendricks filed the charge with the National Labor Relations Board (NLRB).

National Nurses Organizing Committee (NNOC) union officials enjoy monopoly bargaining powers over the workplace. Because Missouri does not have Right to Work protections making union affiliation completely voluntary, nonmember workers are still forced to pay part of forced union dues to keep their jobs.

In the charge, Hendricks alleges that NNOC union officials are using illegal dues deduction authorization forms that force members to authorize union dues deductions from their paychecks and deny them the right to pay for union dues via check.

Union Bosses Forced to Settle Federal Charges After Illegally Levying Retaliatory $7,300 Strike Fine Against Worker

Worker fined for exercising his right to refrain from formal union membership

Kansas City, MO (July 3, 2012) – A Honeywell nuclear assembly worker has won a settlement from a local union for retaliating against him for exercising his right to refrain from union membership and continue to work during a union boss-instigated strike.

With free legal assistance from National Right to Work Foundation staff attorneys, Daniel Gudde filed a federal charge with the National Labor Relations Board (NLRB) regional office in Overland Park, Kansas after union officials levied a $7,361.36 fine against him.

Gudde began working at Honeywell in late September, believing he had to join the International Association of Machinist (IAM) Local Lodge 778 union. In early October, IAM Local 778 union officials instigated a strike. Gudde and three of his coworkers were unsure if they had to go on strike as union members or if they had to fulfill a required 30-day probationary period of employment.

Union officials told Gudde and his colleagues to continue to work to complete the 30-day probationary period.

Worker fined over $7,300 for exercising his right to refrain from formal union membership

Kansas City, MO (May 9, 2012) – A Honeywell nuclear assembly worker has filed a federal charge against a local union for retaliating against him with a $7,361.36 fine for exercising his right to refrain from union membership and continue to do his job during a union boss-instigated strike.

With free legal assistance from National Right to Work Foundation attorneys, Daniel Gudde filed the charge with the National Labor Relations Board regional office in Overland Park, Kansas on Friday.

Gudde began working at Honeywell in late September believing he had to join the International Association of Machinist (IAM) Local Lodge 778 union. In early October, IAM Local 778 union officials instigated a strike.
